REPLANTED PRODUCE (Yerushalmi Ma'asros Perek 5 Halachah 1 Daf 20b)

(Mishnah): If one uproots saplings in his property and plants elsewhere in his property, he is exempt (since they are not complete). If he bought them whilst they were still attached, he is exempt (as a sale only obligates completed produce). If he collected them to send to a friend, he is exempt.

(R. Elazar ben Azaria): If such produce is being sold in the marketplace, he is obligated.

If one uproots turnip or radish from his property and plants them in his own property - if replanted for their seeds they are obligated, since this uprooting is their completion.

Onions that took root (in earth) on an upper floor, (if they had become Tamei) they become Tahor. If a building fell down on them (on the upper floor) but the leaves are uncovered, they are considered planted.

(Gemara) (R. Abahu citing R. Shimon ben Lakish): The Mishnah taught that if one uproots saplings in his property and plants elsewhere...This is the opinion of R. Akiva, as the Mishnah (in Maseches Peah 1:6) teaches - He may take from the threshing floor and use it as seed and be exempt from tithing until he smooths the pile - these are the words of Rabbi Akiva.

(R. Chiya citing R. Yochanan): (Disagreeing) The Mishnah follows all opinions. The Chachamim agree with R. Akiva about saplings.

What's the difference between wheat and saplings? The wheat is complete; the saplings are not complete.

And R. Akiva agrees with the Chachamim about (the Mishnah's case of) turnip and radish (that they are obligated) since they deteriorate when they are replanted.

Answer: Wheat has another threshing floor (so they have not avoided being tithed) but these do not.

(R. Simi to R. Yosi, citing R. Acha): Rav was discussing when he brought it into a protected courtyard, like the opinion of R. Meir (earlier, in the 2nd Perek, that an acquisition and also a protected courtyard establish an obligation to tithe, even for produce which is not yet complete).

Support (R. Mana): (A Baraisa supports this idea that the Mishnah is like R. Meir) 'If he bought produce attached to the ground it is exempt.' However, had he bought it detached, it would become obligated (through the acquisition even though it wasn't complete). Who has this opinion? R. Meir.

(R. Chiya citing R. Yochanan): (The Mishnah taught from R. Elazar ben Azaria that if such produce is being sold in the marketplace, he is obligated.) This follows R. Yehuda's opinion in the (following) Tosefta (in Ma'asros 3:9) - R. Yehuda says from R. Elazar ben Azaria - even if one sends his friend olives from the Ma'atan (vat where the olives are left to soften and warm), shoots and bundles of fenugreek, the recipient shouldn't eat them until he tithes as people send Tevel of these types to their friends.

(R. Shimon ben Lakish): Even if a Chaver sent to another Chaver, he must tithe.
