A FINE FOR A DIVORCEE FROM EIRUSIN (Yerushalmi Perek 3 Halachah 4 Daf 19a)

מתני' נערה שנתארסה או שנתגרשה רבי יוסי הגלילי אומר אין לה קנס

(a)

(Mishnah - R. Yosi ha'Glili): If a Na'arah was divorced from Eirusin, she does not receive a fine;

רבי עקיבה אומר יש לה קנס וקנסה של עצמה:

R. Akiva says, she has a fine, and it is hers (not her father's).

גמ' מאי טעמא דרבי יוסי הגלילי

(Gemara) Question: What is the reason of R. Yosi ha'Glili?

[דברים כב כח] אשר לא אורשה [צ"ל הא אורשה אין לה קנס - קרבן העדה]

Answer: "Asher Lo Orasah" - this implies that if she was engaged [even if she was widowed or divorced], she has no fine.

[ורבי עקיבא אשר לא אורשה] עד שלא נתארסה נותן לאביה נתארסה נותן לעצמה

R. Akiva says, "Asher Lo Orasah" distinguishes - before she was engaged, he gives [the fine] to her father. If she was engaged [and widowed or divorced], he gives to her.

על דעתיה (דרבי יוסי הגלילי) דר"ע נערה נותן לאביה בוגרת נותן לעצמה בתולה נותן לאביה מוכת עץ נותן לעצמה

Question: According to R. Akiva, we should say that [Na'arah does not totally exclude a Bogeres. Rather,] a Na'arah, he gives to her father. A Bogeres, he gives to her! A Besulah, he gives to her father. A Mukas Etz, he gives to her!

שנייא היא דכתיב נערה נערה ולא בוגרת בתולה בתולה ולא מוכת עץ

Answer: There is different, for it says "Na'arah" - a Na'arah, and not a Bogeres. "Besulah" - a Besulah, and not a Mukas Etz.

לית כתיב אשר לא אורסה

Question: Is it not written "Asher Lo Orasah" (to exclude if she was Mekudeshes)?!

אשר לא אורסה מלמד הימינה לגזירה שוה מה תמן חמשין אף הכא חמשין

Answer: "Asher Lo Orasah" teaches through a Gezeirah Shavah. Just like there (rape, he pays) 50, also here (Mefateh) he pays 50.

ולית ליה לרבי יוסי חמשין

Question: Does R. Yosi ha'Gelili not have [a source that the fine for rape is] 50?!

אית ליה כסף כסף מה כסף שנאמר להלן חמשין אף כאן חמשין

Answer: He learns from a Gezeirah Shavah "Kesef-Kesef". Just like Kesef said below (rape) is 50, also here (Mefateh) it is 50.

בא עליה עד שלא נתארסה ונתארסה (ונתגרשה) לית מילתא דרבי אחי אמרה שהוא נותן

If he had Bi'ah with her before she became Mekudeshes, and she became Mekudeshes - do we not learn from R. Achi that he pays?!

והתני [שם כט] תחת אשר עינה לרבות את היתומה לקנס דברי ר"י הגלילי

(Beraisa): "Tachas Asher Inah" includes an orphan for a fine. R. Yosi ha'Gelili says so.

א"ר אחי תיפתר שבא עליה עד שלא מת אביה ומת אביה כבר נראה ליתן לאביה

(R. Achi): The case is, he had Bi'ah with her before her father died, and her father died. It was already proper to give to her father [so he is not exempted when her father died];

הוא בא עליה עד שלא מת אביה ומת אביה והוא בא עליה עד שלא נתארסה ונתארסה

When he had Bi'ah with her before her father died, and her father died, this is the same as when he had Bi'ah with her before she became Mekudeshes, and she became Mekudeshes (he pays).

רבי זעירא אמר רב חסדא בעא בא עליה עד שלא נישאת ונישאת

Question (R. Ze'ira citing Rav Chisda): If he had Bi'ah with her before she had Nisu'in, and she had Nisu'in [what is the law]?

(ממה) [צ"ל כמה - שערי תורת ארץ ישראל] דתימר תמן תחת בעלה היא הוא נותן לאביה וכא תחת בעלה היא הוא נותן לאביה:

Answer: Just like you say there (Motzi Shem Ra) she is under her husband (Nesu'ah), and [even so] he pays her father, also here (when she had Nisu'in after Bi'ah, now) she has a husband, and he pays her father [even though she totally left his Reshus. We explained this like SEFER NIR, NO'AM YERUSHALMI, SHA'AREI TORAS ERETZ YISRAEL.]

Note: It is hard to explain that 'there' refers to the above case (Ones or Mefateh, and later she became Mekudeshes), for an Arusah is not 'under' her husband, i.e. in his Reshus, for any monetary law, just he can annul her vows together with her father. How can we learn to a Nesu'ah, who totally left her father's Reshus?! (based on NO'AM YERUSHALMI)
