HOTZA'AH OF A MES (Yerushalmi Perek 10 Halachah 5 Daf 63b)

אמר ר' שמואל בר רב יצחק הדא דאת אמר בצריכין לכיליין כגון אילין תותייא. אבל אם אינן צריכין לכיליין חייב אף על הכלי:


(R. Shmuel bar Rav Yitzchak): (Our Mishnah exempts one who was Motzi less than a Shi'ur of food in a Kli, even for the Kli.) This is when [the food] needs the Kli, e.g. [soft] berries (if one takes them in his hand, he will crush them. If it does not need the Kli, he is liable even for the Kli (i.e. he is liable for the Kli even though he is exempt for the food).

את החי במיטה פטור אף על המיטה.


(Mishnah): If one was Motzi a live person on a bed, he is exempt even for the bed.

דחייא טעין גרמיה.


[He is exempt for the person] because a live person carries himself (he makes himself lighter).

את המת במיטה חייב.


(Mishnah): If one was Motzi a [whole] Mes in a bed, he is liable.

All agree to this. (R. Shimon argues only in the Seifa, when he was Motzi k'Zayis of a Mes or Nevelah, or ka'Adashah of a Sheretz.)

לא כן תני אף ריח רע כל שהוא. ואמר ר' אילא אף ר' שמעון מודה בה. ומודה ר' שמעון באיסורי הנייה.


Question: Was it not taught [above, 9:4] that also [something with] a bad smell, the Shi'ur is any amount, and R. Ila said that even R. Shimon agrees about this, and R. Shimon agrees about Isurei Hana'ah! (All should obligate here for any amount! We could have challenged also Rabanan, who require a k'Zayis in the Seifa. We asked a stronger question against R. Shimon, who exempts even for a k'Zayis.)

א"ר יודן תיפתר במת עכו"ם ושאין בו ריח רע והוציאו [דף סד עמוד א] לכלבו.


Answer (R. Yudan): [Our Mishnah] discusses a dead Nochri without a bad smell, and he took it out for his dog [to eat. It is Mutar b'Hana'ah. It is Melachah ha'Tzerichah l'Gufah, but one is liable only for enough to fill a dog's mouth. Rabanan hold that a k'Zayis is Metamei, and they obligate for Melachah she'Einah Tzerichah l'Gufah. We explained this like Bi'ur HA'GRA, YD 349:1, CHASAM SOFER 93b.)

תני חצי זית מן המת וחצי זית מן הנבילה ופחות מכעדשה מן השרץ חייב. ורבי שמעון פוטר.


(Beraisa): If one was Motzi a half-k'Zayis of a Mes or a half-k'Zayis of a Nevelah or less than k'Adashah of a Sheretz, he is liable, and R. Shimon exempts.

מה (טעמא דרבי שמעון) [צ"ל טעמון דרבנן - קרבן העדה] כבר נתמעטה הטומאה.


What is Rabanan's reason? The Tum'ah was already decreased. (The case is, less than a k'Zayis remains, so Hotza'ah of a half-k'Zayis is Metaher.)

מה (טעמון דרבנן) [צ"ל טעמא דרבי שמעון - קרבן העדה] בההיא דר' יודן תיפתר במת עכו"ם ושאין בו ריח רע והוציאו לכלבו:


What is R. Shimon's reason? It is like R. Yudan answered [above]. It discusses a dead Nochri without a bad smell, and he took it out for his dog.


MELACHOS DONE TO A HUMAN BODY (Yerushalmi Perek 10 Halachah 6 Daf 64a)

מתני' הנוטל צפרניו זו בזו או בשיניו וכן שערו וכן שפמו וכן זקנו וכן הגודלת וכן הכוחלת וכן הפוקסת ר' אליעזר מחייב חטאת


(Mishnah): For cutting one's fingernails one on the other or with his teeth; tearing out [by hand] hair from his head, mustache, or beard; braiding hair; coloring eyes, or Pokeses (applying a mudpack), R. Eliezer obligates a Chatas;

וחכמים אומרים משום שבות


Chachamim say, these are forbidden only mid'Rabanan.

התולש מעציץ נקוב חייב ושאינו נקוב פטור


If one detaches something that was growing in an Atzitz Nakuv (a flowerpot with a hole), he is liable. If it is not Nakuv (has no hole), he is exempt;

ורבי שמעון פוטר בזה ובזה:


R. Shimon exempts in both cases.

גמ' רבי אבהו בשם רבי יוסי בי רבי חנינא מה פליגין בשנטלן הוא אבל אם נטלן אחר מאוסין הן


(Gemara - R. Avahu citing R. Yosi bei R. Chanina): When do they argue? It is when he himself cut [his fingernails on each other or with his teeth]. If someone else cut them, they are repulsive (he cannot cut them nicely. Even R. Eliezer exempts.)

דברי חכמים. רבי אחא רבי נחום בשם רב לעולם אינו חייב עד שיטלנו בקרסטל.


According to Chachamim - R. Acha said in the name of R. Nachum citing Rav that one is liable only if he cut them with a scissors.
