(a)

(Mishnah): The following are stoned:

הבא על האם ועל אשת אב ועל הכלה והבא על הזכר ועל הבהמה והאשה המביאה עליה את הבהמה

A man who had Bi'ah with his mother (unless specified, the woman always gets the same Misah as the man), his father's wife, his daughter-in-law, another man, or an animal, and a woman who brings an animal to have Bi'ah with her;

והמגדף והעובד עכו"ם והנותן מזרעו למולך ובעל אוב וידעוני והמחלל את השבת והמקלל אביו ואמו והבא על נערה מאורס' והמסית והמדיח והמכשף ובן סורר מורה:

One who blasphemes, serves idolatry, gives from his seed to Molech, to one who conjures up the dead with Ov or Yid'oni, one who is Mechalel Shabbos, one who curses a parent, one who has Bi'ah with a Na'arah Me'orasah, one who entices (an individual) to serve idolatry, one who entices a city to serve idolatry, a witch, and a Ben Sorer u'Moreh.

גמרא לכן צריכה בהעלם אחד אבל בשני העלימות [צ"ל לא צריכה - הגהות ר' יוסף דיננער] שכן אפי' באשה אחת [דף לב עמוד א] בא עליה וחזר ובא עליה (בהעלם אחד - פני משה מוחקו) חייב על כל אחת ואחת.

(Gemara): (The next Mishnah teaches that if one had Bi'ah with his mother and she is his father's wife, he is liable for both. In Kerisus, R. Akiva asked about one who had Bi'ah with three Arayos in one Helam.) He needed to ask about one Helam [of the man], but in two He'elamos [of the women he need not ask]. Even for one woman [and only one Isur and initial Hekdesh for him], if he had Bi'ah with her and had Bi'ah with her again, he is liable for each one!

Objection (R. Shimon brei d'R. Hillel ben Pazi, to R. Hillel ben Pazi): Our Mishnah discusses one woman forbidden due to many Isurim, but if there were many women and many He'elamos, but it was one Helam for him [he is liable only once]!

(אמר ליה לכן) [צ"ל ולכן - הגהות ר' יוסף דיננער] צריכה בהעלם אחד. דאיתפלגון הוא בהעלם אחד והיא בחמשה העלימות

And therefore, he asked about one Helam [for he discusses a woman forbidden due to three Isurim. He does not ask when there is only one Isur,] for there is an argument about when it is one Helam for him, and five He'elamos for her (about her liability, but all agree that he is liable only once);

רבי יוחנן אמר הוא מביא קרבן אחד והיא מביאה חמשה קרבנות

R. Yochanan says, he brings only one Korban, and she brings five Korbanos;

רבי שמעון בן לקיש אמר כשם שאינו מביא אלא קרבן אחד כך אינה מביאה אלא קרבן אחד

ii.

Reish Lakish says, just like he brings only one Korban, she brings only one Korban.

שלא תאמר יעשו נשים הרבה והעלימות הרבה בהעלם אחד איני חייב אלא אחת לפום כן צריך מימר חייב על כל אחת ואחת.

iii.

[R. Akiva asked about one woman with three Isurim,] lest you say that this is like five women and many He'elamos [for them, and one Helam for him - he is liable only once. Therefore, he needed to say that he is liable for each one. (We explained the Sugya like HAGAHOS R. DINAR.)]

א"ר בון בר חייה תני רבי ישמעאל כן לא תנחשו ולא תעוננו והלא הניחוש והעיגון בכלל היו ויצאו מן הכלל לחלוק על הכלל

(d)

(R. Bun bar Chiyah): R. Yishmael taught so - "Lo Senachashu" and Lo Se'onenu" - Nichush and Inun were in the Klal [of Kishuf, i.e. witchcraft]. They left the Klal (were taught individually) to divide the Klal (teach that one is lashed for each kind of Kishuf by itself).

HOW WE EXPOUND EXTRA VERSES ABOUT ARAYOS (Yerushalmi Halachah 5 Daf 32a)

כלל בהיכרת ופרט בהיכרת. מילתיה דרבי יוחנן אמרה כלל ופרט הוא

(a)

If there is a Klal of Kares, and Kares was taught about a Prat (an Aveirah in the Klal), from R. Yochanan we learn that this is [like something that was in] a Klal, and a Prat [was taught to teach about the entire Klal];

דמר ר' אבהו בשם רבי יוחנן כי כל אשר יעשה מכל התועבות האלה ונכרתו וגו' והלא אחותו בכלל היית ויצאת מן הכלל לחלוק על הכלל.

(R. Avahu citing R. Yochanan): [E.g. there is Kares for all Arayos,] - "Ki Kol Asher Ya'aseh mi'Kol ha'To'evos ha'Elu v'Nichresu..." - a sister was included. It left the Klal (the Torah explicitly taught Kares for it) to divide the Klal (teach that there is Kares for each Ervah by itself).

התיב ר' לעזר והכתיב ערות אחות אמך וערות אחות אביך לא תגלה

(b)

Question (R. Lazar): It says "Ervas Achos Imcha v'Achos Avicha Lo Segaleh"! (We already know from Achoso that there is Kares for each Ervah by itself.)

אמר ליה לצורך יצאת לידון בערייה.

(c)

Answer (R. Avahu): It left [the Klal] for a need, to teach about Ha'ara'h (the beginning of Bi'ah. It is considered like full Bi'ah.)

(עמוד ב) והכתיב ואיש אשר ישכב את אשה דוה וגלתה את ערותה את מקורה הערה והיא גילתה את מקור דמיה

(d)

Question: [We already know this, for] it says "v'Ish Asher Yishkav Es Ishah Davah v'Gilsah Es Ervasah Es Mekorah He'erah v'Gilsah Es Mekor Dameha"!

אמר ליה לצורך יצאת לידון בערייה שלא תאמר הואיל ואין חייבין עליה אלא משום (טומאת ערייה) [צ"ל טומאה - קרבן העדה] לא נעשה בה את המערה כגומר לפום כן צריך מימר.

(e)

Answer: It was needed to teach about Ha'ara'ah, lest one say that since he is liable for her only due to Tum'ah (but when she is Tehorah, she is permitted), we do not consider one who does Ha'ara'ah like one who finishes Bi'ah. Therefore, it needed to be said.

והכתיב ואיש אשר ישכב את דדתו ערות דודו גלה

(f)

Question: [Why does] it say "v'Ish Asher Yishkav Es Dodaso Ervas Dodo Gilah"? (An aunt was already taught!)

א"ל לצורך יצאת לידון בערירי

(g)

Answer #1: It was needed to teach [that it is punished with] being childless;

דאמר רבי יודן כל אתר דתימר ערירים יהיו הווין בלא וולד וכל אתר דתימר ערירים ימותו קוברין את בניהן.

R. Yudan taught that wherever it says "Aririm Yihyu", they will not have children, and wherever it says "Aririm Yamusu", they will bury their children (who were already born).

אמר ר' יוסי דודתו לצורך יצאת למעט את אשת (אחיו) [צ"ל אחי אביו - קרבן העדה] מאמו.

(h)

Answer #2 (R. Yosi): Dodaso was needed to exclude the wife of his father's maternal brother (Ariri does not apply to it);

מה טעמא נאמר כאן דודתו ונאמר להלן או דודו או בן דודו יגאלנו מה דודו שנאמר להלן באחי אביו מאביו הכתוב מדבר אף דודתו שנא' כאן באשת אחי אביו מאביו הכתוב מדבר

What is the reason? It says here Dodaso, and it says there "Oh Dodo Oh Ben Dodo Yig'alenu" - just like Dodo there is his father's paternal brother, also Dodaso said here, the verse discusses his father's paternal brother's wife.

אף אשת אחיו לימדה מדודתו. מה דודתו שנא' להלן באשת אחי אביו מאביו הכתוב מדבר אף אשת אחיו שנאמר כאן באשת אחיו מאביו הכ' מדבר.

Also his brother's wife is learned from Dodaso. Just like Dodaso said below regarding there is his father's paternal brother's wife, also his brother's wife said here, the verse discusses his paternal brother's wife.

עד כדון כרבי עקיבה כרבי ישמעאל

(i)

Until here is like R. Akiva. (He learns Dodaso from a Gezeirah Shavah, and his brother's wife from Dodaso.) According to R. Yishmael [he learns as follows];

תני רבי ישמעאל נאמרה כאן אשת אחיו ונאמר להלן ואיש אשר יקח את אשת אחיו נדה היא מה נדה יש לה היתר לאחר איסורה אף אשת אחיו יש לה היתר יצאת אשת אחיו מאמו שאין לה היתר לאחר איסורה.

R. Yishmael says, It says here "Eshes Achiv", and it says there "v'Ish Asher Yikach Es Eshes Achiv Nidah Hi" - just like Nidah has a Heter after she is forbidden, also Eshes Achiv has a Heter (Yibum). This excludes his maternal brother's wife, who has no Heter after she is forbidden.

SOMETHING THAT WAS IN A KLAL AND LEFT IT (Yerushalmi Halachah 5 Daf 32b)

והא (ר' יוחנן) [צ"ל ר"א - צפנת פענח] מקשי לה מנן תיתי ליה.

(a)

Question: R. Elazar challenged (these Limudim). What is his source [that there is Kares for each Ervah by herself]?

ר' אבהו בשם ר' לעזר בשם ר' הושעיה שתי לאוין וכרת אחד לאוין חולקין את ההכרת.

(b)

Answer (R. Avahu citing R. Lazar citing R. Hoshayah): Two Lavim and one Kares - the Lavim divide the Kares (there is Kares for each Lav).

מה טעמא על בשר אדם לא ייסך ובמתכנתו לא תעשו כמוהו וכתיב איש אשר ירקח כמוהו ואשר יתן ממנו על זר ונכרת מעמיו הרי כאן שני לאוין וכרת אחד לאוין חולקין את ההכרת.

What is the reason? It says "Al Besar Adam Lo Yisach uv'Maskunto Lo Sa'asu Kamohu", and it says "Ish Asher Yirkach Kamohu va'Asher Yiten Mimenu Al Zar v'Nichras me'Amav" - these are two Lavim and one Kares. The Lavim divide the Kares.

ועוד מן הדא שמואל בר אבא בעא קומי ר' זעירא ויצאו שלמים ויחלקו על כל הקדשים בטומאה

(c)

Question (Shmuel bar Aba, to R. Ze'ira): [A verse obligates Kares for eating Kodshim b'Tum'ah. Kares was taught explicitly about Shelamim. We should say that] Shelamim left [the Klal to divide, and] to obligate for each Kodshim [eaten] b'Tum'ah! (Below, we do not say so!)

[דף לג עמוד א] א"ל לצורך יצאו למעט קדשי בדק הבית שאין חייבין עליהן משום פיגול ונותר וטמא.

(d)

Answer (R. Ze'ira): It left for a need, to exclude Kodshei Bedek ha'Bayis. One is not liable for them for Pigul, Nosar and Tamei;

ולא מתניתא היא קדשי המזבח מצטרפין זה עם זה למעילה וחייבין עליהן משום פיגול ונותר וטמא מה שאין כן בקדשי בדק הבית מכיון (שאינן) [צ"ל שהן - פני משה] מצטרפין אינן חולקין.

A Mishnah teaches that Kodshei Mizbe'ach join with each other for Me'ilah, and one is liable for them for Pigul, Nosar and Tamei. This does not apply to Kodshei Bedek ha'Bayis. Since [Kodshei Mizbe'ach] join, they do not divide.

אמר רבי חנינה וכן היא צריכה ליה ויחלקו ולא יצטרפו.

(e)

Question (R. Chaninah): This Mishnah needs [a source! We should learn from Shelamim that Kodshei Mizbe'ach] divide, and do not join!

כלל בעשה ופרט בלא תעשה. מילתיה דר' לעזר אמרה כלל ופרט הוא.

(f)

If a Klal was said about an Aseh, and a Prat about a Lav, R. Lazar's teaching shows that this is a Klal u'Ferat (i.e. a Prat that left the Klal to teach about the Klal);

ר' לעזר אומר לוקין ע"י חרישה בשביעית

(R. Lazar): One is lashed for plowing in Shemitah.

רבי יוחנן אמר אין לוקין על ידי חרישה בשביעית.

2.

(R. Yochanan): One is not lashed for plowing in Shemitah.

מה טעמא דר' לעזר ושבתה הארץ שבת לה' כלל שדך לא תזרע וכרמך לא תזמר פרט. הזורע והזומר בכלל היו ולמה יצאו

What is R. Lazar's reason? "V'Shavsah ha'Aretz Shabbos la'Shem" is a Klal. "Sadcha Lo Sizra v'Karmecha Lo Sizmor" is a Prat. Seeding and pruning were in the Klal [of Avodah from which one must rest]. Why were they taught explicitly?

להקיש אליהם אלא מה הזורע והזומר מיוחדין שהן עבודה בארץ ובאילן אף אין לי אלא דבר שהוא עבודה בארץ ובאילן.

It is to equate [other Avodah] to them. Seeding and pruning are Avodah in the land and with trees. I learn [to forbid in Shemitah] only Avodah in the land and with trees.

מה עבד לה ר' יוחנן

(g)

Question: How does R. Yochanan explain this? (Why does he exempt from lashes?)

שני דברים הן ושני דברים שיצאו מן הכלל [צ"ל אינן - הגהות ר' יוסף דיננער] חולקין.

(h)

Answer: They are two matters, and two matters that left the Klal do not divide.

על דעתי' דר' אלעזר אינן חולקין. ואית ליה לחלוק אינן חולקין הא ללמד מלמדין.

(i)

Opinion #1 (R. Elazar): They do not divide. He holds that they do not divide, but they teach about other matters.

על דעתיה דרבי יוחנן אינן מלמדין. שנייה היא שכלל בעשה ופרט בלא תעשה ואין עשה מלמד על לא תעשה ואין לא תעשה מלמד על עשה.

(j)

Opinion #2 (R. Yochanan): They do not teach about other matters. Here is different for the Klal is an Aseh, and the Prat is a Lav, and an Aseh does not teach about a Lav, and a Lav does not teach about an Aseh.

על דעתיה דר' לעזר עשה מלמד על לא תעשה אבל לא תעשה אינו מלמד על עשה.

According to R. Lazar, an Aseh teaches about a Lav, but a Lav does not teach about an Aseh.

THE ISUR OF MELACHOS IN SHEMITAH (Yerushalmi Halachah 5 Daf 33a)

על דעתיה דר' יוחנן ניחא מותר לחפור בה בורות שיחין ומערות על דעתיה דר' לעזר מהו לחפור בה בורות שיחין ומערות

(a)

Question: According to R. Yochanan, it is fine - in [Shemitah] one may dig round and long pits, and caves. According to R. Lazar may one dig round and long pits, and caves?

כשם שאין מלמדין לענין איסור כך לענין היתר לא ילמדו.

(b)

Rejection of premise: [It is a question also according to R. Yochanan!] Just like we do not learn Isur, so we should not learn Heter! (HAGAHOS R. DINAR)

אמר ר' בא קרתיגנאה טעמא דרבי יוחנן שש שנים תזרע שדך לא בשביעית ושש שנים תזמר כרמך לא בשביעית. כל לא תעשה שהוא בא מכח עשה עשה הוא ועובר בעשה.

(c)

(R. Ba Kartigna'ah): R. Yochanan's reason is due to "Shesh Shanim Tizra Sadecha", but not in Shevi'is, and "Shesh Shanim Tizmor Karmecha", but not in Shevi'is. Every Lav that comes due to an Aseh is an Aseh, and [one who transgresses it,] he transgresses an Aseh.

(d)

(R. Yirmeyah): He transgresses an Aseh.

(e)

(R. Yosi): There is not even an Aseh.

Question: It says explicitly "v'Shavsah ha'Aretz Shabbos la'Shem"!

Answer: [This Aseh applies only] to what the Lav applies (seeding and pruning).

(h)

(Beraisa) Suggestion: One should be lashed for the addition! (This will be explained.)

(i)

Explanation #1 (R. Yochanan): The Beraisa suggests that one should be lashed for plowing in Shemitah. (This is an addition to what is written.)

רבי לעזר פתר מתניתא יכול יהו לוקים על איסור שני פרקים הראשונים.

(j)

Explanation #2 (R. Lazar): The Beraisa suggests that one should be lashed for the first two periods (of Tosefes Shemitah in Erev Shemitah. I.e. one may not plow a grain field after Pesach, or a tree field after Shavu'os.)

אית תניי תני ושש שנים תזרע שדך ושש שנים תזמר כרמך ואית תניי תני שדך לא תזרע וגו'.

Some teach [that the Beraisa brings the verse] "Shesh Shanim Tizra Sadecha v'Shesh Shanim Tizmor Karmecha", and some teach "Sadcha Lo Sizra..."

מאן דמר שש שנים מסייע (לרבי יוחנן) [צ"ל לר' לעזר - הגהות ר' יוסף דיננער] ומאן דמר שדך לא תזרע מסייע (לר' לעזר) [צ"ל לרבי יוחנן - הגהות ר' יוסף דיננער]

The one who says "Shesh Shanim..." supports R. Yochanan (the Torah permits working six full years, including all of Erev Shemitah). The one who says "Sadcha Lo Sizra..." supports R. Lazar (there is a Lav only for planting and pruning).

מתניתא (מסייע) [צ"ל פליגא על - פני משה] לרבי לעזר. השמר בלא תעשה פן לא תעשה. וכתיב שם תעלה עולותיך ושם תעשה. שם תעלה זו העלייה ושם תעשה זו השחיטה וזריקה.

(l)

Question (against R. Lazar - Beraisa): "Hishamer" [lest you offer Olos outside the Mikdash] is a Lav. "Pen" is a Lav. "Sham Ta'aleh Olosecha v'Sham Ta'aseh" - "Sham Ta'aleh" is Aliyah [putting them on the fire]. V'Sham Ta'aseh is Shechitah and Zerikah;

מה העלייה שהוא בעשה הרי היא בלא תעשה אף שחיטה וזריקה שהן בעשה יהו בלא תעשה.

Just like Aliyah, which is [forbidden] due to an Aseh, there is a Lav (Hishamer Pen), also Shechitah and Zerikah, which are [forbidden] due to an Aseh, there is a Lav!

בגין דכתיב שם תעלה ושם תעשה והא אילו לא כתיב שם תעלה ושם תעשה אין עשה מלמד על לא תעשה ואין לא תעשה מלמד על עשה.

Inference: This is because it is written "Sham Ta'aleh... v'Sham Ta'aseh." Had it not written "Sham Ta'aleh v'Sham Ta'aseh", the Aseh would not teach about the Lav, and the Lav would not teach about the Aseh!

(m)

Question: How does R. [E]lazar explain this?

שלא תאמר כמה דתימר גבי שבת חפר חרץ נעץ אינו חייב אלא אחת ודכוותה שחט והעלה לא יהא חייב אלא אחת לפום כן צריך מימר חייב על כל אחת ואחת.

(n)

Answer: We should not say like we say about Shabbos - if one dug, made a groove and inserted, he is liable only once [for planting], similarly if he slaughtered and offered [outside the Mikdash], he is liable only once! Therefore, it needed to say that he is liable for each one.

רבי זעירה רב חייה בר אשי בשם כהנא הנוטע (בשבת) [צ"ל שביעית - הג"ר מאיר שמחה] חייב משום זורע

(o)

(R. Zeirah citing R. Chiya bar Ashi citing Kahana): One who plants [a sapling] in Shemitah is liable for Zore'a (seeding).

רבי זעירה אומר זומר כנוטע.

(p)

(R. Zeirah): Zomer (pruning) is like Zore'a.

נטע וזמר (בשבת) [צ"ל שביעית - הג"ר מאיר שמחה] על דעתיה דכהנא חייב שתים על דעתיה דרבי זעירה אינו חייב אלא אחת.

(q)

If one planted and pruned in Shemitah, according to Kahana he is liable (lashed) twice. According to R. Zeirah, he is liable only once.

כלום אמר רבי זעירה אלא זומר כנוטע דילמא נוטע כזומר

(r)

Rebuttal: R. Zeirah said only that pruning is like planting (it was included in Zore'a, and the Torah taught it by itself to add a second Lav). Did he say that planting is [only] like pruning?! (Surely he is liable also for Zore'a)!

הכל היה בכלל זריעה ויצאת זמירה להחמיר על עצמה מפני שיצאת זמירה להחמיר על עצמה את פוטרו משום זורע.

Everything (seeding and planting) was included in Zeriah ("Sadcha Lo Sizra"). Zemirah was taught by itself to be stringent about (forbid) itself. Because it was taught by itself to be stringent about itself, will you exempt it from Zore'a?!

הוי לא שנייא נטע וזמר בשבת בין על דעתיה דכהנא בין על דעתיה דרבי זעירה חייב שתים:

(s)

Conclusion: There is no argument about one who plants and prunes on Shabbos. Both according to Kahana and R. Zeirah, he is liable twice.
