והכא הוא דשייך למימר הכי מפני שהמזמן אוסר על עצמו נכסי המזומן

Explanation #1: Here it is feasible to say so, because the host forbids to himself the property of the invitee;

ומש"ה איכא למימר דדוקא קאמר שאינו רוצה ליהנות ממנו אלא א"כ יקבל הוא ממנו ג"כ הנאה זו דכור א' של חטים וכו' דלאו כלבא הוא

Therefore, we can say that he truly said that he does not want to benefit from him unless he (the invitee) also takes this benefit from him (the host) of a Kor of wheat, for he is not a dog.

אבל במתני' היכי שייך למימר הכי והא המזמן אינו אוסר עליו נכסי המזומן דאדרבה נכסיו הוא אוסר למזומן אם לא יקבל ממנו גם עכשיו הנאה זו

Distinction: However, in our Mishnah, how we can say so? The host does not forbid to himself the property of the invitee. Just the contrary, he forbids his property to the invitee if he will not take this benefit from him also now!

ואחרים אומרים דמשום דהכא בעי למיתן ליה מתנה מרובה משמע דעבד ליה אידך נייח נפשיה דאי לא לא הוה יהיב ליה הך מתנה

Explanation #2: Here, he wants to give to him a big gift. This implies that he (the intended recipient) was very pleasing to him, for if not, he would not give to him this gift;

הלכך שייך למימר לאו כלבא אנא אבל במתני' לא מוכח הכי דעביד איניש להאכיל את חבירו אצלו אף על גב דחבריה לא יהיב ליה מעיקרא מידי.

Therefore, here it is feasible to say [I am not a dog]. However, in our Mishnah, there is no proof [that the intended recipient was pleasing to him], for one often feeds his friend, even if the friend did not give to him anything beforehand.

RAN DH Hareini k'Ilu Hiskabalti [TRANSLATION: I consider it as if I received.]

(SUMMARY: The Ran discusses when one can say "it is as if I received.")

מפרש בפרק מי שאחזו (גיטין דף עד:) דהיינו טעמא משום דלהרווחה דידיה איכוון והא לא אצטריך

Explanation: In Gitin (74), it explains that the reason is because he intended for his [own] benefit, and [now] he does not need it.

ודוקא כשהבנים סמוכים על שולחנו דבכי האי גוונא שייך למימר דלהרווחה דידיה איכוון שלא יצטרך להוציא משלו לצרכן והא לא אצטריך

Limitation: This is only when he feeds [his sons]. In such a case, it applies to say "he intended for his benefit, so he will not need to spend his money for their needs, and he does not need."

ובכי האי הוא יכול לומר כן אבל אין הבנים סמוכים על שולחן אביהם הוי איפכא דלהרווחה דידהו קמכוין

In such a case, he can say [it is as if I received]. However, if the children do not depend on his table, it is the opposite, for he intended for their benefit;

As long as they say "we consider it is as if we received", they permitted the vow. If the father said so, his words have no effect.

Opinion #1: The Rashba wrote that only regarding fulfilling an action, one can say "it is as if I received", since even if he received, he could return it to him;

אף מעכשיו יכול לומר הריני כאילו התקבלתי והחזרתיך דאפוכי מטראתא למה לי

Also now [that he did not receive], he can say "it is as if I received and returned to you." Why should we need to [toil to] pass sacks (in this case, wheat and wine) back and forth?!

אבל בבטול מעשה כגון שאמר נכסי אסורין עליך אם תלך למקום פלוני לא שייך למימר הכי לומר לו הרי הוא כאילו לא הלכת שא"א

However, regarding Bitul of an action, e.g. he said "my property is forbidden to you if you go to place Ploni", it is not applicable to say to him "it is as if you did not go", for it is impossible [to make it as if he did not go].

ואיכא מאן דפליג שאפילו בענין זה יכול לומר כן שאותו תנאי עצמו לא אמרו מתחלה אלא להשלים רצונו

Opinion #2: Some disagree, and say that even in this case he can say that the Tenai itself, from the beginning he said it only to fulfill his desire;

שהיה רוצה שלא ילך ועכשיו כיון שאינו חושש אם ילך אם לא ילך כבר נשלם רצונו.

Explanation: This is not like the Hava Amina, that the host was Madir the invitee. If so, even without Ones, it is permitted, for this is Nidrei Zeruzin;

Therefore, the reason [he is permitted] is because he fell sick. If not for this, it is a Neder.

דליכא למימר לזרוזיה איכוון שהרי לא היה צריך לזרז אותו דאדרבה הוא בקש ממני שיזמיננו.

We cannot say that he intended to urge him, for he did not need to urge him. Just the contrary! He asked him to invite him!

Answer #1: Here, even though "I am not a dog" could apply, for he forbids to himself Hana'ah from the invitee if the invitee will not accept this Hana'ah from him., and therefore, we could say that he truly vowed...

אפילו הכי א"ר אליעזר בן יעקב דנדרי זרוזין הן

Even so, R. Eliezer ben Yakov says that it is Nidrei Zeruzin.

Consequence: Based on this, we find that the rejection above, that even R. Eliezer ben Yakov agrees whenever one could say "I am not a dog", is a mere Dichuy (a flimsy rejection). It is not true.

Answer #2: According to the other explanation that we wrote above, that the reason for "I am not a dog" is because we distinguish between a big gift and a small gift...

Here, the reason it says "even further" is not because we are not concerned for the reason "I am not a dog";

Rather, it says "even further" because one might have thought that since he specifies and says "hot bread and a cup of hot [drink]", he truly vowed, and it was not mere urging. He teaches that this is not so. Also this is Nidrei Zeruzin.

Consequence: Based on this, what we said initially is still true, that whenever one could say "I am not a dog", i.e. regarding a big gift, even R. Eliezer ben Yakov agrees.

Explanation #2: I say that there is no need to say so. Rather, initially when we asked whether Rabanan argue with him, we asked in order to determine the truth of the matter;

דאי פליגי עליה אפשר דלא קי"ל כוותיה דיחיד ורבים הלכה כרבים

If they argue with him, it is possible that the Halachah does not follow him, for when an individual argues with a Rabim, the Halachah follows the Rabim;

וכדמסקי' בבעיין אם תמצא לומר פליגי הלכתא כוותיה או לית הלכתא כוותיה

This is like the conclusion of our question. If you will say that they argue, does the Halachah follow him, or not?

אבל השתא דמקבע רב הונא הילכתא כוותיה במאי דאפליגו רבנן עליה אפילו אם תמצי לומר דאברייתא קאי אבל במתני' מודו ליה רבנן לא נפקא לן מינה מידי

However, now that Rav Huna fixed the Halachah like him, in what Rabanan argue with him about, even if you will say that he refers to the latter case, but Rabanan agree in our Mishnah, this makes no difference.

עוד נראה לי דכיון דאמר רב הונא סתמא הלכה כר' אליעזר משמע דאמתני' קאי שהמשנה היתה שגורה בפי הכל ולא הברייתא.

Explanation #3: Since Rav Huna said Stam "the Halachah follows R. Eliezer", this implies that he refers to the Mishnah, which was fluent in everyone's mouth, and not the Beraisa.

We hold like this, and retract from what we said above in our Sugya, that R. Eliezer ben Yakov agrees whenever one could say "I am not a dog" that it is a real vow. In the conclusion, this is not true, like we wrote.

ומיהו אע"ג דהדרינן מטעמא דלאו כלבא אנא טעמא דלאו מלכא אנא אכתי איתיה ומודי ביה רבי אליעזר

However, even though we retracted from the reason "I am not a dog", the reason "I am not a king" lasts. R. Eliezer agrees [when it applies].

Opinion #2: However, according to the other explanation that I wrote above, that the reason "I am not a dog" (and therefore, he truly vows) is because he gave a big gift, this is [true] also in the conclusion;

RAN DH Masnisin Nidrei Havai [Vows of exaggeration.]

(SUMMARY: The Ran explains the two kinds of Nidrei Havai.)

אמר קונם אם לא ראיתי בדרך הזה כעולי מצרים אם לא ראיתי נחש כקורת בית הבד,

Explanation: He said "Konam if I did not see on this road like Olei (as many people as came up from) Mitzrayim", or "if I did not see a snake like the beam of the olivepress."

נראה לי דתנא תרי גווני נקט חד דשייך ביה גוזמא דהיינו כעולי מצרים דעביד איניש דכי חזי אינשי טובא גזים ואמר כעולי מצרים

It seems to me that he mentioned two kinds [of Nidrei Havai]. In one, exaggeration applies, i.e. "like Olei Mitzrayim." People are prone, when they see a great multitude, to exaggerate and say that it was like Olei Mitzrayim;

וחד לא שייך ביה גוזמא דהיינו נחש כקורת בית הבד

Exaggeration does not apply to the other, i.e. "a snake like the beam of the olivepress";

דכיון דמפרשינן בגמרא דלא נחש גדול קאמר אלא טרוף לא שייך למימר דרך גוזמא טרוף כקורת בית הבד שאין שום נחש טרוף כלל

Since we explain in the Gemara that he does not discuss a big snake, rather, creviced, we cannot say that he said so like exaggeration, that it was creviced like the beam of the olivepress, for no snake is creviced.

ואשמועינן תנא דכי תלה איסור פירות בחד מהני נדרו בטל וכל חד וחד טעמיה לחוד

Explanation (cont.): The Tana teaches that when he made an Isur on Peros dependent on one of these, his vow is Batel. Each has its own reason;

דכי אמר קונם עלי פירות אם לא ראיתי בדרך הזה כעולי מצרים בדין הוא דלא לתסרו עליה דקושטא קאמר כיון שראה עם רב דעביד איניש דגזים בכי ה"ג

When he said "Konam Alai Peros if I did not see on this road like Olei Mitzrayim", it is proper that they are not forbidden to him, since truly, he saw a multitude that people often exaggerate about like this;

When he said "if I did not see a snake like the beam of the olivepress", also then the Peros are permitted, for a different reason;

Even though surely he lies, for even in the way of exaggeration, one cannot say so, even so, the Peros are permitted;

משום דאמדינן ליה לדעתיה שלא לאסור את הפירות נתכוון שא"כ לא היה לו לתלות איסורו בתנאי אלא היה לו לאסרם עליו במוחלט

This is because we estimate that he did not intend to forbid the Peros. If he did, he should not have attributed the Isur to a Tenai. He should have forbidden them absolutely!

שהרי אף כשהתנה בכיוצא בזה אין לתנאו ענין שהדבר ברור שלא ראה נחש כזה שאין בין אוסר סתם למתנה בכיוצא בזה כלום

Source: Even when he made such a Tenai, his Tenai does not take effect, for it is clear that he did not see a snake like this. There is no difference at all between one who forbids Stam, and one who makes a Tenai like this.

אלא ודאי אמרי' שלא לאסור פירות בא אלא לומר דברי הבאי זה כלומר שראה נחש כקורת בית הבד

Rather, surely we say that he did not come to forbid the Peros, rather, to say this vain matter, that he saw a snake like the beam of the olivepress.

It did not teach there "[if I did not see] like Olei Mitzrayim", for in such a case one is not lashed for Shevu'as Shav, for in the way of exaggeration, he says the truth.

Implied question: Why didn't the Tana teach here "[if I did not see] a camel flying in the air"?

This is [like] the Mishnah there in Shevuos, which teaches there that in such a case, he is lashed for Shevu'as Shav;

Gemara - Question: What are oaths of exaggeration? If you will say that he said 'if I did not see on this road like [the number that] left Egypt', did he say anything? He said a Shevu'as Sheker!

כלומר שאין ללשון זה שום משמעות ולשקר לאו דוקא אלא כלומר ללא דבר כדכתיב קרא אך לשקר שמרתי (שמואל א כה).

Explanation: I.e. there is no meaning to this expression. 'Sheker' is not precise. Rather, it is for nothing, like "Ach la'Sheker Shamarti."

RAN DH d'Amar Shevu'ah she'Ra'isi [TRANSLATION: He said, a Shevu'ah that I saw.]

ר"ן ד"ה דאמר שבועה שראיתי

(SUMMARY: The Ran explains that Abaye establishes the Beraisa to discuss only one kind of Shevu'os Havai.)

ונראה בעיני דסבירא ליה לאביי לפום אוקימתיה דכי קתני כך שבועות הבאי מותרות לאו אכולהו גווני דמתני' קאי

Explanation: It seems to me that Abaye, based on how he establishes the Beraisa, holds that when it taught that Shevu'os Havai are permitted, it does not refer to all the kinds in our Mishnah;

דבמידי דלא שייכא ביה גוזמא ליכא למימר שתהא שבועתו מותרת דשבועת שוא הויא

Regarding something to which exaggeration does not apply, you cannot say that his Shevu'ah is permitted, for it is Shevu'as Shav.

וליכא למימר מ"מ הפירות מותרות

Suggestion: Perhaps in any case, the Peros are permitted (so it is proper to teach 'permitted')!

דהא אביי לא במתנה באיסור פירות מוקים לה

ii.

Rejection: Abaye does not establish [the Beraisa] to discuss one who attributed an Isur Peros [to what he saw]!

אלא לאביי הכי קתני כשם שנדרי הבאי מותרין כך שבועות הבאי של גוזמא מותרות

Rather, Abaye establishes it to teach that just like Nidrei Havai are permitted, also Shevu'os Havai of exaggeration are permitted;

דלא תימא כיון דשבועה חמורה לא גזים בה איניש ובדוקא קא משתבע ולקי משום שבועת שוא

[It teaches that] you should not say that since a Shevu'ah is severe, people do not exaggerate in it, and he truly swears, and he is lashed for Shevu'as Shav;

דליתא אלא עביד איניש דגזים בשבועות כי היכי דגזים בנדרים.

ii.

This is wrong. Rather, people are wont to exaggerate in Shevu'os, just like they exaggerate in Nedarim.

ר"ן ד"ה ומקשי ליה רבא א"כ למה ליה למימר

Gemara: Rava challenged him - if so, why did he need to say so?!

כלומר דאי אמידי דשייך ביה גוזמא בלחוד קאי פשיטא דשבועות נמי מותרות דכיון דגזים ואמר קושטא קאמר

Explanation: If it refers only to something to which exaggeration applies, obviously, also Shevu'os are permitted. Since he exaggerates, he says the truth!

RAN DH u'Od Dumya d'Neder ka'Tani [TRANSLATION: And also, he taught similar to a Neder.]

ר"ן ד"ה ועוד דומיא דנדר קתני

(SUMMARY: The Ran explains Rava's second objection.)

כלומר דכשם שנדרים מותרין בהנהו תרי גווני דמתני' כך שבועות מותרות בהנהו תרי גווני גופייהו

Explanation: Also, they were taught similarly to Neder. I.e. just like Nedarim are permitted in these two cases of our Mishnah, also Shevu'os are permitted in these very two cases;

ואי שבועה שראיתי קאמר אי אפשר שתהא מותרת בנחש (הגהות ישנות) כקורת בית הבד ודכוותיה
