TOSFOS DH 'AMAR REBBI YOSSI, BAMEH DEVARIM AMURIM, BE'DINEI NEFASHOS'.

תוס' ד"ה 'אמר רבי יוסי, 'במה דברים אמורים, בדיני נפשות'.

(SUMMARY: Tosfos refutes Rashi's explanation [that the Gemara's distinction between Nefashos and Mamon pertains to saving the defendant]. In their opinion, the Gemara is talking about the testimony of Nefashos being negated, but not that of Mamon]).

פי' הקונטרס, משום דכתיב "והצילו העדה" דמצוה לבטל העדות בקל כדי להציל הנפש.

(a)

Explanation: According to Rashi this is because the Torah writes "ve'Hitzilu ha'Eidah", rendering it a Mitzvah to negate the testimony with ease in order to save a life.

וקשה לפירושו, דא"כ דיני ממונות נילף מינייהו, דהא כתיב "משפט אחד יהיה לכם"?

(b)

Question #1: Based on the Pasuk in Emor "Mishpat Echad Yih'yeh lachem, we ought then to learn Mamon from Nefashos?

ועוד, דבדיני ממונות נמי כתיב "ע"פ שנים או ע"פ שלשה עדים" ונקיש ג' לב'?

(c)

Question #2: Furthermore, the Torah specifically writes by Manon too "al-Pi Shenayim O Sheloshah Eidim", in which case the same ought to apply to Mamon?

לכך פירש ר"י, דבדיני נפשות שייך שפיר למילף מ"שנים" דעדותן בטלה, משום דמה שנים כי נמצא אחד מהן קרוב או פסול עדותן בטלה לגמרי, ומעתה אינה מועלת לכלום; הלכך ב"שלשה" נמי כולם בטלים לגמרי. אבל בדיני ממונות ד"בשנים" נמי כי נמצא אחד מהן קרוב או פסולת השני אינו בטל לגמרי דחייב לו שבועה; לכך ["שלשה"] נמי נמצא אחד מהן קרוב או פסול תתקיים העדות בשאר עדים.

Answer: Therefore the Ri explains that by Nefashos it is feasible to learn from "Shenayim" that by "Sheloshah", their testimony is negated, because if one of "Shenayim" is found to be related or Pasul, the entire Eidus becomes meaningless. Whereas by Mamon, where even if one of "Shenayim" turns out to be related or Pasul, the remaining witness is still valid to make the defendant swear, by "Sheloshah" too, if one of them turns out to be related or disqualified, the testimony of the remaining two remains intact.

TOSFOS DH 'AMAR RAVA, VE'HU SHE'HE'IDU KULAM BE'TOCH K'DEI DIBUR'

תוס' ד"ה 'אמר רבא' והוא שהעידו כולם בתוך כדי דיבור'.

(SUMMARY: Tosfos refutes Rashi's explanation that 'Toch K'dei Dibur' pertains to Karov u'Pasul as well. According to them, it is confined to the Din of Eidim Zom'min, and they go on to explain the difference).

[פ"ה], ובהא קאמרה מתניתין ד'מאה כשנים', אבל אם העידו השנים ולאחר זמן העידו האחרים הרי הן שתי כתי עדים לכל דבר. משמע, דקאי אף לענין קרוב או פסול.

Explanation: Rashi explains that this pertains to our Mishnah, which rules that 'a hundred are like two'. But if two witnesses testify now, and the rest later, it is considered two sets of witnesses in all regards. This implies that 'Toch K'dei Dibur' also applies to the Din of 'Karov O Pasul'.

וקשה, דהא משמע בסמוך דלענין דין דקרוב או פסול אינו תלוי בהעדאה בתוך כדי דיבור, אלא בראיית מעשה גמרה עדותן, אף כי העידו אחר תוך כדי דיבור; דקאמר 'הרוג יציל'?

(b)

Question: The Gemara a little later implies that the Din of 'Karov O Pasul' is not dependent upon testifying 'Toch K'dei Dibur', but that the testimony is concluded at the time that the witnesses saw the act that they are testifying on?

לכך נראה, דלא קאי רק אדין דעדים זוממין, דקאמר 'עד שיזומו כולם' ובהא קאמר דוקא כי העידו כולם בתוך כדי דיבור דזה הוי עדות אחד ובעינן 'עד שיזומו כולם', אבל העידו מקצתן בתוך כדי דיבור ומקצתן אחר כדי דיבור, א"כ הוי שתי כתות ולא בעינן עד שיזומו כולם; אבל לענין נמצא אחד קרוב או פסול אף אם נמצא מהני שהעידו לאחר כדי דיבור עדותן בטלה.

Answer: It therefore appears that the Din of 'Toch K'dei Dibur' is confined to the Din of Eidim Zom'min (to the Din of 'ad she'Yazumu Kulan').

וא"ת, מ"ש?

Question: Why the difference?

ויש לומר, שנא ושנא! דדוקא גבי נמצא אחד מהן קרוב או פסול חשיב כחד עדות כשהעידו לאחר כדי דיבור, משום שהם אומרים אמת; וא"כ עדותן התחיל מראייה שלהם, וראייה שלהם היתה בבת אחת עם העדים הכשרים; אבל בעדים זוממין, שאינן אומרים אמת, אם כן לא בא עדותן אלא כשיעידו בבית דין, וכיון דלא העידו בבת אחת רק לאחר כדי דיבור, לא חשבינן כחד עדות (כן נראה למשי"ח).

Answer: There is a big difference, inasmuch as in the case of 'Karov O Pasul', where the witnesses are telling the truth, they, together with the Kasher witnesses, are considered one group, by virtue of the fact that they witnessed whatever it is that they are testifying on simultaneously; Whereas Eidim Zom'min, who did not actually see anything, only become witnesses when they testify in Beis-Din. Consequently, if they do not testify 'Toch K'dei Dibur' of the remaining witnesses, they are considered two groups. So it seems according to Mashi'ach (Mori she'Yichyeh).

TOSFOS DH 'ELA ME'ATAH HARUG YATZIL'?

תוס' ד"ה 'אלא מעתה הרוג יציל'?

(SUMMARY: Tosfos gives two reasons to explain why the victim should save the murderer)

פירוש, שהוא בעל דין; אי נמי מפני שהוא שונא, ושונא פסול לעדות (ועיין תוס' יבמות כה. ד"ה הוא וכו' באריכות).

(a)

Carification: Either because he is a Ba'al-Din (a party in the case); or because he hates the murderer, both of which ought to invalidate his testimony.

TOSFOS DH 'NIRVA YATZIL'?

תוס' ד"ה 'נרבע יציל'?

(SUMMARY: Tosfos proves that the Gemara's Kashya is not because the Nirva hates the Rove'a (for forcibly raping him), but rather because the rape took place with the Nirva's consent, and that he will save the Rove'a because he [the Nirva] is his own relative).

מפני שהוא שונא של רובעו בעל אונסו.

(a)

Explanation: The Nirva ought to save the Rove'a because, in his capacity as a victim, he hates him (as we learned in the previous Dibur).

ולא נראה, דהא מוכח פ"ק דסנהדרין (דף ט: ושם) דנרבע לאנסו כשר לעדות?

(b)

Refutation: That does not seem correct however, based on the Gemara in Sanhedrin, which permits a person who was forcibly raped to testify.

ויש ליישב, דמנרבע לרצונו פריך, דבהכי איירי קרא, דכתיב "ומתו גם שניהם" דהיינו ברצון; ולהכי פריך 'יציל הנרבע' אפילו יש עדים הרבה בדבר, ולא מפני ששונאו כיון שהוא לרצונו, אלא מפני שהוא קרוב לעצמו.

(c)

Alternative Explanation: In fact, the Gemara is asking from someone who was a willing partner in the relationship, since that is what the Pasuk (which rules that they must both be sentenced to death) is talking about, and the reason for the suggestion that the Nirva saves the Rove'a (and himself) from the death penalty is because he is his own relative.

וקשה, דבמסכת סנהדרין (שם) אמרינן ' "פלוני רבעני לרצוני' ,הוא ואחר מצטרפין להרגו'?

(d)

Question: We learned in Sanhedrin that if Reuven testifies that Shimon had relations with him with his consent, he and Levi combine to have Shimon sentenced to death?

וי"ל, דהני מילי כי ליכא סהדותא מעלמא דרבעו לרצונו, וליכא סהדותא אלא מהוא עצמו ואחר; ולכך פלגינן לדיבוריה, דלגבי דידיה לא מהימנין ליה דקרוב הוא אצל עצמו. אבל הכא, דאיכא עדים שנרבע לרצונו ומעדותן נקרא רשע ופסול לעדות, דאין אנו צריכין לעדותו כלל.

(e)

Answer: The reason for the latter ruling is because of the principle 'Palginan le'Dibureih' (We split his testimony, believing Reuven's testimony on Shimon, but not on himself. That itself is confined to where his testimony has no external backing; but where there are two witnesses who support his claim that he consented to the 'rape', he is a Rasha, and his testimony is disqualified.

ועוד אמר הר' יוסף בכור שור, דפריך הכי ,נרבע (שהוא קרוב לרובע) יציל' וכן 'הרוג (שהוא קרוב להורג) יציל'.

Alternative Answer: Alternatively, the Gemara is asking from a Nirva (and, in the previous case) a Harug) who is a relation of the Rove'a and of the Horeig (respectively).

TOSFOS DH 'HEICHI AMRINAN L'HU'?

תוס' ד"ה 'היכי אמרינן להו'?

(SUMMARY: Tosfos explains why the Gemara is asking specifically from a case of Dinei Mamonos (but not on one of Dinei Nefashos).

קאי אדיני ממונות; בשלמא אדיני נפשות לא קשה 'היכי אמרינן להו', דניחזי אנן, אם התרו בו הקרוב ופסול אם לאו? אלא פריך בדיני ממונות דליכא התראה

(a)

Explanation: The question is confined to Dinei Mamonos (where the Eidim do not need to warn), but not to Dinei Nefashos, where they do, in which case we will immediately know whether they warned the Karov or the Pasuk or not.

TOSFOS DH 'LE'AS'HUDI ASISU'?

תוס' ד"ה 'לאסהודי אתיתו ... '?

(SUMMARY: Tosfos discusses a. how to avoid the relatives of a murderer from disqualifying the witnesses by claiming that they too, witnessed the murder, and b. on what grounds we believe the Kasher witnesses to disqualify their own testimony by claiming that they came to testify together with the Pesulim).

קשה, דאם כן, לא יהרג אדם לעולם, דהקרובים יבואו ויאמרו 'לאסהודי אתינו'?

(a)

Question: Seeing as we ask the witnesses why they came to Beis-Din, the murderer's relatives will always come to Beis-Din and claim that they came to testify, thereby invalidating the Kasher witnesses, with the result that nobody will ever be sentenced to death?

ופירש רבינו חיים כהן, דאמרינן לעדים כשרים 'לאסהודי עם הפסולין אתיתו, אם למיחזי אתיתו בלא הפסולין'? ואי אמרי הכשרים 'למיחזי אתינו בלא הפסולים', אז לא הוי עדותן בטלה, אפילו אם נמצא אחד מהן קרוב או פסול; אבל אי אמרי 'לאהסהודי אתינו עם הפסולין' הוי עדותן בטילה.

(b)

Answer: R. Chayim Kohen therefore explains that we ask the Kasher witnesses whether they intended to testify together with the Pesulim or not. Should they answer in the negative, then their testimony is accepted (even if one of them turns out to be a relative or Pasul; and it is only if they reply in the positive that their testimony is invalidated.

ומכל מקום תימה קצת, היאך יהיו גם העדים כשרים נאמנים לומר 'לאסהודי אתינן' כדי לבטל העדות; הוו ליה כחוזר ומגיד, כיון שכבר העידו?

Question: Based on the principle 'Keivan she'Higid, Shuv Eino Chozer u'Magid' (once a witnesses has testified, he does not have the authority to retract), on what grounds do we believe the Kasher witnesses to disqualify their own testimony (in the latter case), seeing as they have already testified?

וי"ל דסברא דכיון דבאין לבית דין עם הכשרים עכשיו, נראין הדברים שמתחלה כולהו לאסהודי קא אתו דהוכיח סופן על תחלתן.

Answer: The answer lies in the fact that the Pesulim came to Beis-Din together with the Kesherim, which bears out their latter statement.

TOSFOS DH 'SHMUEL OMER HALACHAH KE'R. YOSSI'

תוס' ד"ה 'שמואל אומר, הלכה כרבי יוסי'.

(SUMMARY: Tosfos discusses a. how to avoid the problem of relatives invalidating a Get by their very presence, both according to R. Yossi and according to Rebbi, and b. in light of the solution, why the Gemara asked earlier 'Harug Yatzil'?)

קשה, היאך מצינו ידינו ורגלינו כשנותנין גט שיש במעמד קרובים? והיה לנו לומר דעדות הכשרים בטל והאי דומיא דדיני נפשות דשרינן אשת איש שיש בה מיתת בית דין; וטעם דפרישית לעיל גבי עדות נפשות שייך נמי בגט?

(a)

Question #1: Seeing as we rule like R. Yossi, we need to understand how it is, that relatives who are present at a Get ceremony, do not automatically invalidate the Get?

וגם לרבי נמי קשה, שפעמים יתכוין אחד מן הקרובים להעיד?

(b)

Question #2: In fact, the same question will apply even according to Rebbi, there where even just one of the relatives intended to testify?

לכן נראה לר"י, דגם לר' יוסי לא אמרו דעדותן בטלה אלא דוקא באותן שמעידים בפני ב"ד, אבל בשביל ראייה לחודה לא.

(c)

Answer: The Ri therefore explains that even, according to R. Yossi, the Chachamim only disqualified the witnesses via Pasul witnesses who actually testify in Beis-Din, but not if they merely witnessed the event.

וא"ת, א"כ מאי פריך 'הרוג יציל' והא אינו הולך להעיד בבית דין?

Question: That being the case, what prompted the Gemara to ask earlier 'Harug Yatzil', seeing as the victim did not testify in Beis-Din?

ואומר הר"י, דודאי מתחלה היה סבור הש"ס לרבי יוסי כי נמי אינן באין להעיד בב"ד עדותן בטלה, ומשני 'במקיימי דבר הכתוב מדבר' כלומר, כשבאין לקיים הדבר בבית דין אמר רבי יוסי נמצא אחד מהן קרוב או פסול דעדותן בטלה.

Answer: To answer the question, the Ri explains that the Gemara initially thought that Pasul witnesses invalidate the testimony by merely witnessing the event. And when the Gemara answered 'במקיימי דבר הכתוב מדבר', it actually meant that it is only witnesses who came to Beis-Din to testify who invalidate, which is precisely what R. Yossi is referring to when he says 'Nimtza Echad Meihen Karov O Pasul, Eidusan Beteilah'.

ואם תאמר, א"כ מאי פריך לעיל 'מה יעשו שני אחין וכו' והלא אין שום חששא אם לא יבאו להעיד בבית דין כדפרישית?

(d)

Queston: Then why does the Gemara ask above 'What should two brothers do who witnessed a crime? What is the problem? Let one of them simply not go to Beis-Din?

ויש לומר, משום דפעמים שלא ידע זה בזה ויעיד האחד אע"פ שכבר העיד אחיו בב"ד.

(e)

Answer: The Gemara's Kashya is based on the probability that, after one of the brothers has already testified, the other, unaware that he has, will go to Beis-Din and testify too.

ואפילו אירע לאחר כדי דיבור?

(f)

Implied Question: Seeing as the second brother testifies after Toch K'dei Dibur, why should it worry us?

מכל מקום עדותן בטלה, משום דמקשינן שלשה לשנים לענין נמצא קרוב או פסול בזה אחר זה, אע"פ דלענין הזמה בעינן 'תוך כדי דיבור'.

(g)

Answer: This is no problem, because even though Eidim Zom'min must testify 'Toch K'dei Dibur in order to be considered one Eidus, this is not necessary regarding Karov O Pasul (as we explained earlier).

TOSFOS DH 'VE'ECHAD MASREH BE'EMTZA'

(SUMMARY: Tosfos explains why the Mishnah says the Masreh is not one of the witnesses.)

תימה ,ואמאי הוצרך לומר ואחד מתרה שאין מן העדים?

(a)

Question: Why does the Mishnah need to add that the person warning is not one of the witnesses?

ויש מפרשים, דנקטיה משום רישא דקתני 'רואין אלו את אלו', ומסתמא היינו ע"י המתרה שאומר לעדים לאלו ואלו ראו את המעשה הרע שזה עשה.

(b)

Answer #1: Some answer that it is because the Reisha, which states that they saw each other through the window, which is presumably via the person who is standing in the middle and warning.

ונראה למשי"ח, דנקטיה לאפוקי מדרבי יוסי, דאמר בסיפא אינו חייב עד שיהו פי שנים עדים מתרין בו.

(c)

Answer #2: Mashi'ach however, explains that it is to counter the opinion of R. Yossi, who states in the Seifa that only the witnesses are eligible to warn the defendant.

TOSFOS DH 'SHE'MIKTZASAN RO'IN EILU ES EILU'

תוס' ד"ה 'שמקצתן רואין אלו את אלו'.

(SUMMARY: Tosfos explains that they combine with those who cannot see).

מצטרפין יחד, אף אותם שאין רואים.

(a)

Clarification: Those who can see the event combine with those who cannot, to be included in the group of witnesses.

TOSFOS DH 'HAREI EILU EIDUS ACHAS'

תוס' ד"ה 'הרי אלו עדות אחת'.

(SUMMARY: Tosfos presents three respects in which they are considered to be one Eidus).

- שאם נמצא אחד מהן קרוב או פסול, עדות כולם בטלה. וכן שאם נמצא אחת מ הן זוממת, אין נהרגין עד שיזומו כולם, ובטלין נמי עדות כולם בהזמה אחת מהן דהזמה הוי, כנמצא אחד מהן קרוב או פסול.

(a)

Explanation: They are all considered one set of Eidim in that a. If one of them turns out to be a Karov or Pasul, the entire Eidus is disqualified, b. if only one of them becomes an Eid Zomem, they cannot be sentenced to death, until they all become Zom'min, and c. That if one of them is found to be an Eid Zomem, the entire Eidus is Bateil (like in the first case).

TOSFOS DH 'HU VE'HEIN NEHERAGIN'.

תוס' ד"ה 'הוא והן נהרגין'.

(SUMMARY: Tosfos discusses a. How, when there are two sets of witnesses, the status of one does not affect the status of the other, and b. the role of the person in the middle who is warning, and whether he needs to be part of the Eidus or not).

'הן נהרגים', אע"פ שלא הוזמו כת שניה, כיון שהוזמו הן; 'הוא נהרג', משום כת שניה דלא בטלה עדות כת שניה בהזמת הראשונה כיון דהוי שתי עדיות.

(a)

Clarification: They are sentenced to death because they are Zom'min, irrespective of the fact that the second group are not; He is sentenced to death because the the second group did not become Zem'min, even though the first group did.

יש מפרשים, שצריך שתהא כל כת וכת רואה המתרה או המתרה רואה אותן, אז מצטרף המתרה לזו ולזו; דאם לא כן אין המתרה מצטרף עמהן ולא יהרג על פיהם; דלעולם אינו נהרג אא"כ המתרה מעדות שבאין לחייבו. והא דקתני נמי 'נמצא אחת מהן זוממת' שהוזם גם המתרה עמהם, דהא מעדותן הוא כדפרישית.

(b)

Explanation: There are those who explain that each group must see the Masreh (the person warning), or vice-versa, for the latter to combine the two groups; Otherwise, they will not combine and the defendant will not be put to death by their testimony; This means that the Masreh must be part of the Eidus.

והא דקתני נמי 'נמצא אחת מהן זוממת' שהוזם גם המתרה עמהם, דהא מעדותן הוא כדפרישית. ומ"מ הוו השתי כתות שתי עדיות, כיון שאין כת זו רואה את זו.

(c)

Conclusion: Consequently, when the Mishnah refers to one of the groups becoming Zom'min, it incorporates the Masreh too. Nevertheless, the two groups are considered two sets of`witnesses, seeing as they could not see each other when they witnessed the event.

וקשה למשי"ח, מאי קאמר? דאדרבה, לא מיתוקמא מתני' אלא כשאין רואין המתרה, וכן אין המתרה רואה אותן; דאי רואין המתרה או המתרה רואה אותם הוו השתי כתות עדות אחת, אע"פ שאין רואין זה את זה, דהמתרה מצרפן כדקתני רישא 'בזמן שמקצתן רואין אלו את אלו'; אלמא לא בעינן שיהא כל השנים שמכאן רואין את אלו מכאן אלא בחד סגי?

Question #1: 'Mashi'ach's answer is problematic however, in that on the contrary, the Mishnah can only speak where neither can the Eidim see the Masreh, nor can he see them; because if they can, the two sets of Eidim will combine to become one set? This is because, despite the fact that the two sets of Eidim cannot see each other, the Masreh combines them ...

כדקתני רישא 'בזמן שמקצתן רואין אלו את אלו'; אלמא לא בעינן שיהא כל השנים שמכאן רואין את אלו מכאן אלא בחד סגי?

Proof: ... as we learned in the Reisha, which speaks about some of the witnesses seeing each other; from which we can extrapolate that the two sets of witnesses do not need to see each other, and one (in the middle) will suffice.

ועוד קשה לפי' דצריך שיהא המתרה מעדותן הא אמרינן בגמ' מתרה שאמרו אפי' מפי עצמו, אפי' מפי שד, ואז ודאי לא הוי המתרה מעדותן כלל?

Question #2: Furthermore, we query the fact that he requires the Masreh to be part of the Eidus, from our Sugya, which allows even the victim himself or a demon to serve as the Masreh, in which case, he will certainly not be part of the Eidus?

לכן נראה, דודאי מיירי כשאין רואין המתרה ולא המתרה רואה אותם אלא שמעו המתרה שמתרה כן, ובכן סגי, דהא קיימינן לרבנן דפליגי ארבי יוסי דבסמוך ולא בעו פי שנים עדים מתרין בו כמו רבי יוסי.

(d)

Alternative Explanaion: The Mishnah must therefore be speaking where neither they saw the Masreh nor did the Masreh see them; and what happened was that the Eidim overheard the Masreh issuing his warning, and that will suffice to validate their testimonies. Bear in mind that we hold like the Rabbanan of R. Yossi, who do not require the witnesses to do the actual warning.

TOSFOS DH 'LE'EIDUS MEYUCHEDES SHE'HU PASUL'

(SUMMARY: Tosfos explains this statement and points out that it has nothing to do with our Mishnah).

Clarification: One from one window and one from another window. This is an independent issue; it does not pertain to the Mishnah, which is not talking about that.

TOSFOS DH 'TANYA NAMI HACHI ... '.

(SUMMARY: Tosfos discusses whether the Gemara is coming to prove the source of Eidus Meyuchedes or the basic ruling).

מייתי 'תניא נמי הכי' ד"מלא יומת על פי עד אחד" נפקא, דאילו עיקרא דמילתא שמענו ממתניתין; דנהי דמתניתין לא איירי באחד מחלון זה, מ"מ מדאשמעינן בשתי כתות דחשבינן שתי עדיות כשאין רואין אלו את אלו, מינה שמעינן דה"ה בכת אחת.

Explanation #1: The Beraisa proves that the source for the Din of Eidus Meyuchedes is the Pasuk "Lo Yumas ... ", rather than to prove the actual Halachah, which we know from our Mishnah, which, granted is not speaking about two individual witnesses, is nevertheless speaking about two groups of witnesses who do not see each other, from which we can extrapolate the Din regarding one pair.

מכל מקום, נראה יותר לפרש דעיקר מילתא מייתי, דאי ממתניתין הוה אמינא דוקא בשתי כתות, דכל חדא חשיב עדות באפי נפשה אבל בכת אחת מצטרפי שפיר.

Explanation #2: It is more likely however, that we cite the Beraisa to prove the actual Halachah. In fact, we would not have known it from our Mishnah, which is speaking specifically about two sets of Eidim, each of which is an Eidus in itself, wich is not the case by two individual witnesses.

וכן נראה, דיותר דוחק לומר דלא מייתי 'תניא נמי הכי' רק הפסוק, כיון דליכא מאן דפליג עליה (כן נראה למשי"ח).

Proof: As a matter of fact, 'Mashi'ach' prefers this explanation, since it is more of a Dochek (a push) to establish the proof with regard to the source only, seeing as nobody disagrees with that.

(SUMMARY: Tosfos rejects the commentator's proof that the Seifa of our Mishnah ['Harei Eilu Sh'tei Iduyos'] is speaking even where the witnesses see the Masreh, as he explained earlier).

מכאן מייתי המפרש ראיה במתניתין גבי סיפא דקתני 'הרי אלו שתי עדיות' ,דמכל מקום איירי אע"פ שהן רואין המתרה כדפרישי'.

Refutation: We refute this however, on the grounds that Rava is referring specifically to the Beraisa of Eidus Meyuchedes (one witness from each window), and he is teaching us that as long as they see the Masreh or vice-versa, they combine to form one Eidus, even though they cannot see each other (like the case of 'Miktzasan Ro'in Eilu es Eilu' in our Mishnah).

ותדע דאעדות מיוחדת דברייתא קאי, דאי אמתניתין קאי, דקתני 'הרי אלו שתי עדיות'כדפרישית, אם כן הוה ליה למימר 'ואם לאו אין מצטרפין', שזהו עיקר החידוש.

Proof: And a proof that Rava refers specifically to Eidus Meyuchedes of the Beraisa, is that, had he been referring to our Mishnah, he ought to have added 'and if not, they do not combine', since that would then be the thrust of his Chidush.

TOSFOS DH 'O MASREH RO'EH OSAN, MITZTARFIN'.

תוס' ד"ה' או מתרה רואה אותן, מצטרפין'.

(SUMMARY: Tosfos explains how it is possible to kill the accused, on the basis of words of the the Masreh [who after all, is only one person], when he claims that he saw the witnesses).

פירוש, על פיהם נהרג; דלא חשיבא עדות מיוחדת.

(a)

Explanation: This means that on the basis of the testimony of the two individual witnesses (who did not see each other), the accused is sentenced to death.

ואם תאמר, והיכי מהימני ליה למתרה לומר שראה אותן, להרוג את זה? דבשלמא כשרואין המתרה הרי הן שנים; אבל מתרה רואה אותן, קשיא?

(b)

Question: There is no problem in believing the two individual witnesses when they claim that they saw the Masreh. But on what grounds can we possibly believe the Masreh (to the point of sentencing the accused to death on account of it) when he claims that he saw the two witnesses?

ויש לומר, דמיירי שיש עדים שמעידין שהמתרה רואה אותן, אך לא ראו המעשה אותן העדים.

Answer: We are speaking where there are other witnesses (who did not witness the actual murder but) who testify that the Masreh saw the two witnesses.

TOSFOS DH 'BE'DINEI NEFASHOS HU DE'LO KESHEIRAH, HA BE'DINEI MAMONOS, KESHEIRAH'

תוס' ד"ה תוס' ד"ה 'בדיני נפשות הוא דלא כשירה, הא בדיני ממונות כשירה'.

(SUMMARY: Tosfos explains why we cannot learn Eidus Meyuchedes by Mamon from Misah, via the Pasuk "Mishpat Echad Yi'yheh Lachem", just like we do with regard to invalidating Pesulim).

Question: R. Avraham from Orleans asks that, just as we invalidate Pesulim by Mamon by comparing Mamon to Misah, via the Pasuk "Mishpat Echad Yi'yheh Lachem", why can we not learn Eidus Meyuchedes by Mamon from Misah using the same source?

ונראה, דעל כרחך האי קרא לאו בדיני ממונות קאי, דעד אחד מועיל לממון דלשבועה מיהא איתיה.

Answer: It seems however, that the Pasuk (which invalidates Eidus Meyuchedes) cannot refer to Mamon, seeing as a single witness is at least Kasher to extract a Shevu'ah from the defendant.
