FORCING A RESIDENT TO MAKE AN EIRUV (Yerushalmi Halachah 5 Daf 3a)

רבי יוחנן בשם רבי לעזר בי רבי שמעון מי שאינו רוצה לערב נכנסין לביתו ומערבין לו בעל כרחו.

(a)

R. Yochanan citing R. Elazar bei R. Shimon: If one of the residents of a courtyard does not wish to make an Eiruv Chatzeiros (which combines all of the private domains of each resident to create one large private domain, by each resident giving food and the basket being placed in one of the houses), we may enter his house and force him to be part of the Eiruv.

והא תני והוא אינו רוצה לערב אינו ממאן נכנסין לביתו ומערבין לו על כורחו מפני שאין ממאן אבל אם היה ממאן לא

Question (Beraisa): If he does not wish to make an Eiruv, but he does not explicitly refuse, we may enter his house and force him to do it. This is only permitted because he did not explicitly refuse, but if he did, we may not force him...?

ותני כן כופין הן בני המבוי זה את זה לעשות להן לחי וקורה למבוי.

Parenthetical support for R. Yochanan (Beraisa): (Just as other residents of a courtyard can force one resident to make an Eiruv), the people of an alleyway can force each other to erect a vertical plate or horizontal beam (to allow carrying in the alleyway. See Maseches Eiruvin 1:1)...?

Answer (R. Yosi bei R. Bun): R. Yochanan was referring to when he refuses an Eiruv because he is miserly.

RECEIVING SPACE PER DOORWAY (Yerushalmi Halachah 5 Daf 3a)

רב חונה אמר חצר מתחלקת לפתחין

(a)

Rav Huna: A courtyard is divided according to the doorways. (Before the courtyard is divided equally, each doorway receives 4 amos of space in front of it.)

אמר רב חסדא לזבלין היא מתניתא

(b)

Rav Chisda: He only receives for each doorway when he needs it for manure.

ותני כן בכירה טפח [דף ג עמוד א (עוז והדר)] בזבלין לפי פתחים (באכסדר') [באכסנייא] לפי אדם.

Support (Beraisa): For a stove, he receives a tefach (around it); when they divide up the manure (which has multiple purposes) each receives according to the number of doorways; for hosting the king's soldiers, he must feed them according the number of people in his household.
