SEMICHAH ON A KORBAN ON YOM TOV (Yerushalmi Halachah 4 Daf 11a)

[דף כג עמוד א (עוז והדר)] משנה בית שמאי אומרים מביאין שלמים ואין סומכין עליהן אבל לא עולות

(a)

(Mishnah): Beis Shamai say that one may bring Shelamim offerings without performing Semichah, but one may not bring Olah offerings.

ובית הלל אומרים מביאין שלמים ועולות וסומכין עליהן

Beis Hillel say that one may bring Shelamim and Olah offerings and perform Semichah.

גמרא ב''ש אומרים הותרה סמיכה שלא כדרכה וב''ה אומרים לא הותרה סמיכה שלא כדרכה

(Gemara): Beis Shamai say that Semichah in an irregular way is permitted; Beis Hillel say that it is only permitted in the regular way.

איזו היא שלא כדרכה מאתמול

What is "irregular Semichah''? If it was performed on the previous day.

אמר ר' זעירה כל עמא מודיי באשם מצורע שסמך עליו מאתמול לא יצא

R. Zeira: All agree that one does not fulfil his obligation if on the previous day he performed Semichah on the Korban Asham of a Metzora.

שלמי נדבה שסמך עליהן מאתמול יצא

They also agree that one fulfils his obligation if on the previous day he performed Semichah on a voluntary Korban Shelamim.

מה פליגין בשלמי חגיגה ב''ש עבדין לון כשלמי נדבה בית הלל עבדין לוג כאשם מצורע

They disagree over Shalmei Chagigah (that are brought on the festivals) - Beis Shamai view it like a voluntary Shelamim; Beis Hillel view it like the Asham of a Metzorah.

א''ר יסי הן דאת אמר אשם מצורע שסמך עליו מאתמול לא יצא בזמנו עיבור זמנו נעשה כשלמי נדבה

R. Yasi: This law, that one does not fulfil his obligation if on the previous day he performed Semichah on the Korban Asham of a Metzora; only applies if it was brought on time, but if brought late (e.g. on the 9th day of his Taharah process), it receives the law of the volunteer Shelamim offerings.

אמרו ב''ה לב''ש מה אם בשעה שאני אוסר להדיוט הרי אני מתיר לגבוה בשעה שהוא מותר להדיוט אינו דין שנתיר לגבוה

Beis Hillel to Beis Shamai: If at a time when it is prohibited to a private person (such as slaughtering on Shabbos), it is permitted in the Temple (for public sacrifices); at a time when it is permitted to a private person (to slaughter on Yom Tov), it will certainly be permitted in the Temple.

אמרו להן בית שמאי והרי נדרים ונדבות יוכיחו שהן מותרין להדיוט ואסורין לגבוה

Beis Shamai respond: Volunteer sacrifices disprove it, as they are permitted to a private person (to slaughter animal to eat) but they are prohibited in the Temple?!

אמרו להן בית הלל לא אם אמרתם בנדרים ונדבות שאין זמנן קבוע תאמרו בחגיגה שזמנה קבוע

Beis Hillel reply: No, volunteer sacrifices do not have a fixed time, but would you say it for a Chagigah sacrifice that has a fixed time?

אמרו להן בית שמאי חגיגה אין זמנה קבוע שאם לא חג בראשון חוגג בשני לא חג בשני חוגג בשלישי

Beis Shamai: Chagigah does not have a fixed time, as if he did not bring it on the first day, he could bring it on the second day; if not on the second day, he could bring it on the third day.

אמרו להן בית הלל חגיגה זמנה קבוע [דף כג עמוד ב (עוז והדר)] שאם לא חג ברגל אינו יכול לחוג אחר הרגל

Beis Hillel: Chagigah has a fixed time, as if he did not bring it on the festival, he cannot bring it later.

אמרו להן ב''ש והלא כבר נאמר (שמות יב) אך אשר יאכל לכל נפש הוא לבדו יעשה לכם

Beis Shamai: It is because the Pasuk states (Shemos 12, 16), "...except you may make for yourselves that which every person eats'' - this slaughtering is not done for human consumption, so it is prohibited.

אמרו להן ב''ה משם ראייה לכם אינו נעשה אבל נעשה הוא לגבוה

Beis Hillel: This is not a proof! It is not "for yourselves'' but it is for the Temple service.

אבא שאול אומרו טעם אחר מה אם בשעה שכירתך סתימה כירת רבך פתוחה בשעה שכירתך פתוחה אינו דין שתהא כירת רבך פתוחה

Aba Shaul expressed it in another way - if at the time when your stove is closed (on Shabbos), your master's stove is open; when your stove is open (on Yom Tov), certainly your master's stove should be open.

Another expression - it is not correct that your table is full and your creator's table is empty.
