DAF DISCUSSIONS - PESACHIM 4

dovid sandel asked:

lkvod harav - on the bottom of 4b discussing source for issur of chametz 6 hrs and up attempt 1 is 1st posuk says "7 days" and 2nd says "yom rishon" "yom rishon must be day before. this is questioned with attempt that maybe "leil 15th" is being included in "issur" (vs the diyuk of days not nights). My question "leil 15th" is included in the first apporach also, so what is real issue here? what is not liked with apporach 1? - thanks and sholom

The Kollel replies:

Abaye begins by pointing out that the Pasuk "Ach ba'Yom ha'Rishon ... " must be referring to the fourteenth, seeing as we know from the Pasuk "Shiv'as Yamim ... ", that one is forbidden to retain Chametz during the entire seven days, starting from nightfall.

We query this however, by suggesting that "Shiv'as Yamim" is confined to the day, precluding the night of the fifteenth, during which time one is permitted to retain Chametz, and we now learn from the Pasuk "Ach ba'Yom ha'Rishon" that one is obligated to burn it some time during the night.

According to the first approach, we know from the outset that the night of the fifteenth is Asur, and the second Pasuk comes to obligate burning the Chametz on the fourteenth; whereas according to the second approach we think it is permitted, and the second Pasuk comes to obligate burning it during the night.

We conclude by refuting the second approach, based on a series of Hekeshim, which prove that the night of the fifteenth is Asur anyway, and does not need a Pasuk to forbid it.

Do you still have a problem with the Gemara?
