NEDARIM 85 - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the Yahrzeit of her father, Rav Mordechai ben Eliezer Zvi (Rabbi Morton Weiner) Z'L, who passed away on 18 Teves 5760. May the merit of supporting and advancing Dafyomi study -- which was so important to him -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה אינו משלם אלא דמי חולין שבו

(a)

Gemara: He pays only the value of the Chulin in it.

אבל לא דמי תרומות ומעשרות ואפילו לפי טובת הנאה שיש לו בהן דסבירא ליה דטובת הנאה אינה ממון.

Explanation: But he does not pay the value of the Terumos and Ma'aseros, and even based on his Tovas Hana'ah in them, for he holds that Tovas Hana'ah is not Mamon.

ר"ן ד"ה במתנות שלא הורמו קמיפלגי

Gemara: They argue about gifts that were not separated.

דרבי סבר כיון שלא הורמו תרומות ומעשרות הוו להו כחולין שבו דלאו כמי שהורמו דמיין

Explanation: Rebbi holds that since Terumos and Ma'aseros were not separated, they are like Chulin in it, for it is not as if they were separated;

ורבי יוסי סבר כמי שהורמו דמיין ואין לו בהם כלום ומשום הכי אינו משלם אלא דמי חולין שבו.

R. Yosi [b'Ribi Yehudah] holds that it is as if they were separated, and he has no [ownership] in them. Therefore, [the thief] pays only the value of the Chulin in it.

Gemara: What is the difference if they were separated, or if they were not separated?

דכיון דטובת הנאה אינה ממון כי לא הורמו מאי הוי דהא פתיכי ביה תרומה ומעשר שאין לו בהן כלום.

Explanation: Since Tovas Hana'ah is not Mamon, so what if they were not separated? Terumah and Ma'aser are mixed with them, in which he has no ownership!

(SUMMARY: The Ran shows how we can explain if all agree that Tovas Hana'ah is Mamon, and if all agree that it is not Mamon.)

Explanation: Now we do not decide whether both of them hold that Tovas Hana'ah is Mamon or it is not Mamon;

ואי אית להו טובת הנאה אינה ממון לרבי יוסי ברבי יהודה ניחא

If [both] hold that Tovas Hana'ah is not Mamon, this is fine for R. Yosi b'Rebbi Yehudah;

ורבי היינו טעמיה דקנסוהו רבנן לגנב לשלם טובת הנאה של תרומות ומעשרות לבעל הבית

(What is Rebbi's reason?) Rebbi holds that Rabanan fined the thief to pay Tovas Hana'ah of Terumos and Ma'aseros to the Ba'al ha'Bayis.

If they hold that Tovas Hana'ah is Mamon, this is fine for Rebbi;

ורבי יוסי ברבי יהודה היינו טעמיה דאינו משלם אלא דמי חולין שבו משום דקנסוהו רבנן שלא ישלם לו טובת הנאה שבתרומה ומעשרות.

(What is R. Yosi b'Ribi R. Yehudah's reason?) He holds that he pays only the value of the Chulin inside, because Chachamim fined [the Ba'al ha'Bayis for delaying giving the tithes, so the thief] does not pay the Tovas Hana'ah in the Terumah and Ma'aseros.

RAN DH Rava Amar She'ani Terumah [TRANSLATION: Rava said, Terumah is different.]

(SUMMARY: The Ran explains that he holds that Tovas Hana'ah is Mamon.)

כלומר כולה מתני' אית לה דטובת הנאה ממון וסיפא ניחא דכהנים אלו יטלו אחרים

Explanation: The entire Mishnah holds that Tovas Hana'ah is Mamon. The Seifa is fine. [When he said] "these Kohanim", others take;

ורישא היינו טעמא דיטלו בעל כרחו משום דתרומה לא חזיא אלא לכהנים שאי אפשר ליתנה לישראל

The reason for the Reisha (when he forbade all Kohanim), they take b'Al Korcho (against his will) is because Terumah is proper only for Kohanim. He may not give it to a Yisrael;

הלכך כיון דאתי למיסרה (הגהה בגליון, הגהות ישנות)) עלייהו שויא עפרא בעלמא דאפקריה לההיא טובת הנאה שיש לו בה.

Therefore, since he comes to forbid it to them, he considers it like mere earth. He was Mafkir the Tovas Hana'ah that he has in it.

RAN DH umi'Ha Sham'inan [TRANSLATION: And from here, we learn...]

ר"ן ד"ה ומהא שמעינן

(SUMMARY: The Ran discusses why we are not concerned lest he permit his vow.)

שהאוסר הנאת פירותיו (הגהות ישנות) על עצמו יכולים אחרים ליטול אותן בעל כרחו ואינו יכול לעכב

Inference: [We learn from here that] if one forbade his Peros to himself, others can take them b'Al Korcho. He cannot stop them.

אע"פ שיכול לישאל על נדרו

Implied question: He could permit his vow [and they will be permitted to him]!

כיון דהשתא מיהא הא לא איתשיל

(c)

Answer: Since now he did not permit it [they may take].

מיהו היכא דאיתשיל חייבין לשלם דכיון דחכם עוקר הנדר מעיקרו כיון דאיתשיל הויין להו הנך פירי כאילו לא אתסרו עליה מעולם

Distinction: However, when he did permit [his vow afterwards], they must pay. Since a Chacham uproots a vow from its source, after he permitted it, it is as if these Peros were never forbidden to him.

וא"ת אם כן היאך יטלו כהנים על כרחו למה לא נחוש דלמא מיתשיל ומתהני מדידיה

Question: If so, why may Kohanim take b'Al Korcho? Why are we not concerned lest he will permit [his vow], and they benefit from his [Tovas Hana'ah]?

לאו קושיא היא דהתנן המקדש האשה על תנאי שאין עליה או עליו נדרים ונמצאו עליה או עליו נדרים אינה מקודשת

Answer: This is not difficult. A Mishnah (Kesuvos 72b) teaches that one who is Mekadesh a woman on condition that she or he has no vows, and it was found that she or he has vows, she is not Mekudeshes;

ומדקתני אינה מקודשת משמע שאינה מקודשת כלל ויכולה להנשא לאחר

"She is not Mekudeshes" connotes that she is not Mekudeshes at all, and she may marry someone else.

אע"ג דתניא התם הלכה אצל חכם והתירה וכן הוא שהלך אצל חכם והתירו מקודשת

Implied question: A Beraisa there (74b) teaches that if she went to a Chacham and he permitted her, and similarly (75a) if he went to a Chacham and he permitted him, she is Mekudeshes! (We should be concerned for this.)

אלמא אע"ג דמצי מיתשיל וחיילי קדושי למפרע כל אימת דלא מיתשיל לא חיישינן דלמא מיתשיל

Answer: Even though one can permit, and the Kidushin will take effect retroactively, as long as he [or she] did not permit, we are not concerned lest he permit;

הכא נמי דאם איתשיל עבדו כהנים איסורא למפרע כל אימת דלא איתשיל לא חיישינן להכי, הרשב"א ז"ל.

Also here, if he asks, Kohanim did an Isur retroactively. As long as he does not ask, we are not concerned for this. The Rashba said so.

RAN DH va'Ani Mistapek b'Zeh [TRANSLATION: And I am unsure about this.]

(SUMMARY: The Ran questions what he wrote above in the name of the Rashba.)

לפי שמשעה שאסרו על עצמו הפקירו וכל שזכה בו אחר קנה כזוכה מן ההפקר

Question: [I am unsure about this.] Once he forbade it to himself, he was Mafkir it. Whoever acquires it afterwards is like one who acquired from Hefker;

Implied question: The Isur (the reason he was Mafkir it) went away through She'elah (permitting his vow)!

Answer: This one's (the one who acquired it) Kinyan is not Batel. I do not find She'elah regarding Hefker. Therefore, they may take b'Al Korcho.

Support: If not, since Nedarim are destined to ask to permit them - this is why above (59a) they are considered Davar she'Yesh Lo Matirim - we would be concerned lest he ask.

Implied question: The Mishnah says that she is not Mekudeshes [due to vows. We are not concerned lest she permit them!]

לא שתהא מותרת לינשא אלא דינא קתני

Answer #1: She may not have Nisu'in [with another man]. Rather, [the Mishnah] teaches the law [now].

Answer #2: Even if you will say that it teaches a uniform law, this is because we are not concerned about her. [If she was Niseis to another man,] she will not ruin herself [through permitting her vows, and causing the first Kidushin to take effect retroactively];

Regarding [Kidushin on Tenai that there are no vows on] him, we do not find in the Gemara that she is not Mekudeshes (for a man may marry multiple wives. Even if he was Nosei another woman, and permitted his vow, which validates the first Kidushin, he did not transgress. Therefore, this is like a regular vow, which is destined to be permitted),

We find only (75a) "however, if he went to a Chacham and he permitted him, she is Mekudeshes", i.e. she is totally Mekudeshes;

However, if he did not go, we can say that we are concerned (she is Safek Mekudeshes)! So it seems to me.

ר"ן ד"ה מתני'. קונם שאני עושה ע"פ אבא

Mishnah: Konam is what I do, to father's mouth.

מה שאני עושה יהא לפי אבא בקונם.

Explanation: What I make is forbidden to father's mouth via Konam.

ר"ן ד"ה אינו יכול להפר

(b)

Mishnah: He cannot annul.

דאין אלו נדרי עינוי נפש ולא דברים שבינו לבינה.

Explanation: These are not vows of affliction, and not matters between him and her.

ר"ן ד"ה שאני עושה על פיך אינו צריך להפר

Mishnah: 'What I do for your mouth', he need not annul.

Explanation: R. Akiva holds that the excess is hers, and her vow takes effect on it, for she is not obligated to him [to produce extra]. Therefore, he must annul. However, he annuls due to matters between him and her;

ות"ק לא חייש להכי משום דסבירא ליה דהעדפה נמי דידיה הוי

The first Tana was not concerned for this, because he holds that also the excess is his.

והאי העדפה היינו שתעדיף על מה שפסקו לה חכמים לעשות לבעלה דהיינו משקל חמש סלעים כדאיתא בפרק אע"פ (כתובות סד:).

This excess is what she produces more than what Chachamim ruled that she must do for her husband, i.e. [spinning] the weight of five Sela'im [of warp-thread], like it says in Kesuvos (64b).

RAN DH R. Yochanan ben Nuri Omer... [TRANSLATION: R. Yochanan ben Nuri says, he should annul, lest he divorce her, and she be forbidden to remarry him.] (pertains to Amud A)

Explanation: R. Yochanan ben Nuri holds like the first Tana, that also the excess is the husband's. Therefore, he need not annul due to excess;

אלא שמא יגרשנה ויהא הנדר חל שמשגרשה אינה משועבדת לו למעשה ידיה

However, perhaps he will divorce her and the vow will take effect, for once he divorced her, she is not obligated to work for him;

ותהא אסורה לחזור לו לפי שנאסר במעשה ידיה ואי אפשר לו ליזהר שלא תטחון ושלא תאפה וכל שאר מלאכות השנויות במשנתנו שאשה עושה לבעלה

It will be forbidden for her to return to him, since her work is forbidden to him, and it is impossible for him to be careful that she not grind, bake or do all other Melachos taught in our Mishnah that a woman does for her husband.

The first Tana disagrees with R. Yochanan ben Nuri, either because he holds that Hafarah does not help for after divorce, or because the vow itself, since now it does not take effect, also later it does not take effect.

Observation: Regarding their argument about excess, whether or not it is the husband's, in Kesuvos (66a) we establish it to be about excess through exertion, like it says there.

Explanation: Some establish this in Kesuvos (58b) even when he feeds her;

Even so, she has permission to be Mevatel his Hekdesh, and she works and eats due to Rav Huna's teaching. He said there that a woman can tell her husband "I will not be fed from you, and I will not work for you";

The one who argues with Rav Huna there, he establishes our Mishnah when he does not feed her. Therefore, she works and eats.

Gemara: And the excess.

אם הקדיש מותר מעשה ידיה דהיינו יתר על חמש סלעים ביהודה כדאיתא התם.

Implication #2: [The Halachah is unlike] what he said that the excess is hers. This is wrong. Rather, it is her husband's.

Explanation: You cannot ask from Hekdesh to Konamos. Even though Ein Adam Makdish Davar she'Lo Ba l'Olam, one can forbid [through Konam] Davar she'Lo Ba l'Olam.

דאשכחן מילתא דאיתא בקונמות וליתא בהקדש שהרי אע"פ שאין אדם מקדיש פירות חבירו אדם אוסר פירות חבירו עליו

We find a matter that applies to Konamos that does not apply to Hekdesh. Even though one cannot be Makdish another's Peros, one can forbid another's Peros to himself.

וכיון שכן אדם אוסר נמי דבר שלא בא לעולם דהא פירות חבירו לדידיה כדבר שלא בא לעולם דמי דלית ליה בהו מידי.

Therefore, one can forbid also Davar she'Lo Ba l'Olam, for another's Peros to himself is like Davar she'Lo Ba l'Olam, for he has no [rights] in them.

However, from your very source [you are refuted]! You find in Konamos that one forbids only when one of them is in his Reshus - either the Peros, or the one to whom they are forbidden;

This is just like one can forbid his Peros to his friend, even though his friend is not in his Reshus, since the Peros are in his Reshus. This shows that one of them suffices.

ומהא שפיר איכא למילף דאדם אוסר דבר שלא בא לעולם דדבר שלא בא לעולם כפירות חבירו דמי.

Gemara: However, can he forbid Davar she'Lo Ba l'Olam to his friend...?!

דומיא דמתניתין שאוסרת מעשה ידיה שלא באו לעולם על בעלה הא לא מצית למיפשט לאיסורא

Explanation: Similar to our Mishnah, that she forbids her earnings, she'Lo Ba'u l'Olam, to her husband, you cannot learn to forbid it;

אדרבה ממקום שבאת איכא למילף היתרא שהרי אין אדם אוסר פירות חבירו על חבירו

Just the contrary, from the place that you come [to forbid], one can learn to permit, for one cannot forbid his friend's produce to his friend;
