KIDUSHIN 5 (1 Elul 5782) - Dedicated l'Iluy Nishmas Esther Chaya Rayzel (Friedman) bas Gershon Eliezer (Yahrzeit: 30 Av, Yom Kevurah: 1 Elul) by her son-in-law, Eli Turkel of Raanana, Israel. Esther Friedman was a woman of valor who was devoted to her family and gave of herself unstintingly, inspiring all those around her.

1)

THE SOURCE OF KIDUSHIN USING A DOCUMENT (Cont'd) (Yerushalmi Halachah 1 Daf 1b)

(a)

Question: Why can we not learn through a Kal Vechomer that one could use a document for Kidushin...If money that does not take her out (of her marriage) can bring her in (i.e. achieves Kidushin); a document that does take her out (Get) should certainly bring her in?!

(b)

Answer: No - money is different to a document; since it is used to redeem property consecrated to the Temple (hekdesh) thereby 'taking out' that property from its state of holiness, it can also "take in'' i.e. be used to marry

(c)

Conclusion of answer: Since the Kal Vechomer has been broken, we need the comparison between divorce and marriage in the pasuk (see earlier Kidushin 4, 3)(a)) to prove marriage through a document.

2)

KIDUSHIN THROUGH AN ACT OF 'TAKING POSSESSION' (Yerushalmi Halachah 1 Daf 1b)

(a)

R. Yudan: We can use a Kal Vechomer to teach that a woman can be acquired in marriage by 'seizing' i.e. an act of 'taking possession''...If a slave-woman who cannot be acquired through relations can be acquired through seizing; a woman who can be acquired in marriage through relations should be able to be acquired through seizing! This is disproven since the pasuk states "uboaloh'' - she is acquired through relations but not through seizing.

(b)

We can use a Kal Vechomer to teach that a slave-woman can be acquired through relations...If a woman who cannot be acquired in marriage through seizing, can be acquired through relations; a slave-woman who can be acquired seizing should be acquired through relations! This is disproven since the pasuk states (Vayikra 25, 46), "And you shall give them as a heritage to your children after you to inherit as a possession etc.'' - she is acquired through seizing but not through relations.

(c)

Conclusion: We have learned that a woman is acquired in marriage through one of three methods - giving money, a document or marital relations.
