Why does the Torah insert "be'Chol Moshvoseichem" (See Torah Temimah, note 40)?

1.

Rashbam: To teach us that the prohibition against eating Cheilev and Dam applies even in locations where there are no Korbanos, where only Chulin is eaten and they are not brought on the Mizbe'ach. 1

2.

Moshav Zekenim: Whenever something is permitted in the Beis-Hamikdash and forbidden to commoners, 2 the Torah inserts ?be?Chol Moshvoseichem?.

3.

Kidushin, 37b: To teach us that the prohibition against eating Cheilev and Dam applies even in an era when there are no Korbanos. 3

1

Refer to 3:17:3:1*.

2

Moshav Zekenim:Such as Shabbos, since the Kohanim sacrifice Korbanos in the Beis-Hamikdash on Shabbos, and Yom Kipur, since it is unlike the Mo'adim and its punishment is more severe - and the Kohen Gadol should not think that he can do Melachah in his house like he did in the Mikdash (Why did he need to give new reasons for Yom Kipur? The same reason given for Shabbos should suffice! Perhaps it is because any Kohen may serve on Shabbos, but only the Kohen Gadol on Yom Kipur - PF).

3

Kidushin (Ibid.): Even though the prohibition is mentioned in the Parshah of Korbanos.

2)

3)

How will we reconcile this Pasuk which forbids all Cheilev, with the Pasuk in Re'ei Devarim, 12:22, which permits the Cheilev of a Tzvi and an Ayal?

1.

Rashi (in the Beraisa of R. Yishma'el): Therefore the Torah adds a third Pasuk in Tzav, 7:23 "Kol Cheilev Shor, ve'Chesev va'Eiz Lo Socheilu", implying that the Cheilev of Chayos and birds are permitted min haTorah.

4)

Why does the Torah prescribe five La'avin for Dam?

1.

Moshav Zekeinim: 1. Blood that seeps out after the animal dies); 2. Blood of (that is absorbed in) the limbs; 1 3. Dam ha'Evarim; 4. Dam [Shechitah of a Chayah or bird, which must be] covered; 5. Dam ha'Nefesh. 2 .

2.

Kerisus, 4b 3 : 1. Dam Chulin; 2. Dam Kodshim: 3. Dam Kisuy XXX; 4. Dam ha'Tamtzis; 4 5. Dam ha'Evarim. 5

1

Which is only forbidden if it has been separated from the limb.

2

Dam ha'Nefesh is subject to Kareis, whereas Dam haTamtzis and Dam ha'Evarim are only subject to a La'av.

3

See Torah Temimah note 42 for sources.

4

See Torah Temimah, note 43.

5

This is synonymouss with Dam ha'Nefesh. See Torah Temimah, note 43. Refer also to 3:17:3:1* & 3:17:3:1* 6

.

5)

Which kinds of blood are forbidden?

1.

Moshav Zekenim: Blood of a Behemah, Chayah or bird - it says "la'Of ve'la'Behemah", and Chayos are included in "Behemah".
