WRITING OVER HIS PROPERTY TO HIS SLAVE (Yerushalmi Peah Halachah 8 Daf 19b - misnumbered as Halachah 7)

(a)

(Mishnah): One who writes over his property to his slave, the slave goes free. If he withheld any sized field, he does not go free.

[ãó ìã òîåã à (òåæ åäãø)] ø"ù àåîø ìòåìí äåà áï çåøéï òã ùéàîø äøé ëì ðëñé ðúåðéï ìôìåðé òáãé çåõ îà' îøáåà ùáäï:

(b)

(R. Shimon): He always goes free unless he said, "Behold, all of my property is given to my slave, Ploni, except for 1/10000th of them. (Since that part could refer to the slave.)

âîøà øáé éñà áùí ø"à ùééø îèìèìéï ìà òùä åìà ëìåí àðé àåîø âåôå ùééø:

(c)

(Gemara) (R. Yasa citing R. Elazar): (When the Mishnah taught that if he withheld any sized field, he does not go free) this also applies if he withholds movables, as one could say that he withheld the slave himself.

(d)

(Tosefta): (The two opinions of the Mishnah are first brought, and the Tosefta then says...) when these words (of R. Shimon) were said before R. Yosi, he cited the pasuk (Mishlei 24:26), "Lips should kiss him who gives a right answer."
