Sholem asks:

The Mishna suggests that if the eighth day is on Erev Pesach they can be counted amongst a group and their status does not effect the Korbon Pesach since they can bring their Korbon Kaporoh until night.

What would be the halocho if the Zov or Zoveh failed to bring their Korbon Kaporoh. Would they be yoitzeh their chiyuv or do they have to bring another Korbon on Peach Sheini.

Would the circumstances for the failure dictate the psak?

The Kollel replies:

1) The Gemara below 90b asks why are we not worried that the Mechusar Kipurim [Rashi writes that this includes the Zav or Zavah i.e. they have not yet brought their Korbon Kaporoh] will be negligent and not bring their korban? The Gemara answers that the scenario is that they have already handed over their korban to Beis Din, and Rav Shemaya said that there is a chazoka that the Beis Din use all the money in the chests to buy the necessary korbanos, so we can assume that the korban of the Zav and Zava has in fact been offered.

2) However, if for some reason, the Zav or Zava did not bring their korban, they could not eat the korban Pesach (see Gemara above 59a that a Mechusar Kepurim can bring his korban even after the afternoon korban Tomid in order that he can go to the Mikveh and eat korban Pesach at night) and are not yotzei so they would have to bring another korban on Pesach Sheni.

3) The Talmud Yerushalmi, very near the beginning of the 9th chapter of Pesachim, derives from the word (Bamidbar 9:13) "veHaIsh" that even if someone deliberately did not bring Korban Pesach on 14 Nisan, he can still bring Pesach Sheni on 14 Iyar.
