ACTS THAT SHOW THAT A SLAVE WAS FREED (Yerushalmi Perek 4 Halachah 4 Daf 23a)

אמתיה דרבה בר זוטרא ערקת. אתייאש מינה. אתא שאל לרבי חנינה ולר' יהושע בן לוי (אמר) [נראה שצ"ל אמרו] אינו רשאי לשעבדה.

(a)

The Shifchah of Rabah bar Zutra fled. He despaired from her. He went and asked R. Chaninah and R. Yehoshua ben Levi. They said, he cannot force her to serve him.

[דף כג עמוד ב] מהו לכתוב לה גט שיחרור. (אמר) [נראה שצ"ל אמרו] ליה אם כתבת יאות את עבד.

He asked if he must write a Get Shichrur for her. They said, if you wrote, you did properly.

רבי חנינה בשם רבי ישמעאל בי רבי יוסה עבד שנשא בת חורין לפני רבו יצא לחירות.

(R. Chaninah citing R. Yishmael bei Rebbi Yosah): If a slave married a Bas Chorin in front of his master, he goes free.

אמר רבי יוחנן אמש הייתי יושב ושונה הכותב כתב קידושין לעבדו או כתב נישואין לאמתו רבי אומר זכה. וחכמים אומרים לא זכה.

(R. Yochanan): Last night, I sat and learned 'if one wrote a Kidushin document for his slave (the slave is Mekadesh a Bas Chorin) or a Nisu'in document to his Shifchah (her master is Mekadesh her), Rebbi says, [the slave] acquired [freedom]. Chachamim say, [the slave] did not acquire;

אהן תנייא קדמייא סבר כרבי זכה.

The first Tana (R. Yishmael bei Rebbi Yosi) holds like Rebbi, that he acquired.
