MOVING A LADDER & DESIGNATING BIRDS (Yerushalmi Halachah 4 Daf 5a)

(a)

(Mishnah): Beis Shamai prohibit moving a ladder from dovecote to dovecote, but permit tipping it from window to window. Beis Hillel permit it.

(b)

Beis Shamai prohibit taking a bird unless he shook it before Yom Tov. Beis Hillel permit (merely) standing and declaring, "I am taking this one and this one''.

(c)

(Gemara): Yehuda bar R. Chiya left the town to check his fields. They asked him the law pertaining to an attic ladder.

1.

Yehuda permitted it.

2.

When he came to his father, his father (R. Chiya) asked him, "Did a situation come to your hands (to rule upon)?''

3.

Yehuda replied: I permitted them to move an attic ladder.

4.

R. Chiya taught a Beraisa in public (as a response to his son's ruling) - Beis Hillel only permitted moving a dovecote ladder, but an attic ladder is prohibited.

(d)

Question: What is the difference between a dovecote and an attic ladder?

(e)

Answer #1 (R. Yaakov bar Acha): Concerning the dovecote ladder, it is permitted since he could not take the birds before Yom Tov (as they needed an extra day in the nest to grow stronger). However, concerning the attic ladder, he could have done his work with it before Yom Tov.

(f)

Answer #2 (R. Yosa bei R. Bun): Concerning a dovecote ladder, he can climb it on Yom Tov to take the birds (and everyone will know that it is needed for Yom Tov). Concerning an attic ladder, he cannot climb it on Yom Tov (as onlookers will think that he is taking it to plaster his roof).

(g)

(1st difference between these answers): Using a dovecote ladder to climb into his attic. (According to #2 it would be permitted as onlookers will assume he is taking it for a Yom Tov need; according to #1 it would be prohibited, as he should have done it before Yom Tov.)

(h)

(2nd difference): Using an attic ladder to climb up to a dovecote. (According to #1 it would be permitted, as he could not have done it before Yom Tov; according to #2 it would be prohibited because of the onlookers).
