UNTIL WHEN CAN A HUSBAND ANNUL NEZIRUS? (Yerushalmi Perek 4 Halachah 5 Daf 18b)

(a)

(Mishnah): After Zerikah (throwing the blood on the Mizbe'ach) of one of the Korbanos, [a husband] cannot annul [his wife's Nezirus];

R. Akiva says, even after Shechitah of any one of the animals, he cannot annul.

This applies to Tiglachas (shaving after finishing Nezirus in) Taharah. However, regarding Tiglachas Tum'ah, he can annul it, for he can say 'I do not want a repulsive wife.'

Answer (R. Yosi bei R. Bun citing R. Yosi ben Chanina): It is a Gezeiras ha'Kasuv - "v'Hafar Es Nidrah [Asher Aleha". We expound as if it said] v'Hafar Es Mah she'Aleha. When he annuls her vow [of Nezirus], he annuls [the Chiyuv to shave] upon her. (Her vow was only for Isurim of wine, shaving and Tum'ah; the obligation to shave at the end is a result. When he cannot annul the Isurim of the vow, for they were already permitted, he cannot annul just due to the Chiyuv to shave at the end. We explained this like SEFER NIR.)

(f)

(R. Lazar): [Our Mishnah] is like R. Shimon [who says that once one Korban is offered, all Isurim of Nezirus cease].

(R. Yochanan): It is like everyone. Once the Lav ("Lo Yishteh") was uprooted and reduced to an Aseh ("v'Achar Yishteh ha'Nazir Yayin", all agree that he cannot annul);

R. Shimon says, even after one action (one Korban).

Support (for R. Lazar - Chizkiyah - Mishnah): This applies to Tiglachas Taharah, but regarding Tiglachas Tum'ah, he can annul it, for he can say that he does not want a repulsive wife.

äà úâìçú èäøä àéðä îðååìú

1.

Inference: [He cannot annul] Tiglachas Taharah [for] she is not repulsive! (Only Tiglachas Tum'ah is repulsive, for also afterwards she must repeat Nezirus and refrain from wine.)

îàï ãàéú ìéä úâìçú [ö"ì èäøä - ÷øáï äòãä] àéðä îðååìú ìà øáé ùîòåï

2.

Who holds that [he cannot annul] Tiglachas Taharah [for] she is not repulsive - is it not R. Shimon [for she is already permitted wine]?

(i)

(R. Yosi bar Avin): Also Rebbi holds like [R. Shimon]. Rebbi says, even [if it is] Tiglachas Taharah, he can annul, for he can say 'I do not want a shaved wife.' [If he argues with R. Shimon,] he should say 'I do not want a repulsive and shaved wife'!

(R. Yochanan): R. Akiva said [that after Shechitah of one of the animals, he cannot annul] only regarding Chatas, for it is Pasul Lo Lishmah. (The other Korbanos, we can do Zerikah Lo Lishmah, and they are Kosher b'Di'eved.)

Question: If so, even [after separating the Chatas,] in its lifetime [he should not be able to annul due to Hefsed Kodshim, for then the Chatas must die]!

Answer: It is given to Hekdesh (absolutely) only through Shechitah. (Before Shechitah, she can ask a Chacham to permit her Hekdesh, which was mistaken, but not after Shechitah, for then retroactively they slaughtered Chulin b'Azarah - R. MEIR SIMCHAH.)
