SLAUGHTERING A FIRSTBORN WITH A BLEMISH (Yerushalmi Halachah 4 Daf 14a)

משנה בכור שנפל לבור ר' יהודה אומר ירד המומחה ויראה אם יש בו מום יעלה וישחוט [דף ל עמוד ב (עוז והדר)] ואם לאו לא ישחוט

(a)

(Mishnah): If a firstborn animal fell into a pit -

R. Yehudah: An expert should go down into the pit and see. If the animal received a permanent blemish (that will allow it to be slaughtered), he can bring the animal out and slaughter it. If not, he should not slaughter it.

(b)

R. Shimon: If the blemish was not visible before Yom Tov, it is not prepared (for Yom Tov use and may not be slaughtered).

גמרא מחלפה שיטתיה דר' יודה דתנינן תמן ר' יהודה אומר אם לא היתה נבילה מערב שבת אסורה לפי שאינה מן המוכן והכא הוא אמר הכין

(Gemara - Question): The opinion of R. Yehudah has been switched - The Mishnah (in Maseches Shabbos) teaches that if an animal died on Shabbos, it is prohibited to move as it was not prepared for Shabbos use. However, in the Mishnah here, R. Yehudah is not concerned with preparing before...?

ר' יודה כדעתיה דר' יודה אמר אין המומחה תורה

Answer: R. Yehudah follows his reasoning that an expert is not needed to permit it, so the animal was already prepared before Yom Tov when the owner saw the blemish.

R. Chuna quoting R. Aba: Yes, R. Yehudah certainly follows his reasoning. R. Yehudah considers viewing a firstborn (with a blemish) like viewing a Treifah. Just as one is allowed to view a Treifah on Yom Tov (in order to render a ruling if the animal is fit to eat), so one is allowed to view a firstborn on Yom Tov.

Question (R. Yudan): The decree of Demai is Rabbinic and so is viewing a Treifah - just as one may view a Treifah on Yom Tov, so one may tithe Demai on Yom Tov. (Demai is produce bought from an ignoramus and it is unknown if he separate the required tithes. The Rabbis decreed that one who buys Demai must tithe the produce before consumption.)

R. Abahu quoting R. Yosi ben Chaninah: If an animal's blemish was recognisable before Yom Tov but the expert only permitted it on Yom Tov, it is not considered prepared for Yom Tov use.

והא תני עגל בכור שנולד מן הטריפה בי''ט מותר

Question (Beraisa): A firstborn calf that was born from a Treifah on Yom Tov is permitted (even though it had not been prepared on account of its mother before Yom Tov).

אמר רב חסדא תיפתר שעבר המומחה וראהו

Answer (Rav Chisda): The case is when the expert looked at it (before Yom Tov). (Note: This entry follows the explanation of the Pnei Moshe.)

A similar case came before R. Imi and he thought that one could say that when there is a dispute between R. Yehuda and R. Shimon, the Halacha follows R. Yehuda (to be lenient and eat a Bechor that received a blemish on Yom Tov).

אייתי רב הושעיה מתניתא דבר קפרה מדרומא ותנא וחכמים אומרים כל שמומו ניכר מבערב יום טוב ולא התירו מומחה אלא ביום טוב אין זה מן המוכן [דף לא עמוד ב (עוז והדר)] וקיבלה וחזר ביה

Rav Hoshiya's Beraisa of Bar Kafra from the south: The Chachamim say - any animal whose blemish was recognisable before Yom Tov but an expert only came on Yom Tov, it is not considered prepared. R. Imi accepted this Beraisa and retracted his ruling.

SLAUGHTERING ANIMALS: MOTHER AND CHILD ON THE SAME DAY (Yerushalmi Halachah 4 Daf 14b)

אותו ואת בנו שנפלו לבור ר' ליעזר אומר יעלה את הראשון על מנת לשחוט וישחוט והשני עושין לו פרנסה במקומו שלא ימות

(a)

If two animals, a mother and a child, fell into a pit - R. Eliezer says that one should take out one animal intending to slaughter it and then slaughter it; as for the other one, one should supply it with food where it is, to prevent it from dying.

ר' יהושע אומר יעלה את הראשון ע''מ לשחוט ולא ישחוט ויערים ויעלה את השני אע''פ שלא חישב לשחוט אחד מהן מותר

R. Yehoshua says - take out the first one with intent to slaughter it but do not slaughter; then deceptively take out the second one (as if he intends to slaughter the second). Even though he only intends to slaughter one of them, it is permitted.

ר' בון בר חייה בעי מחלפה שיטתיה דר' ליעזר תמן הוא אמר מותר להערים והכא הוא אמר אסור להערים

(b)

Question (R. Bun bar Chiya): The opinion of R. Eliezer has switched. There (in the Mitzvah of separating Chalah on Yom Tov) he says that it is permitted to act deceptively; but here he says that it is prohibited?

תמן משום בל יראה ובל ימצא והכא מה אית לך

Answer: In that case, there is a prohibition of Bal Yera'eh and Bal Ye'Matzei (owning Chametz) so Chazal were lenient; here, that is not the case.

מחלפה שיטתיה דרבי יושוע תמן הוא אמר אסור להערים והכא הוא אמר מותר להערים

Question: The opinion of R. Yehoshua has switched. There (Chalah) he said that one may not act deceptively; but here he permitted it?

Answer #1 (R. Idi): Here involves a Rabbinic prohibition (of moving an animal) so it is not permitted; there (Chalah) involves a Torah prohibition of eating dough without separating Chalah, so it is permitted (to avoid the prohibition).

Answer #2 (R. Yosa bei R. Bun): Here, it is permitted in order to save the property of Jews (the other animal in the pit); there, there is no such reason.
