Question (R. Elchanan): [R. Eliezer] ha'Kalir composed a Piyut that we say on the second day of Pesach "His righteousness - [He commanded] not to slaughter an animal and its child on the same day."

דמשמע שר"ל שהקב"ה חס על אותו ואת בנו והוא אינו אלא גזירה.

This connotes that Hash-m had compassion on the animal and its child. Really this [like every Mitzvah] is merely a [Divine] decree! (Ma'aseh Roke'ach on Rambam Hilchos Tefilah 9:7 - Targum Yonason and the Midrash say that Hash-m had compassion! The Isur is only to say so in Tefilah (Tosfos Yom Tov Berachos 5:3). Piskei Tosfos 84 - the Isur to say "Your mercy extends to a bird's nest" is because it arouses jealousy among the creations. Amora'im argue about whether the Isur is for saying that Hash-m had mercy on the bird, or due to envy. I saw in the name of Ratzuf Ahavah that ha'Kalir (perhaps he was R. Elazar b'Rebbi Shimon) holds like the latter opinion!)

TOSFOS DH ha'Kol b'Yedei Shamayim Chutz mi'Yir'as Shamayim

תוספות ד"ה הכל בידי שמים חוץ מיראת שמים

(SUMMARY: Tosfos resolves this with a Gemara that says that illnesses are b'Yedei Adam.)

Question: In Kesuvos (30a), we say that everything is in the hands of Heaven, except for [sickness due to] the cold or heat!

Answer: Here we discuss a person's dispositions, if he will be wise or foolish, poor or rich, strong or weak;

There (in Kesuvos), we discuss occurrences that happen to a person after he is born. Also they are in the hands of Heaven, except for Tzinim and Pachim, i.e. [sickness due to] the cold or heat!

ולא קשה מהא דכתיב לפני קרתו מי יעמוד (תהלים קמז)

Implied question: It says "Lifnei Karaso Mi Ya'amod" (one cannot protect himself from cold)!

דה"פ אם ישלחנה בפעם אחת כדכתיב בראש הפסוק משליך קרחו כפתים

Answer: The verse means that if He would send it all at once [no one could bear it], like the beginning of the verse says "Mashlich Karcho ch'Fitim."

וגם לא קשה מהא דכתיב ואין נסתר מחמתו (שם יט)

Implied question: It says "v'Ein Nistar mi'Chamaso" (there is no escape when the sun is very strong)!

דההיא בעוברי דרכים הוא דקאמר אבל כל זמן שהוא בביתו ודאי יכול הוא לינצל ממנו.

Answer: The verse discusses travelers. However, as long as one is in his house, surely he can save himself from it.

Explanation #1: This refers to what is at the extremes of the world in the east and west.

Question: In the Yerushalmi, Amora'im argue. One says that from "va'Yomer" until "l'Shimtzah b'Kameihem" is the second account of the calf, i.e. the end of the verse "va'Yar Moshe" (which is right after "and this calf came out");

ולפרש"י לא היה לו לומר אלא עד תחלת הפסוק

According to Rashi, it should have said only until the beginning of the verse! (I.e. we should permit translating the verse "va'Yar Moshe... b'Kameihem", for it does not suggest that it had power!)

לכן נראה כדמפרש בירושלמי דהטעם הוי לפי שאין דומה גנאי של יחיד ביחיד או של צבור בצבור לגנאי של יחיד בצבור

Answer: Rather, the reason [we do not translate it] is like the Yerushalmi says, for the disgrace of an individual [read by] an individual, or of the Tzibur [read by] the Tzibur, is unlike (much less than) the disgrace of an individual [read by] the Tzibur;

ומשום כבודו של אהרן לא רצו לתרגם.

(SUMMARY: Tosfos deletes uv'Ma'amados from the text.)

לא גרס ובמעמדות שהרי גבי מעמדות לא מצינו רחוב אלא לבית הכנסת היו הולכין כדתניא בפ' בתרא דתענית (דף כו.).

Assertion: The text does not say "uv'Ma'amados", for we do not find a [city] square. Rather, they used to go to the Beis ha'Keneses, like a Beraisa in Ta'anis (26a).
