1)

TOSFOS DH MITZTARFIN

úåñôåú ã"ä îöèøôéï ìëîìà î÷ãç

(SUMMARY: Tosfos explains why the Gemara refers to the Shi'ur of Beis Shamai.)

ìàå îùåí ãáòå ìîéñúí ëá"ù ...

(a)

Clarification (Part 1): Not because he wants to finalize the Halachah like Beis Shamai ...

àìà îùåí ãá"ù ôéøùå ùéòåøï, ð÷è ùéòåøà ãá"ù.

(b)

Clarification (Part 2): ... but it is because Beis Shamai gives a specific Shi'ur, (whereas Beis Hillel do not) that he refers to the Shi'ur of Beis Shamai.

2)

TOSFOS DH ISHTIMITSEIH HA D'AMAR ETC.

úåñôåú ã"ä àéùúîéèúéä äà ãàîø ëå'

(SUMMARY: Tosfos discusses what Rav Yirmiyah initially thought and the conclusion, with which he has a problem.)

ñ"ã ãøá éøîéä - ãàôéìå áð÷áéí ùéù áäí çñøåï ÷àîø ãîöèøôéï ìøåáä, îãð÷è 'ëðôä', ãîùîò ëð÷áé ðôä, ùéù áäí çñøåï àééøé.

(a)

Initial Explanation: Rav Yirmiyah thinks that even holes which render some of the flesh missing (as opposed to cavities) combine to make up a majority - seeing as the Gemara compares it to a sieve, implying that it is speaking about holes like a sieve, of which some of the metal is missing.

åîùðé ãáùàéï áäï çñøåï àééøé, åìà ð÷è 'ðôä' àìà ìåîø ãîìàä ð÷áéí ëðôä.

(b)

Conclusion: ... and he answers that it is speaking about cavities, where none of the flesh is actually missing, and the reason that it mentions 'Nafah' is because, like a sieve, it is riddled with holes.

åìùåï 'àéùúîéèúé' ' ÷ùä.

(c)

Question: The Lashon 'Isht'mitseih however is then difficult (see Maharam).

3)

TOSFOS DH NITLAH MIMENAH RETZU'AH, MITZTAREFES L'CH'ISAR

úåñôåú ã"ä ðéèìä îîðä øöåòä îöèøôú ìëàéñø

(SUMMARY: Tosfos asks that it would then have sufficed to teach us only 'Nikvah'?)

úéîä, ìéùîåòéðï ðé÷áä, åë"ù øöåòä.

(a)

Question: In that case, it should rather teach us 'Nikvah', and we will know Retzu'ah from a Kal-va;Chomer.

4)

TOSFOS DH K'DEI SHE'YIKANEIS ISAR L'RACHBO

úåñôåú ã"ä úåñôåú ã"ä ëãé ùéëðñ àéñø ìøçáå

(SUMMARY: Tosfos explains what 'le'Rochbo' means.)

ôéøåù ìøçáå ùì àéñø - ùéåùéáäå ùí òì øçáå åéëðñ, ìàôå÷é ãøê òåáéå.

(a)

Clarification: That one places the Isar on its width to see whether it will enter the hole, and not on its thickness.

5)

TOSFOS DH ANSAH ATZMAH

úåñôåú ã"ä àðñä òöîä

(SUMMARY: Tosfos explains what 'Ansah Atzmah' means.)

ùôùèä öåàøä éåúø îãàé ìéèåì éø÷ ááåø.

(a)

Clarification: That the animal stretched out its neck excessively to take a vegetable from inside a pit.

6)

TOSFOS DH CHOTECH SHETEI TZALA'OS MI'KAN U'MIKAN

úåñôåú ã"ä çåúê ùúé öìòåú îëàï åîëàï

(SUMMARY: Tosfos citing Rabeinu Chananel, explains what this means and adds that the chest here is not the same as the chest in Perek Tamid.)

ôéøù ø"ç ùúéí îëàï åùúéí îëàï.

(a)

Clarification (Part 1): Rabeinu Chananel explains that this means 'two on one side and two on the other side'.

åäàé çæä ìà äåé ëääåà ãîñëú úîéã (ãó ìà.), ùìà äéå ùí ùåí öìòåú, ëãúðï áô' ìà äéå ëåôúéï.

(b)

Clarification (Part 2): ... and the chest mentioned here is not the same as the chest mentioned in Maseches Tamid (31a), learned in the Mishnah whish speaks where there are no ribs, as the Mishnah states in Perek Lo Hayu Kofsin.

7)

TOSFOS DH MAR BAR CHIYA MASNI IPCHA

úåñôåú ã"ä îø áø çééà îúðé àéôëà

(SUMMARY: Tosfos citing Rashi establishes Mar bar Chiya like the first Lashon, and then rules le'Chumra in all cases.)

ôé' á÷åðèøñ ãîñúáøà ëìéùðà ÷îà, ã÷í ìéä øáé éåçðï áùéèúéä ìòéì, ãàîø 'ðé÷á ä÷ðä ìîèä îï äçæä, ðéãåï ëøéàä'.

(a)

Clarification: Rashi explains that this probably goes according to the first Lashon, since Rebbi Yochanan concurs with that opinion above, when he says that a Kaneh which becomes holed below the chest, has the same Din as a lung with a hole.

åðøàä ãàæìéðï áëåìäå ìçåîøà, îãìà àéúîø äìëúà ìà ëîø åìà ëîø; åâí øáé éåçðï ãàîø 'ðé÷á ä÷ðä ìîèä îï äçæä' - îùîò áéï ãøéàä áéï ãëáãà ðãåï ëøéàä.

(b)

Halachah (Part 1): ... and it would seem that we go Lechumra in all cases, since no ruling is issued, neither like one opinion, nor like the other. And Rebbi Yochanan too (whom we just quoted, and) who talks about the Kaneh which became holed below the chest implies that both that of the lung and that of the liver, have the Din of the lung.

åëï øáéðå çððàì ôñ÷ ìçåîøà, ãùìùúï ð÷åáúï áîùäå, áéï ãëáã áéï ãìá áéï ãøéàä.

(c)

Halachah (Part 2): Rabeinu Chananel too, Paskens le'Chumra, that the Shi'ur of a hole in all three is a Mashehu - of the liver, of the heart and of the lung.

8)

TOSFOS DH MAN D'AMAR ROV ORO ROV MOCHO MAI

úåñôåú ã"ä îàï ãàîø øåá òåøå øåá îåçå îàé

(SUMMARY: Tosfos cites two explanations as to whether the Gemara is referring to the marrow alone being holed, or the marrow as well as the skin.)

ããìîà ä"ä áøåá îåçå ìáã, èøôä ...

(a)

Explanation #1 (Part 1): Since it is possible that the majority of the marrow alone is T'reifah ...

åð÷è øåá òåøå ...

(b)

Implied Question: ... and the reason that he mentions the majority of the skin ...

ìàùîåòéðï ãàôéìå òåøå áòé øåá.

(c)

Answer: ... is to teach us that even the skin requires a majority.

åøáéðå úí îôøù ãîáòé ìéä àé áòé ðîé øåá îåçå.

(d)

Explanation #2: Rabeinu Tam however, explains that the She'eilah is whether one requires the majority of the marrow as well.

å'òåøå' ãð÷è îôðé ùäåà òé÷ø ...

(e)

Clarification (Part 1): ... and the reason that he mentions the skin is because the skin is the main item ...

åîëì î÷åí áìà îåçå ðîé àéðä èøéôä.

(f)

Clarification (Part 2): ... and in any event, without the marrow too being holed, the animal will not be a T'reifah.

9)

TOSFOS DH NISMAZMEZ MOCHEIH D'DEIN

úåñôåú ã"ä ðúîæîæ îåçéä ããéï

(SUMMARY: Tosfos queries the Gemara's proof from the brain).

úéîä ìøéá"í, ãîééúé øàéä îîåç ãøàù ãùéòåøå áð÷á îùäå ìîåç çåè äùãøä ãùéòåøå áøåáå.

(a)

Question: The Rivam asks how the Gemara can bring a proof from the brain in the head, whose Shi'ur regarding a hole is a Mashehu, on to the marrow of the spinal cord, whose Shi'ur is the majority?
