DO WE FEED A WOMAN WHOSE HUSBAND IS AWAY? (Yerushalmi Perek 13 Halachah 1 Daf 68a)

מעשה (בי ר' ישמעאל) [צ"ל בר' ישמעאל בר ר' יוסי - שערי תורת ארץ ישראל] שפסק מזונות לאשה בשוקי בציפורי (מה בשוקי - קרבן העדה מוחקו) שמע ר' ומר מאן אמר ליה שלא שילח לה מאן אמר ליה שלא הניח לה (עברין) [צ"ל עבדין - שערי תורת ארץ ישראל] ידעין

(a)

A case occurred with R. Yishmael b'Rebbi Yosi. He apportioned food for a woman (whose husband went overseas) in the markets of Tzipori. Rebbi heard, and said 'who told him that [her husband] did not send to [finance] her? Who told him that [her husband] did not leave [food in the house] for her? Is it common that this is known?! (We explained this like SHA'AREI TORAS ERETZ YISRAEL.)

ר' הילא אמר (רב בעי מסביר) [צ"ל ר' בא מסבר - קרבן העדה] סבר ר' דלית מתניתא באשת איש אלא באלמנה

(b)

(R. Heila citing R. Ba): Rebbi holds that our Mishnah does not discuss a married woman (we do not give to her even through a Shevu'ah). Rather, it is a widow (i.e. we heard that her husband died. She receives through a Shevu'ah.)

אמר שמואל ור' שמעון בן לקיש תריהון אמרין באלמנה היא מתניתא

(Shmuel and Reish Lakish): Our Mishnah discusses a widow.

אמר ר' אבין תני דבית ר' כן מי שיצא למדינת הים ואשתו תובעת מזונות הוון בעי מימר מאן דמר באשת איש היא מתניתא בתחילה שלא שילח לה בסוף שלא הטמינה ושלא הערימה

(R. Avin): The house of Rebbi taught like this. One who went overseas, and his wife demands food - they wanted to say that our Mishnah discusses a married woman. Initially [she swears] that he did not send [food] to her, and at the end (when she collects her Kesuvah, she swears) that she did not hide [property of her husband] and did not scheme (to sell more than she needs for food).

מאן דמר באלמנה היא מתניתא בתחילה שלא הניח לה בסוף שלא הטמינה ושלא הערימה

The one who says that our Mishnah discusses a widow, initially [she swears] that he did not leave [food] for her, and at the end [she swears] that she did not hide and did not scheme.

אמר שמואל אחוה דר' ברכיה בשלא מחלה ליתומים על כתובתה

(e)

(Shmuel, the brother of R. Berachiyah): [She is fed] when she did not pardon her Kesuvah to the orphans.

הרי שיצא הוא ואשתו למדינת הים ובאת ואמרה מת בעלי תזון ותטול כתובתה

(f)

If he and his wife went overseas, and she came and said 'my husband died', she is fed, and [when she wants] takes her Kesuvah (and ceases to be fed);

גירשני בעלי תזון מכתובתה מה נפשך

(g)

[If she came and said] 'my husband divorced me', she is fed from (i.e. until the value of) her Kesuvah, no matter what you will say!

אם היא אשת איש משל בעלה היא ניזונת אם אינה אשת איש מכתובתה היא ניזונת

If [she lied, and] she is married, she is fed. If she is not married, she is fed from her Kesuvah.

הרי משבא ממדינת הים ואשתו תובעת מזונות ואמר יצאו מעשה ידיה במזונותיה שומעין לו ואם פסקו בית דין מה שפסקו פסקו

If after he came from overseas, and his wife demands food, and he said 'let her eat from her earnings', we heed him. If Beis Din apportioned food for her, what they apportioned, they apportioned. (If she borrowed to eat, he must pay the creditor.)

ר' ירמיה אמר בשאין מעשה ידיה כדי מזונה

(h)

(R. Yirmeyah): [The Beraisa discusses] when her earnings do not suffice for her food. (Then, what they apportioned, they apportioned.)

כהדא שומעין לו

Question: Do we heed him in such a case?!

כמאן דמר אין מזונות לאשה מדבר תורה

Answer: This is like the opinion that feeding one's wife is not mid'Oraisa;

כהדא דתני אין בית דין פוסקין לאשה מזונות [דף סח עמוד ב] מדמי שביעית אבל ניזונת היא עם בעלה בשביעית

This is like a Beraisa teaches, Beis Din does not apportion food for a wife [whose husband is not here] from the money of Peros Shemitah (since he feeds her in exchange for her earnings, this is like paying a debt from Demei Shevi'is), but she is fed with her husband in Shevi'is.

ר' יוסי אומר בשיש מעשה ידיה כדי מזונות

(i)

(R. Yosi): [The Beraisa discusses] when her earnings suffice for her food.

כהדא מה שפסקו פסקו

1.

Question: In such a case, [do we say that] what they apportioned, they apportioned?! (She can feed herself!)

תיפתר בשפסקו יתר

2.

Answer: The case is, they apportioned extra (more than the minimum necessary).

הרי שהיה נתון במדינת הים ואמר יינתנו אילו לבניו בנותיו בכלל אם בשעת מיתה אמר יינתנו אילו לבניו אין בנותיו בכלל

(j)

If one was overseas, and said 'give these to my Banim (children)', his daughters are included. If at the time of death he said 'give these to my Banim', his daughters are not included.

ר' זעירא רב חננאל בשם רב ר' זעירא בשם אבא בר ירמיה שני דברים אמר חנן הלכה כיוצא בו שבעה דברים אמר אדמון אין הלכה כיוצא בו

(k)

(R. Ze'ira citing R. Chananel citing Rav, and R. Ze'ira citing Aba bar Yirmeyah): Chanan said two laws; the Halachah is like him. Admon said seven laws. The Halachah does not follow him.

ר' בא בר זבדא בשם רב יצחק בר חקולא בכל מקום ששנינו אמר רבן גמליאל רואה אני את דברי אדמון הלכה כיוצא בו:

(R. Ba bar Zavda citing R. Yitzchak bar Chakula): Wherever we learned "R. Shimon ben Gamliel says, I agree with Admon", the Halachah is like him. (We explained this like SHA'AREI TORAS ERETZ YISRAEL.)
