FURTHER LAWS LEARNED FROM THE PESUKIM ABOUT THE JEWISH SLAVE (Yerushalmi Halachah 2 Daf 11b)

(שמות כא) ואם אמור יאמר העבד שתי אמירות אחת בסוף שש ואחת בתחילת שבע אחת בסוף שש עד שהוא בעבודתו ואחת בתחילת שבע (שם) לא אצא חפשי (שם)

(a)

Beraisa cont'd: The pasuk states (Shemos 21, 5), "And if the slave shall surely say (amor yomar)'' - there are two 'sayings' here - one at the end of the 6th years and one at the beginning of the 7th. At the end of the 6th - whilst he is still in servitude (as the pasuk still calls him a slave); at the beginning of the 7th - which is when he chooses to say, "I will not go free''.

אהבתי את אדוני את אשתי ואת בני מלמד שאינו נרצע עד שיהא לו אשה ובנים ולרבו אשה ובנים עד שיהא אוהב את רבו ורבו אוהבו עד שיתברכו הנכסים על ידיו שנאמר (דברים טו) כי טוב לו עמך

The pasuk then continues, "I love my master, my wife and my children'' - this teaches they he is only bored if he has a wife and children, his master has a wife and children, he loves his master and his master loves him, that his possessions are blessed through this slave, as the pasuk states (Devarim 15, 16), "...as it is good for him with you''.

[דף יא עמוד ב (עוז והדר)] וקונה את עצמו ביובל דכתיב (ויקרא כה) ויצא (ביובל) [מעמך] הוא ובניו עמו

The Mishnah taught: He acquires himself in yovel - as the pasuk states (Vayikra 25, 41), "and he shall leave [you] (in yovel)...he and his sons with him''.

ובמיתת האדון דכתיב (דברים טו) והיה לך עבד עולם כל ימי עולמו של אדון:

The Mishnah taught: ...and upon the death of the master - as the pasuk states (Devarim 15, 17), "...and he shall be to you an eternal slave'' - meaning the eternity (the lifetime) of the master.

THE CANAANITE SLAVE (Yerushalmi Halachah 3 Daf 11b)

משנה עבד כנעני נקנה בכסף בשטר ובחזקה

(a)

(Mishnah): A Canaanite slave is acquired through money, a document or Chazakah (seizing i.e. an act of taking possession).

וקונה את עצמו בכסף על ידי אחרים ובשטר על ידי [דף יב עמוד א] עצמו דברי ר' מאיר

(b)

R. Meir: And he acquires himself (i.e. freedom) through the money given by others or through him receiving a document.

וחכמים אומרים אף בכסף על ידי עצמו ובשטר על ידי אחרים ובלבד שיהא הכסף משל אחרים:

Chachamim: Even through his own money, as long as it was received from others or through a document received by others (on his behalf), he also goes free.

כתיב (ויקרא כה) והתנחלתם אותם לבניכם אחריכם לרשת אחוזה וגו' הקיש עבדים לאחוזה מה אחוזה ניקנית בכסף ובשטר ובחזקה אף עבד כנעני נקנה בכסף ובשטר ובחזקה

(Gemara): The pasuk states (Vayikra 25, 46), "And you shall give them as a heritage to your children after you to inherit as a possession etc.'' The Torah compares slaves with fields - just as a field is acquired through either money, a document or taking possession (chazakah); so too a Canaanite slave.

Question: What is the source that one can acquire a field in one of those 3 ways?

(ירמיהו לב) שדות בכסף יקנו וכתוב בספר וחתום והעד עדים וחתום אילו עידי שטר והעד עדים אילו עידי חזקה

Answer: The pasuk states (Yirmiyahu 32, 44), "They shall acquire fields with money...'' - this teaches acquisition of a field through giving money. "...and write it in a document and seal it'' - this teaches acquisition of a field using a document. "...and assign witnesses'' - this refers to witnesses to the chazakah.

או אינן אלא אילו עידי שטר

Question: Perhaps it refers to witnesses to the document?

כבר כתיב וכתוב בספר וחתום

(h)

Answer: The pasuk has already said "and write it in a document and seal it'' - which refers to witnesses to the document. Therefore the phrase "and assign witnesses'' must be referring to witnesses to the chazakah.

THE MINIMUM VALUE OF A FIELD (Yerushalmi Halachah 3 Daf 12a)

רבי יסא בשם רבי מנא רבי תנחום רבי אבהו בשם ר' יוחנן אין קרקע נקנה בפחות משוה פרוטה

(a)

R. Yasa citing R. Mana/R. Tanchum/ R. Abahu citing R. Yochanan: A field cannot be acquired for less than the value of a Perutah.

מה טעמא שדות בכסף יקנו

(b)

Question: What is his source? The pasuk states (ibid) "They shall acquire fields with money...''

ופליג על ההוא דא''ר חנינה כל שקלים שכתוב בתורה סלעים ובנביאים ליטרא ובכתובים קינטרין

(c)

Question: This appears to disagree with the statement of R. Chanina that every time the Torah uses the word 'shekalim' it means 'selaim'; in Neviim it means 'litra' and in Kesuvim it means 'Kintarin'. (Since Yirmiyah is in Neviim, the pasuk seems to be referring to using at least a litra to buy a field.)...?

R. Yuda ben Pazi: The exception to this rule is the shekalim of Efron (who sold the Ma'aras HaMachpelah to Avraham for the burial of Sarah), where Kintarin were used, as the pasuk states (Bereishis 23, 9), "for the full price let him give it to me'' - implying the highest coinage.

(d)

Answer to (c): The pasuk in Yirmiyahu uses the word kesef, which implies even a Perutah, as even a Perutah is called kesef. However, R. Chanina refers to the word shekalim, which means selaim.

התיבון הרי האונס הרי אין כתיב בו אלא כסף ואת אמר שקלים

(e)

Refutation: In the case of a rapist (who raped an unmarried na'arah), the Torah used the word kesef (without the word shekalim) (see Devarim 22, 29) and he does pay 50 shekalim (selaim)? (We see that the word kesef and the word shekalim are interchangeable.)

ACQUIRING A FIELD THROUGH CHAZAKAH (Yerushalmi Halachah 3 Daf 12a)

ודלא כרבי לעזר דרבי לעזר אמר הילך קנה

(a)

We learned earlier that a field is acquired through chazakah (an act of taking possession e.g. he fixed something in the field, locked the gate or built or broke down the fence). This is unlike R. Eliezer who said that if the buyer merely walked in the field, he acquired it...

דתני הילך בשדה לאורכה ולרחבה קנה עד מקום שהילך דברי ר' אליעזר

1.

Beraisa (R. Eliezer): If he walked the length and breadth of the field, he acquires as far as he walked.

וחכמים אומרים לא קנה עד שעה שיחזיק

2.

Chachamim: He only acquired when he makes a chazakah (but merely walking does not suffice).

הכל מודין במוכר שביל לחבירו כיון שהילך בו קנייו

3.

All agree that if he sold a path to his friend, if he merely walked there, he acquires it.

מה טעמא (בראשית יג) קום התהלך בארץ לאורכה ולרחבה כי לך אתננה

What is R. Eliezer's source for this? The pasuk states (Bereishis 13, 17), "Get up and walk in the land across its length and breadth, as I will give it to you''.

COMPARING SLAVES TO FIELDS (Yerushalmi Halachah 3 Daf 12a)

אית מתניתין אמר עבדים כקרקעות אית מתניתין אמר כמטלטלין אית מתניתין אמר לא כקרקעות ולא כמטלטלין

(a)

Some Mishnayos view slaves like fields, some view them like movables and some view them like neither.

מתני' אמר עבדים כקרקעות דתנינן תמן חזקת בתים בורות שיחין ומערות ומרחציות ושובכות בית הבדים [דף יב עמוד א (עוז והדר)] ובית השלחין ועבדים

Like fields (Mishnah): To establish a chazakah on houses, pits of all types, caves, bathhouses, dovecotes, olive presses, irrigated fields and slaves etc. (We find that slaves are categorized together with other land.)

אית מתני' אמרה עבדים אינן כמטלטלין דתני אי זהו חזקת עבדים נעל לו מנעלו והתיר לו מנעלו נטל לפניו למרחץ

Like movables (Mishnah): How does one make a chazakah on a slave? If the slave tied or untied the master's shoe or carried the master's items to the bathhouse. (These are acts of meshichah, the way of acquisition used for movables.)

ר''ש אומר אם הגביהו הרי זו חזקה הגביה הוא את רבו אין חזקה גדולה מזו

R. Shimon: If the master lifted him, it is a chazakah. If he lifted the master, there is no greater chazakah than that.

The following statement of Rabbanan shows that slaves are like movables...

דמר רבי יוסי בשם רבנין אין שיעבוד למתנה

R. Yosi citing Rabbanan: There is no automatic lean when a person gives a gift (meaning that the property of the giver is not on lean to the recipient, if for example, a creditor of the giver would seize the gift from the recipient).

אין גובין מן העבדים כקרקעות

Unlike with fields, a creditor cannot seize slaves from orphans if their father's debt was not paid.

(c)

Question (R. Mana to R. Simi): Who are the Rabbanan?

Answer (R. Simi): R. Yitzchak and R. Imi...

ארמלתא תפסת אמתא אתא עובדא קומי רבי יצחק אמר תפסת תפסת

Proof: A widow seized a slave woman as payment for her Kesubah. The case came before R. Yitzchak and he said that after the fact, she could keep the slave woman (although ideally she should not have done this, since slaves are considered to be movables).

ר' אימי מפיק מינה דהיא סברה דהיא דידה ולית היא דידה

R. Imi instructed that the slave woman should be taken away from her and explained that the widow had mistakenly thought that the slave woman was actually hers (and therefore, her seizing was not done as an act of chazakah).

[דף יב עמוד ב] ולא כקרקעות דתני קרקעות ועבדים החזיק בקרקעות [לא החזיק בעבדים] אם אומר את עבדים כקרקעות כיון שהחזיק בקרקעות החזיק בעבדים

(Continuing with the list in (a) above) Slaves are not like fields (Beraisa): One who buys fields and slaves, if he seized the fields, he has not seized the slaves. If you say that slaves are like fields, when he seized the fields, he had also seized the slaves.

דאמר רבי יסא בשם ר' יוחנן היו לו שתי שדות אחת ביהודה ואחת בגליל החזיק בזו שביהודה לזכות בזו שבגליל או בזו שבגליל לזכות בזו שביהודה קנה

Proof (R. Yasa citing R. Yochanan): If a person owned two fields, one in Yehuda and one in the Galil, a buyer could seize the one in Yehuda and also intend to acquire the one in the Galil, and vice-versa. (This proves that slaves must not be like fields.)

לא כמטלטלין אם אומר את עבדים כמטלטלין כיון שהחזיק בקרקע(ות) (א)[ה]חזיק בעבדים

Slaves are not like movables (from same Beraisa): If you say that slaves are like movables, when he seized the fields, he should have also acquired the slaves.

דתנינן תמן (שה)נכסין שאין להן אחריות [נקנין עם נכסים שיש להן אחריות ו]זוקקין את הנכסים שיש להן אחריות לישבע עליהן.

Proof (Mishnah further on): Movables are acquired together with fields and they cause a person to be required to make an oath over a field. (This will be explained later.)
