ONE WHO FOUND DOCUMENTS FROM BEIS DIN (Yerushalmi Halachah 8 Daf 5b)

משנה מצא איגרות שום ואיגרות מזון ושטרי חליצה ומיאונין ושטרי בירורין וכל מעשה בית דין הרי זה יחזיר.

(a)

(Mishnah): If a person found letters of evaluation, or maintenance, chalitzah or miyun documents, documents of selection (of Dayanim by litigants) and any other document of Beis Din, he should return them.

מצא בחפיסה או בגלוסקמא תכריך של שטרות או אגודה של שטרות הרי זה יחזיר

(b)

If he found loan documents in a small leather bottle or in a large leather bag or he found a group of wrapped documents or a bundle of documents, he should return them (since they have identifying marks).

וכמה היא אגודה של שטרות שלשה קשורין זה בזה

Question: How many documents constitute a bundle? Three tied together.

רבן שמעון בן גמליאל אומר אחד לווה משלשה יחזיר ללוה שלשה לווין מאחד יחזיר למלוה

(d)

Rabban Shimon ben Gamliel: If there were three documents together of one borrower who borrowed from three people, they should be returned to the borrower. If there were three borrowers who borrowed from one lender, they should be returned to the lender.

מצא שטר בין שטרותיו ואין ידוע מה טיבו יהא מונח עד שיבא אליהו אם יש עמהן סימפון יעשה מה שבסימפון:

If he found a document amongst his documents and he did not remember whether he received the document from the lender or the borrower, it should stay with him until Eliyahu HaNavi comes to resolve the doubt. If there was a receipt together with them, he should follow the details written there.

גמרא רב ירמיה בשם רב אם היה אישר [דף ו עמוד א] הדיינין הרי זה יחזיר.

(Gemara - R. Yirmiyah citing Rav): If it had the stamp of approval of Beis Din, he can return it (as there is no concern that the money was never lent).

ר' חמא אבוי דרבי הושעיה אמר אשלי דיינין שבגליות גזלי דיינין שבארץ ישראל.

(g)

R. Chama father of R. Hoshiyah: The strongest of the Dayanim in the Diaspora is equivalent to the weakest of the Dayanim in Eretz Yisrael.

רב המנונא אמר נכתבה אונו באחד בניסן [דף ד עמוד ב (עוז והדר)] ניתן הכסף בעשרה בניסן צריכין לכתוב אע''פ שכתבנו כתב באחד בניסן כן נגמר שיתן הכסף בעשרה בניסן.

(h)

Rav Hamnuna: If a sale document was written on the 1st of Nisan but the money was given on the 10th, they must write, "Even though we wrote it on the 1st of Nisan, the money was given on the 10th''.

רב ירמיה בשם רב סימפון שיוצא מתחת ידי המלוה בכתב ידי המלוה פסול אני אומר מתעסק היה בשטרותיו. הא מתחת ידי אחר כשר.

(i)

R. Yirmiyah citing Rav: A receipt that comes from the hand of the lender and written by him is Pasul; as I say that it was prepared in advance of the loan actually being repaid. However, if it came from someone else's hand, it would be Kasher.

רבי יצחק בר נחמן בשם שמואל לעולם אין סימפון כשר עד שיצא מתחת ידי המלוה בכתב ידי הלוה.

(j)

R. Yitzchak bar Nachman citing Shmuel: A receipt is only Kasher if it came from the lender's hand, having been written by the borrower.

והתניא שלא פיקדנו אבא ושלא אמר לנו אבא ושלא מצינו שטר בין שטרותיו ששטר זה פרוע. הא אם נמצא פרוע. מאי כדון

Question against Rav Yirmiyah citing Rav (Mishnah in Maseches Shevuos): (If orphans came to collect payment of money owed to their father, they must swear that) "Our father did not deposit the money with us, nor did he tell us that it had been repaid, nor did we find a document amongst his documents stating that this document was already paid!'' This shows that if such a document was found, it can be relied upon. How can you answer this?

אמר ר' יוסי בי ר' בון תיפתר כגון הדא דייתיקי שאין אדם מצוי לפגם דייתיקן שלו:

Answer (R. Yosi bei R. Bun): A person would not write a note in his will stating that his borrower paid him back unless it had actually happened because he would not wish to make a change to his will by erasing it if it was not eventually paid.
