A SHALIACH BECOMING A WITNESS (Yerushalmi Halachah 1 Daf 23b)

בית שמאי אומרים אין השליח עולה משם עד.

(a)

Beis Shamai: A shaliach sent to betroth (or return money of a borrower) cannot be a witness to the betrothal. (Beis Hillel say that he can become a witness.)

Question: What is the case?

שילח שנים על דעתון דבית שמאי שליח ושני עדים. על דעתון דבית הלל שלשתן שלוחין ושלשתן עדים.

Answer: If the husband sent two witnesses in addition to the shaliach, Beis Shamai say that he must inform them that one will be the shaliach and two will be the witnesses. Beis Hillel say that all three can be shaliachs and also witnesses.

אמר רבי אבון בר חייה נראין דברים בשקידשה בשטר. אבל אם קידשה בכסף נעשה כנוגע בעדותו

R. Avun bar Chiya: These words apply when he betrothed with a document, but if he betrothed with money, he is personally involved in the case (and cannot testify that the money was given).

אמר ר' יוסי מכיון שהאמינתו התורה אפילו קידשה בכסף אינו כנוגע בעדותו.

R. Yosi disagrees: Since the Torah believed him to become a shaliach, even if he betrothed with money, he is not considered to be personally involved.

אמר רבי בא אתא עובדא קומי רב ועשה שליח עד.

R. Ba: Such a case was brought before Rav and he allowed the shaliach to testify.

חד בר נש אפקיד גרבוי גבי קרקפיפא דחבריה וכפר ביה.

(g)

A person once deposited a barrel of wine in the enclosure of his friend by sending it there with a carrier. The recipient later claimed that he did not receive it.

אמר רבי פינחס אתא עובדא קומי רבי ירמיה ועשה [דף כה עמוד א (עוז והדר)] שליח עד וחייבו שבועה ע''י הכתף

R. Pinchas: The case was brought before R. Yiirmiyah and he allowed the shaliach to testify, thereby obligating the carrier to make an oath.
