CHECKS BEFORE MARRIAGE (Yerushalmi Halachah 4 Daf 44b)

משנה הנושא אשה כוהנת צריך לבדוק אחריה ארבע אמהות שהן שמונה אמה ואם אמה ואם אבי אביה ואמה

(a)

(Mishnah): If a man marries a bas Kohen, he must check into her four mothers, which is actually eight...Her mother, her mother's father's mother, her father's mother, her father's father's mother and the mothers of these women.

ולויה וישראלית מוסיפין עוד אחת:

In order to marry a bas Levi or bas Yisrael, one must also check an additional mother.

גמרא אמר רבי יוחנן דרבי מאיר היא [דף מה עמוד א] דתני

(Gemara - R. Yochanan): The Mishnah is authored by R. Meir, as the Beraisa teaches...

אי זו היא עיסה כשירה כל שאין בה לא (חלל ולא) ממזר ולא נתין [ולא עבדי מלכים].

What is considered to be a 'mixture' (i.e. a family of doubtful genealogy) who are Kasher (that their daughter can marry a Kohen)? If there is no possibility of Mamzer, Nasin or slaves of royalty (only a possibility of being a Chalal) in their genealogy.

ר' מאיר אומר כל שאין בה אחת מכל אילו בתה כשירה לכהונה אבל משפחה שנשתקע בה פסול

R. Meir: Whoever does not have one of these in their genealogy, their daughter may marry a Kohen (despite the doubt of Chalal). However, if there was a certain Chalal status in a family, their daughter may not marry a Kohen.

רבי מאיר אומר בודק עד ארבע אימהות ומשיא

R. Meir: He must check four mothers before he marries.

וחכמים אומרים בודק לעולם.

Chachamim: He must always check (even if there is no reason to think that there is a pesul in the family).

[דף מט עמוד ב (עוז והדר)] רב אמר זו דברי ר' מאיר. אבל חכמים אומרים בודק מאי זו משפחה משיאין לכהונה ומשיא.

Rav: This (requirement to check four mothers) is R. Meir's opinion, but Chachamim say that if a family married Kohanim, one could marry one's children to that family.

WITH WHOM SHOULD ONE CHECK? (Yerushalmi Halachah 4 Daf 45a)

(a)

Question: With whom should one check?

רבי חגיי בשם רבי יאשיה בודק ביד קרובותיו

(b)

Answer (R. Chagai citing R. Yoshiyah): He should check her through her relatives (i.e. even women are believed).

ר' חמא אתא סבא אמר ליה משיאין לכהונה מן הדא זרעיתא

(c)

Question (R. Chama to an elder): May a Kohen marry a daughter of this (certain) family?

אמר ליה אין ואסיב על פומיה

(d)

The elder answered in the positive and as a result of this, R. Chama married.

רב אמר לחייה בריה נחות דרג וסב איתא.

(e)

Rav to his son Chiyah: Go down a step to marry a woman (i.e. marry a woman from a family without the lesser quality lineage than you so that she will not dominate you).

אמר רב אידי שכיחא הא מילתא בפומהון דרבנין (במדבר ה) ואם לא נטמאה האשה וטהורה היא. מכיון שלא נטמאה טהורה ולא כיהודה בן פפוס שנועל דלת בפני אשתו אמר[ו] ליה נהוגין הוון אבהתך עבדין כן. .

Rav Idi: The Rabbanan often say - the pasuk states (Bamidbar 5, 28), "If the woman was not defiled and she is pure'' - if she was not defiled, she is certainly pure?! Rather, it is teaching that if it was not known that she was defiled (as there was no known report about it), she is pure. This is unlike Yehudah ben Papus who would lock his wife inside the house so that she would not chat with any man. They said to Yehudah ben Papus - did your fathers behave this way?! (It is not correct to do this as it causes her to be resentful).

חד כהן אתא לגבי ר' יוחנן אמר ליה עבדית מתניתא נשאתי אשה כהנת ובדקתי אחריה ארבעה אימהות שהן שמונה.

A Kohen once came before R. Yochanan and said, "I followed the Mishnah and only married a Bas Kohen after checking into four, which is actually eight, mothers.''

אמר ליה אין הוא עיקרא לקי מן ראשה מן מודע לך.

(h)

R. Yochanan: If there was a pesul at the head of the family, would you have even discovered it? Rather, the Halachah follows the Chachamim that there is no need to check.

לווים ישראלים מוסיפין עליה עוד אחת

(i)

The Mishnah taught that for a bas Levi and a bas Yisrael, they required checking an additional mother.

ולא נמצאת מחמיר בישראלים יותר מן הכהנים.

(j)

Question: Does that not mean that we are more stringent with Yisraelim than Kohanim?!

אמר רבי יוסי בי רבי בון אחת זו ואחת זו קנס קנסו חכמים בהן כדי שיהא אדם דבק בשבטו ובמשפחתו:

Answer (R. Yosi bei R. Bun): For both of them, the Chachamim applied a penalty in order to ensure that a person clings to his tribe and family. (Therefore, since the Chachamim would try to dissuade, for example, a Yisrael from marrying a bas Kohen, they would penalize him further by requiring further checks.)

WHEN NO CHECKING IS NECESSARY (Yerushalmi Halachah 5 Daf 45a)

משנה אין בודקין לא מן המזבח ולמעלה ולא מן הדוכן ולמעלה [ולא מן הסנהדרין ולמעלה]

(a)

(Mishnah): There is no need to check beyond the Altar (i.e. if it was discovered that a girl's [fore]father served in the Temple) or beyond the platform (if it was discovered that a [fore]father served in the Temple on the platform where the Leviim stand to sing and play music) or if he served in the Sanhedrin.

וכל מי שהחזיקו אבותינו משוטרי הרבים וגבאי הצדקה משיאין לכהונה ואין צריך לבדוק אחריהן

(b)

A Kohen may marry anyone without checking, if their [fore]fathers were judges or charity collectors.

רבי יוסי אומר [דף מה עמוד ב] אף מי שהיה חתום בערכי הישנה של ציפורי

(c)

R. Yosi: Even one who was listed amongst the potential judges in the town of Yeshanah near Tzipori (as they were careful only to allow judges with good genealogy).

ר' חנניה בן אנטיגנוס אומר אף מי שהיה מוכתב באיסטרטא של מלך:

R. Chananyah ben Antignus: Even one who was listed amongst the legions of the army of the House of David.

גמרא כתיב (דברים יז) שום תשים עליך מלך. אין לי אלא מלך מניין לרבות שוטרי הרבים וגבאי צדקה וסופרי דיינין ומכין ברצועה מניין.

(e)

(Gemara - question): The pasuk states (Devarim 17, 15), "You shall surely appoint a king over yourself''. This only refers to a king; what about appointments of judges, charity collectors, scribes and those appointed to whip offenders?

ת''ל מקרב אחיך תשים עליך מלך. כל שתמניהו עליך לא יהא אלא מן הברורין שבאחיך.

(f)

Answer: The pasuk states (ibid), "...from amongst your brothers, you shall appoint a king'' - any appointment that you make upon yourselves should be from your finest brothers (i.e. those with fine lineage).

R. Shmuel bar Nachman citing R. Yonasan: The pasuk states (Divrei Hayamim 1, 7, 40), "According to their genealogical lists, in battle...'' - the merit of their lineage will stand for them in war.

עד כדון מן הקבלה מדברי תורה (דברים כג) לא יבא ממזר בקהל י''י. (שם) לא יבא פצוע דכא וגו' וגו' מה כתיב בתריה כי תצא מחנה על אויבך וגו'

(h)

This is a pasuk in Writings, but is there a pasuk in the Torah itself? The pasuk states (Devarim 23, 3), "a Mamzer shall not enter the congregation of Hashem''. The previous pasuk also states, "one with squashed testicles shall not enter etc.'' It is after this that the pasuk states, "When you shall go out against your enemies etc.''
