HOW TOSEFES IS ACQUIRED (Yerushalmi Perek 5 Halachah 1 Daf 31b)

[דף לא עמוד ב] מתני' אף על פי שאמרו בתולה גובה מאתים ואלמנה מנה אם רצה להוסיף אפילו מאה מנה יוסיף נתארמלה או נתגרשה בין מן האירוסין בין מן הנשואין גובה את הכל

(a)

(Mishnah): Even though Chachamim said that the Kesuvah of a virgin is 200 and of a non-virgin is 100, one may add even 10,000 if he wants. If she is widowed or divorced, whether from Eirusin or Nisu'in, she collects it all;

רבי אלעזר בן עזריה אומר מן הנישואין גובה את הכל מן האירוסין בתולה גובה מאתים ואלמנה מנה

R. Elazar ben Azaryah says, from Nisu'in she collects it all. From Eirusin, a Besulah collects 200, and a widow, 100.

שלא כתב לה אלא על מנת לכונסה:

He wrote the Tosefes (addition) only on condition that they have Nisu'in.

גמ' במה הוא מתחייב לה

(c)

(Gemara) Question: How did he become obligated to her [in the addition? He is obligated to give only 100 or 200!]

לא כן רבי יוחנן ורבי שמעון בן לקיש תריהון אמרין הכותב שטר חוב על חבירו בחזקת שהוא חייב לו ונמצא שאינו חייב [אינו חייב] ליתן לו

Didn't R. Yochanan and Reish Lakish both say that if one wrote a loan document against his friend with the Chazakah (others understood) that he owes him, and it turns out that he does not owe him, he is not obligated to pay him? (We explained this like MEICHAL HA'MAYIM.)

רוצה הוא ליתן כמה וליקרות חתנו של פלוני

(d)

Answer: He wants to give much and be called the son-in-law of Ploni (his wife's father. Through this Hana'ah, he obligates himself. (SEDEI YEHOSHUA)

עד כדון בשפסק מן האירוסין פסק מן הנשואין

(e)

Question: This [answer applies] when he stipulated (added) from [after] Eirusin. If he stipulated so from [after] Nisu'in [how can we answer? He is already his son-in-law!]

רוצה הוא ליתן כמה בתשמישה שהוא ערב

(f)

Answer: He wants to give much due to Bi'ah with her, which was pleasant.

עד כדון כשבעל לא בעל

(g)

Question: This [answer applies] when he had Bi'ah [with her]. If he did not have Bi'ah [how can we answer]?

רוצה הוא ליתן כמה על קניינו שהוסיף

(h)

Answer: He wants to give much due to the Kinyan that he added (Nisu'in).

פסק מן (האירוסין פסק מן הנישואין) [צ"ל פסק מן הנישואין לאחר זמן - קרבן העדה] ולקרות חתנו של פלוני כבר הוא (בראוי) [צ"ל בהנאת - קרבן העדה] תשמיש אין בו קניין לא הוסיף מיכן

Question: If he stipulated after Nisu'in, much later [how can we answer]? To be called his son-in-law - he already is! Due to Hana'ah of Bi'ah - this is not now (the first Bi'ah was a long time ago)! Due to added Kinyan - he did not add anything now!

רוצה הוא ליתן כמה ולא תחזור בה

Answer: He wants to give much lest she retract [from being his wife].

ויכולה היא לא כן תני האיש אינו מוציא אלא לרצונו

Question: Can she retract?! Was it not taught that a man divorces only willingly!

אמר רבי אבין מעיקא היא ליה הוא משבק לה

Answer (R. Avin): She can pain him until he consents to divorce her.

2)

STIPULATIONS BY THE FATHER (Yerushalmi Perek 5 Halachah 1 Daf 31b)

תני כשם שהבעל פוסק כך האב פוסק אלא שהבעל מזכה בכתב והאב אינו מזכה אלא בדברים ובלבד דברים שהן נקנין באמירה

(a)

(Beraisa): Just like a husband stipulates, so a father stipulates, but a husband is Mezakeh through writing, and a father is Mezakeh only through words (even if he wrote a document, it does not enable collecting from Meshubadim), and [he is Mezakeh] only matters acquired verbally (SEFER HA'ZECHUS, 61b);

(b)

Question: How are [matters acquired verbally]?

גידול בשם רב (כמה אתה נותן לבנך כך וכך שדה יהושע, - עלי תמר מחקוהו) כמה אתה נותן לבתך כך וכך כיון שקידשה (זכת בין הבנות) [צ"ל זכתה בת בין הבנות - ספר הזכות סא:ב]

(c)

Answer (Gidul citing Rav): How much do you give to your daughter? This amount. Once he was Mekadesh her, a daughter merited [what her father pledged] amidst the other daughters (i.e. if she inherits, this is above her share of the inheritance. We explained this like SEDEI YEHOSHUA, ALEI TAMAR.)

אמר ר' חייה בר יוסף [דף לב עמוד א] אשכח גידול רביתא ומר זעירתא

(d)

(R. Chiya bar Yosef): Gidul could have taught a big Chidush, and he taught a small Chidush!

אלא כיני כמה אתה נותן לבנך כך וכך וכמה אתה נותן לבתך כך וכך כיון שקידשה זכתה הבת בין הבנות והבן בין הבנים

Rather, how much do you give to your son? This amount. How much do you give to your daughter? This amount. Once he was Mekadesh her, a daughter merited amidst the other daughters, and a son merited amidst the other sons.

אמר ר' זעירא והדא היא זעירתא לא נמצא קונה אשה במטלטלין בשוה פרוטה ואין אדם קונה שתי נשים בשוה פרוטה

(e)

(R. Ze'ira): Is this a small Chidush?! Is it not found that he acquires a wife and Metaltelim with a Shaveh Perutah, and a man cannot acquire two wives with a Shaveh Perutah!

ומה (בין אין) [צ"ל בכך ואין - שערי תורת ארץ ישראל] אדם קונה קרקע וכמה מטלטלין בשוה פרוטה

(f)

Question: What is the Chidush? Does one not acquire land and many Metaltelim with Shaveh Perutah?! (Likewise, he acquires a wife and Metaltelim with Shaveh Perutah!)

שכן אדם קונה שתי קרקעות בשוה פרוטה ואין אדם קונה שתי נשים בשוה פרוטה

(g)

Answer: (A woman is unlike land.) One can acquire two lands with Shaveh Perutah, but one cannot acquire two wives with a Shaveh Perutah.

ר' בא בר חייה בשם ר' יוחנן כמה אתה נותן לבנך כך וכך כמה אתה נותן לבתך כך וכך כיון שקידשה זכת הבת בין הבנות והבן בין הבנים ובלבד מן הנישואין הראשונים

(h)

(R. Bun bar Chiyah citing R. Yochanan): How much do you give to your son? This amount. How much do you give to your daughter? This amount. Once he was Mekadesh her, a daughter merited amidst the other daughters, and a son merited amidst the other sons, only if this is the first marriage. (AMUDEI YERUSHALAYIM TINYANA discusses whether this means only the first marriage of the son, or also the first marriage of the daughter.)

ותייא כיי דמר רבי חנניא המשיא את בנו בבית זכה בבית ובלבד מן הנישואין הראשונים

This is like R. Chananya said - one who marries off his son in a house, [the son] acquired the house. This is only if it is his first Nisu'in.

תני רבי הושעיה זכה במטלטלין ולא זכה בבית

(R. Hoshayah - Beraisa): He acquired the Metaltelim [in the house in which he was married], but he did not acquire the house.

Question: Does [R Chananyah] argue [with this Beraisa]?!

ר' ירמיה בשם ר' אבהו תיפתר שהיה אוצרו של אביו נתון שם

(l)

Answer (R. Yirmeyah citing R. Avahu): The case [of the Beraisa] is, the father's storehouse was there. (Since he uses it, he did not give the house itself.)

ר' חזקיה בשם רבי יהושע בן לוי לכן צריכה אפילו שאולין מן השוק

(m)

(R. Chizkiyah citing R. Yehoshua ben Levi): [The Beraisa] needs to teach that even if [the Kelim in the house] were borrowed from the market (the son does not acquire the house).

אמר ר' אבהו אם [דף לב עמוד ב] אמר לו לשאילה לא זכה (בהן) [צ"ל הבן - כן נראה גירסת קרבן העדה]

(n)

(R. Avahu): If [the father] told [his son] that they are borrowed, the son did not acquire [the house. If he did not tell him, he acquired the house.]

אתא עובדא קומי ר' יעקב בי ר' בון והורי כרבי אבהו

A case came in front of R. Yakov bei R. Bun, and he ruled like R. Avahu.

אמר ר' זעירא עיקרא לית לה תימליוסים ורבנין בנין וסלקון עלה

Objection (R. Ze'ira): This Halachah has no basis, and Rabanan build on (add to) it?!

את אמר האב פוסק על ידי בתו אפילו בוגרת

Question: You say that a father stipulates [to give to his daughter, and she acquires verbally. Is this even if she is a Bogeres?

נישמעינה מן הדא האב פוסק על ידי בתו ולא אשה על ידי בתה ולא אח על ידי אחותו

Answer: We learn from the following. A father stipulates for his daughter, but a woman does not stipulate to [give to] her daughter, nor a brother for his sister.

שנייא היא אחותו בין שהיא נערה בין שהיא בוגרת וכא לא שנייא בין שהיא נערה בין שהיא בוגרת

Is there any difference whether his sister is a Na'arah or Bogeres?! (In either case, she is not in his Reshus!) And here (also regarding her father), there is no difference whether she is a Na'arah or Bogeres.

רבי בא קרטיגנא בעא אפילו אחר (אמרין אפילו בוגרת אחר - קרבן העדה מוחקו)

Question (R. Ba Kartinga): Can someone else [stipulate to give to her]?

נישמעינה מן הדא האב פוסק על ידי בתו לא אשה על ידי בתה לא אח ע"י אחותו כל שכן (בוגרת) אחר

Answer: We learn from the following. A father stipulates for his daughter, but a woman does not stipulate to [give to] her daughter, nor a brother for his sister, and all the more so someone else [cannot].

אף למדת הדין כן תן בתך לפלוני ואני אתן לך כך וכך קח שדה פלוני ואני נותן לך כך וכך

Also for monetary laws, this is so. 'Give your daughter to Ploni, and I will give to you such an amount. Buy field Ploni, and I will give to you such an amount' (this is not acquired verbally).
