DAF DISCUSSIONS - KESUVOS 72

Yeshayahu HaKohen Hollander asked:

In the Mishna on Ktuvot 72b - is there a financial difference between "the betrothal is invalid" and "without Ketuva"?

The Kollel replies:

"Einah MeKudeshes" does not require a Get. Financially, there is a Machlokes in the Gemara whether she must return the Kesef Kidushin.

Yeshayahu HaKohen Hollander comments:

I think the more complete answer is in the beraita on Ketuvot 101a:

"she leaves without a Kesuvah" - means without the 200 or 100 granted by the rabbinical ordinance, but she DOES get the Tossefet which her husband promised her in the Ketubah!

Which of course she does NOT get if "the betrothal is invalid"

The Kollel replies:

The term "more complete" is tautological, and, in this case, incorrect. A Moredes or an Overes Al Das about whom it also says "Yotzi B'lo Kesuvah" does not get the Tosefes.
