WHAT IS NEEDED TO COLLECT THE KESUVAH (Yerushalmi Perek 9 Halachah 9 Daf 56b)

מתני' הוציאה גט ואין עמו כתובתה גובה כתובתה

(a)

(Mishnah): If a woman shows a Get without a Kesuvah, she collects a Kesuvah.

הוציאה כתובה ואין עמה גט היא אומרת אבד גיטי והוא אומר אבד שוברי וכן בעל חוב שהוציא שטר חוב ואין עמו פרוזבול הרי אילו לא יפרעו

If she shows a Kesuvah without a Get and says that she lost her Get, and he says that (Beis Din tore her Get when he paid her Kesuvah, and) he lost his receipt, and similarly if a creditor shows a loan document (from before Shemitah) without a Pruzbul (a document showing that the loan was given over to Beis Din before Shemitah, which permits collecting it after Shemitah), they do not collect.

רבן שמעון בן גמליאל אומר [דף נז עמוד א] מן הסכנה ואילך אשה גובה בלא גט ובעל חוב גובה שלא בפרוזבול:

R. Shimon ben Gamliel says, from the time of danger (decrees against keeping Mitzvos) and onwards (we destroy a Get after it is given and a Pruzbul after it is written), a woman collects her Kesuvah without a Get, and a creditor collects his debt without a Pruzbul.

גמ' רבי חייה בשם רבי יוחנן הקורא ערר על מעשה בית דין לא הכל הימינו

(Gemara - R. Chiyah citing R. Yochanan): One who claims against an act of Beis Din (he says that he paid without witnesses), he is not believed.

אמר ליה רבי חייה בר אבא ולא מתניתא היא הוציאה גט ואין עמו כתובה גובה כתובתה

Question (R. Chiya bar Aba): Does not our Mishnah teach this? If a woman shows a Get without a Kesuvah, she collects a Kesuvah.

אמר ליה רבי יוחנן בבלייא מן דגלית לך חספא מן מרגליתא את אמר לי ולא מתניתא היא

Answer (R. Yochanan): Babylonian! After I revealed for you the earthenware from [covering] the pearl (I taught you why she collects a Kesuvah), you tell me, does not our Mishnah teach this?!

רב אמר במקום שאין כותבין שטר כתובה אבל במקום שכותבין שטר כתובה מה דהיא מפקה היא גובה

(Rav): [Our Mishnah] discusses a place where they do not write a Kesuvah document, but in a place where they write a Kesuvah document, what she shows, she collects.

חזר ואמר אפילו במקום שכותבין כתובה גובה היא מן רב חיילה מתבה יתיב

Retraction (Rav): Even in a place where they write a Kesuvah document, she collects [even without a Kesuvah]. One who has great strength [Chachmah] to challenge this, let him challenge!

התיב רבי יוסי והא תני גובה גיטה ומטמנת כתובתה וחוזרת וגובה

(i)

Question (R. Yosi): It was taught that she collects [her Kesuvah] through her Get [alone. If it is in a place where they write a Kesuvah,] she can hide her Kesuvah, and go back and collect again [after her husband dies]!

אין שם בית דין

Answer: Is there no Beis Din there?! (He can pay her in front of Beis Din, and he will have proof that he paid!)

באינון דמתון

Question: If [she is in a place where there is no Beis Din, like] Maton [the concern returns]!

ואין שם עדים

Answer: Are there no witnesses there?! (He can pay her in front of witnesses.)

הבו בשהלכו להם למדינת הים

Question: If the witnesses went overseas [the concern returns]!

Answer: Is there no receipt?!

ולית רב אומולוגייא

Question: Rav holds that we do not write a receipt!

(אית רב) [צ"ל לית ליה לרב - גליון אפרים] אומולוגייא כהן דמר אבד כרטיסן עבד חורן אית ליה כההיא דאמר אי אבד פורנא עבד חורין

Answer: Rav does not hold that we write a receipt, like the case of one who says 'I lost my document; write another for me' [and I will write for you a receipt that you did so. We do not, for he should have been careful with his document. Here,] he holds [that we write a receipt], like it was said, if the Kesuvah was lost, they make another Kesuvah (for one may not be with his wife without a Kesuvah. We explained this like GILYON EFRAYIM and R. MEIR SIMCHAH.)

התיב רבי בא דהא תני גובה בגיטה ומטמנת כתובתה וממתנת עד שימות וחוזרת וגובה

Question (R. Ba): It was taught that she collects [her Kesuvah] through her Get [alone. If it is in a place where they write a Kesuvah,] she can hide her Kesuvah, wait until he dies, and go back and collect again!

אמר ליה רבי יוסה בי רבי בון ולא עליה להביא ראייה שהיתה משמשתו עד שמת

Answer (R. Yosi bei R. Bun): Does she not need to bring a proof that she served (was married to) him until he died?!

רבי זעירא רבי אבונה בשם רב במקום שכותבין שטר כתובה הוא אומר כתבתי והיא אומרת לא כתבת עליה להביא ראייה שלא כתב

(R. Ze'ira citing R. Avunah citing Rav): In a place where they write a Kesuvah document, if he says 'I wrote', and she says 'you did not write', she needs to bring a proof that he did not write;

ובמקום שאין כותבין שטר כתובה והוא אומר כתבתי והיא אומרת לא כתבת עליו להביא ראייה שכתב

In a place where they do not write a Kesuvah document, if he says 'I wrote', and she says 'you did not write', he needs to bring a proof that he wrote;

ר' חייה בר אבא אשכח פרוזבלא דרבי יונתן והוה (פרי מיתן) [צ"ל פרימיתן - קרבן העדה] ליה אמר ליה לית אנא צריך ליה

R. Chiya bar Aba found a Pruzbul of R. Yonason; there were tears in it. [R. Yonason] said to him, I do not need it.

ותני כן נאמן (המלוה) [צ"ל לוה - שדה יהושע] לומר שטר זה פרעתיו וקרעתיו

Support #1 (Beraisa): A borrower is believed to say 'this document, I paid it and tore it' (and the lender found the torn pieces).

Support #2 (R. Yirmeyah citing R. Chiyah - Mishnah): From the time of danger and onwards, a woman collects her Kesuvah without a Get, and a creditor collects his debt without a Pruzbul.

ואיפשר כן (לא פרעתיו וקרעתיו והכא פרעתיו) [צ"ל אלא קבלתיו וקרעתיו והכא כתבתיו - שערי תורת ארץ ישראל] וקרעתיו

Is it possible [that she collects even if she never received a Get]?! No, [rather, she says] 'I received it, and I tore it.' And here, he says 'I wrote [a Pruzbul], and I tore it.' (We explained this like SHA'AREI TORAS ERETZ YISRAEL.)

Note: Perhaps the one who brought the proof from the Beraisa did not hold that the Halachah always follows R. Shimon ben Gamliel in Mishnayos (with only three exceptions), or he was unsure if his law applies even after the danger passed.

WHEN IS A PREVIOUS KESUVAH VALID? (Yerushalmi Perek 9 Halachah 10 Daf 57b)

[דף נז עמוד ב] מתני' שני גיטין ושני כתובות גובה ב' כתובות

(a)

(Mishnah): If a woman has two Gitin and two Kesuvos, she collects two Kesuvos. (The date of the first Get is in between the dates on the Kesuvos.)

ב' כתובות וגט או כתובה ושני גיטין או כתובה וגט ומיתה אינה גובה אלא כתובה אחת שהמגרש את אשתו ומחזירה על מנת כתובתה הראשונה החזירה

(b)

If she has two Kesuvos and one Get (dated after both of them), or one Kesuvah and two Gitin, or one Kesuvah and one Get and witnesses to her husband's death, she collects only one Kesuvah. This is because one who remarries his ex-wife does so on condition that she will receive only her original Kesuvah.

קטן שהשיאו אביו כתובתה קיימת שעל מנת כן קיימה

(c)

If a minor's father married him off [and they remained together when he matured], her Kesuvah is valid, for on this condition he kept her.

גר שנתגייר ואשתו עמו כתובתה קיימת שע"מ כן קיימה:

(d)

If a Nochri converted and his wife [converted] with him, her Kesuvah is valid, for on this condition he kept her.

גמ' והוא שיהא הגט יוצא מכתובה לכתובה

(e)

(Gemara): (Our Mishnah says that if she has two Gitin and two Kesuvos, she collects two Kesuvos.) This is when the [date of the first] Get is in between [the dates on] one Kesuvah and the other Kesuvah.

עד כדון בשוות היה בזו מנה ובזו מאתים

Question: This is if the Kesuvos were equal. If one was 100 and one was 200 [what is the law]?

רב הונא ורב ירמיה ורב חסדא חד אמר גובה בראשונה וחרנה אמר גובה בשנייה [צ"ל וחרנה אמר מנה גובה מזמן הראשונה - קרבן העדה] והתוספת גובה מן זמנה של שנייה

Answer: Rav Huna, Rav Yirmeyah and Rav Chisda [argued about this]. One said that she collects the first [Kesuvah], another said that she collects the second, and the other said that she collects 100 from the date of the first [Kesuvah] and the addition from the date of the second.

אמר רבי חנניה קומי רבי מנא לית הדא אמרה ההן דיזיף מן חבריה וחזר ויזיף מיניה צריך מימר לבד מן כרטוסה קדמייא דאית לי גבך

(h)

Inference (R. Chananyah, to R. Mana): Does [our Mishnah] not teach that one who borrows from his friend, and returned and borrowed from him, he must say [write in the second document] 'aside from the first document that I have against you'?

אורחא דאיתתא מימר אבד פורנה עביד חורן אלא כי אורחא דבר נשא מימר אבד כרטיסו עבד חורן

(i)

Rebuttal (R. Mana): It is normal for a woman to say 'the Kesuvah was lost; make (write) another [Kesuvah, for one may not be with his wife without a Kesuvah]. Is it normal for a person to say 'I lost my document; write another for me'?! (Surely it is not. If the borrower is proper, he will admit verbally, but not write another document.)

(אלא כי) [צ"ל בכל זה - ריטב"א, בשט"מ מד:א] אפשר יודי ליה

Remark: Even so, it is possible that [R. Mana] agrees [to R. Chananyah that it is proper to write so, lest a Beis Din err and think that both documents are for the same loan. We explained this like the RITVA.]

ר' יודן בר שיקלי אעיל עובדא קומי רבי יוסי לא כן אמר ר' אבהו בשם ר' יוחנן שטר שלווה בו ופרעו אל ילוה בו באותו היום

(k)

Question (R. Yudan bar Shikli, to R. Yosi): (Our Mishnah says that if she has two Gitin and one Kesuvah, she collects one Kesuvah.) Didn't R. Avahu say in the name of R. Yochanan that a document that one borrowed with and paid it, he may not borrow [another loan] with it [even] on the same day?! (Even though it is not predated, the lien that the document creates was pardoned; it cannot create another lien. She should not collect at all!)

Note: Surely, the date of the Kesuvah precedes both Gitin. If not, obviously it was written for the latter marriage! Surely he is not believed to say that he paid her first Kesuvah, and did not tear the Get or Kesuvah, and has no receipt or witnesses of payment. Rather, he agrees that he remarried her, on condition that the first Kesuvah document is her Kesuvah. Even if we learn from R. Yochanan that the document is invalid, this is like admission that he did not write a valid Kesuvah for the second marriage, and he is obligated even in a place where they write a Kesuvah! Perhaps R. Yudan asks why the Mishnah says Stam that she collects, which implies that she collects like a regular Kesuvah, even from buyers. Since she does not have a valid document, she cannot take from buyers!

א"ל כאן בשפרעו כאן בשלא פרעו

Answer (R. Yosi): Here [R. Yochanan] discusses when he paid [the debt]. Here [our Mishnah] discusses when he did not pay.
