DO VOWS DEPEND ON LESHON BNEI ADAM OR LESHON TORAH? (Yerushalmi Perek 3 Halachah 1 Daf 19a)

הנודר מן המזון מותר במים ומלח.

(a)

One who vows from Mazon is permitted water and salt.

תמן תנינן הנודר מן המבושל מותר בצלי ובשלוק.

(b)

(Mishnah): One who vows from Mevushal is permitted roasted and Shaluk (half cooked).

מתניתא אמרה כן שהשלוק קרוי מבושל

Question #1: A Mishnah teaches [unlike] this, that Shaluk is called Mevushal!

דתנינן היה מבשל את השלמים או שולקן

(Mishnah): He cooked the Shelamim [of a Nazir] or was Sholek it [and the Torah says that that the foreleg must be "Beshelah''. This shows that Shaluk is called Mevushal!]

וקרייא אמר שהצלוי קרוי מבושל שנאמר [דברי הימים ב לה יג] ויבשלו את הפסח באש

(d)

Question #2: A verse teaches that roasted is called Mevushal - "va'Yevashlu Es ha'Pesach ba'Esh''! (Pesach must be roasted.)

אין תימר [דף יט עמוד ב] שלא כהלכה

Suggestion: Perhaps they did improperly (they truly cooked it).

רבי יונה בוצרייה אמר כמשפט.

Rejection (R. Yonah of Botzrei): [The above verse continues] "ka'Mishpat''!

מתני' שהשלוק קרוי מבושל וקרייא אמר שהצלוי קרוי מבושל ותנינן הנודר מן המבושל מותר בצלי ובשלוק.

Reiteration of questions: A Mishnah teaches that Shaluk is called Mevushal, and a verse teaches that roasted is called Mevushal, and a Mishnah teaches that one who vows from Mevushal is permitted roasted and Shaluk!

אמר רבי יוחנן הילכו בנדרים אחר לשון בני אדם

Answer (R. Yochanan): Vows depend on Leshon Bnei Adam (the way people speak. People do not call roasted and Shaluk "Mevushal''.)

אמר רבי יאשיה הילכו בנדרים אחר לשון תורה.

(R. Yoshiyah): Vows depend on Leshon Torah.

Question: What do they argue about?

אמר קונם יין שאני טועם בחג על דעתיה דר''י אסור ביום טוב האחרון על דעתיה דרבי יאשיה מותר.

Answer: If one said "Konam (is forbidden like a Korban) wine, that I will taste it during the Chag (Sukos)'', according to R. Yochanan he is forbidden on the last day of Yom Tov (in Leshon Bnei Adam, it is part of Sukos), and according to R. Yoshiyah he is permitted.

אוף ר' יאשיה מודה שהוא אסור לא א''ר יאשיה אלא לחומרן.

Rejection: R. Yoshiyah agrees that he is forbidden. R. Yoshiyah said [that vows depend on Leshon Torah] only to be stringent.

א''ר חייה בר בא רבי יוחנן אכל חליטין ואמר לא טעמית (מידי) [צ''ל מזון - הגר''ח קניבסקי שליט''א] בההוא יומא.

(R. Chiya bar Bari): R. Yochanan ate Peros Ginosar, and said that he did not taste Mazon that day.

ותנינן הנודר מן המזון מותר במים ומלח

(n)

Question (Mishnah): If one vowed not to eat Mazon, he is permitted [only] water and salt! (Everything else is called Mazon.)

פתר לה כר' יאשיה דרבי יאשיה אמר הילכו בנדרים אחר לשון תורה.

Answer: [Our Mishnah] is like R. Yoshiyah. R. Yoshiyah said that vows depend [even] on Leshon Torah. (In Leshon Torah, everything other than water and salt is called Mazon. R. Yochanan spoke like Leshon Bnei Adam.)

Question: What is the source that all matters [other than water and salt] are called Mazon [in Leshon Torah]?

רבי אחא בי ר' עילא אמר [בראשית מה כג] ועשר אתונות נושאות בר ולחם ומזון מה ת''ל מזון

Answer (R. Acha bei R. Ila) Question: "V'Eser Asonos Nos'os Bar va'Lechem u'Mazon'' - why does it say Mazon? (It already said grain and bread!)

אלא מיכן שכל הדברים קרויין מזון.
