(SUMMARY: Tosfos discusses what we infer from the ruling like R. Aba's teachings.)

לרבא דהוי שלישי בראשון כשר כדפי' בקונטרס (הגהת הב"ח) דלא ממעט הלכתא מילתא דרבא

Explanation #1: [R. Aba could agree] to Rava that a third generation with a first generation (his grandfather's brother) is Kosher, like the Rashbam explained. The ruling [like R. Aba] does not exclude Rava's teaching;

ואי לאפוקי מדשמואל ורב ששת ודרב פפא הא איתותבו

[We cannot say that Mar Zutra rules like R. Aba] to teach unlike Shmuel, Rav Sheshes and Rav Papa, for they were [already] refuted!

אבל ר' אבא דשלח לרב יוסף בר (הגהת הב"ח) חמא לא איתותב

However, what R. Aba sent to Rav Yosef bar Chama was not refuted.

Implied question: [R. Aba] mentioned testimony about land. This connotes that [testimony about] a loan is Kosher, even if [the witness] became blind. The Beraisa disqualifies [one who became blind] for all testimony!

מצינן למימר דהוא הדין בהלואה דפסיל רבי אבא וקרקע סבירא ליה דמכוין בטוב כדשמואל והוי כהלואה ואפ''ה פסיל ליה

Answer: We can say that also for a loan, R. Aba disqualifies him. [He mentioned land] because he holds that he can be precise [to specify which land it is, even though he cannot see it], like Shmuel, and it is like a loan (for which a witness need not identify anything now), and even so [R. Aba] disqualifies him.

Pesak (R. Tam, in Sefer ha'Yashar): A third generation with a first is Pasul.

Explanation #2 (R. Tam): [The Gemara asks] what does [Mar Zutra rule like R. Aba to] teach unlike it? If it is to argue with Rava, [Rava] adds to R. Aba's words [so we cannot infer unlike Rava];

ואי אתא למפסק דדוקא שלישי בשני כשר ולא שלישי בראשון א''כ הוה ליה למימר אין הלכה כרבא

If he comes to rule that only a third [generation] with a second is Kosher, if so, he should have said "the Halachah does not follow Rava"!

ואי לאפוקי ממר בר רב אשי כלומר הא דלא קאמר אין הלכה כרבא אלא הלכתא כרבי אבא משום שרוצה לכלול בהדיא דאין הלכה כמר בר רב אשי

Suggestion: He comes to rule unlike Mar bar Rav Ashi. I.e. he did not say "the Halachah does not follow Rava", rather, the Halachah follows R. Aba, because he wants to include explicitly that the Halachah does not follow Mar bar Rav Ashi [who is Machshir even more than Rava].

הא לית הלכתא כו'

Rejection: [We already explicitly ruled that] the Halachah does not follow [Mar bar Rav Ashi].

ואי משום שמואל ורב ששת ורב פפא אצטריך ליה למימר דהלכה כרבי אבא שעתה ממעט כולהו ביחד

Suggestion: He needed to say that the Halachah follows R. Aba due to the opinions of Shmuel, Rav Sheshes and Rav Papa. He teaches unlike all of them at once.

[The Gemara asks that] he should have said explicitly "the Halachah does not follow Rava" if he comes to teach only unlike Rava!

[It answers that] rather, he teaches unlike R. Yochanan. Now, he could not say "the Halachah does not follow Rava", and he needed to say "the Halachah follows R. Aba", which excludes all of them, and excludes also Rava. Only a third [generation] with a second is Kosher.

וקשה לר''י דאי דייקינן ממילתיה דרבי אבא דוקא שלישי בשני א''כ נידוק נמי דדוקא עדות קרקע ובהלואה כשר ובברייתא פוסל הכל

Question (Ri): If we infer from R. Aba's words only a third with a second, if so we should infer also only testimony about land, but for a loan, it is Kosher [even if now he is blind]. The Beraisa disqualifies [him for] all [testimony]!

Explanation (R. Tam): The reason he said "like the time of Dibur, the time for a Talmid to greet his Rebbi, i.e. "Shalom Alecha Rebbi"...

לפי שכשאדם עושה סחורה עם חבירו ויראה רבו או גדול הימנו בחכמה לא יתן לו שלום שאם יתן לו שלום לא יוכל לחזור בו ממקחו

This is because when a person does business with his friend, and he sees his Rebbi or someone greater than himself in Chachmah, he will not greet him, for if he greets him, he cannot retract from his sale;

לכך תקנו חכמים שכשיעור זה יכול לחזור

Therefore, Chachamim enacted that in this amount of time, he can retract.

וקשה לר''י בפ' בתרא דנדרים (דף פז.) תניא מי שיש לו חולה בתוך ביתו ונתעלף כמדומה לו שמת וקרע ואח''כ מת לא יצא ידי קריעה

Question (Ri): In Nedarim (87a), a Beraisa teaches that if there was a sick person in the house, and he fainted, and it seemed [to his relative Ploni] that he died, and [Ploni] tore [his garment], and afterwards he died, [Ploni] did not find the Mitzvah of Keri'ah;

ואמר ר''ש בן פזי אמר ר''ש בן לוי לא שנו אלא אחר כדי דבור אבל תוך כדי דבור אינו חוזר וקורע והתם לא שייך האי טעמא

R. Shimon ben Pazi said in the name of R. Shimon ben Levi "this is only if [he died] after Kedei Dibur, but Toch Kedei Dibur, he need not tear again." This reason [of R. Tam] does not apply there!

Answer: Rabanan did not distinguish. (They said that Toch Kedei Dibur is k'Dibur, even when the reason does not apply, except for the exceptions listed.)

Explanation #1 (Rashbam): If he was Matfis or designated something for idolatry, and Toch Kedei Dibur he retracted, even so it is forbidden.

ואין נראה לר''י דהתפסה לא שייכא בעבודת כוכבים דאמרי' בפ' כל הצלמים (ע''ז דף מד:) האומר בית זה לעבודת כוכבים לא אמר כלום שאין הקדש לעבודת כוכבים

Objection (Ri): Hatfasah (imbuing Heter with an existing Isur) does not apply to idolatry! We say in Avodah Zarah (44b) that if one said "this house is for idolatry", it has no effect, for there is no Hekdesh for idolatry;

ואמרינן נמי בפ' כל האסורין (תמורה כח: ושם) דאין מוקצה לעבודת כוכבים אלא שבע שנים שנא' (שופטים ו) ואת הפר השני שבע שנים ועד שימסרנו לכומרי עבודת (הגהת הב"ח) כוכבים ויאכילנה כרשיני עבודת כוכבים והתם לא שייך תוך כדי דבור

We say also in Temurah (28b) that there is no Muktzah (designation) for idolatry, only [after] seven years, for it says "v'Es ha'Par ha'Sheni Sheva Shanim", and until he hands it over to the priests of the idolatry and feeds it vetch of idolatry. There, Toch Kedei Dibur does not apply!

Defense: We can reject [the question from there, and say that] if he hands it over to the priests of the idolatry on condition that they fatten it for seven years, it is Muktzah, and even if he retracts Toch Kedei Dibur, it does not help.

Explanation #2 (Ri): The case of idolatry is that he said "you are my god", and retracted Toch Kedei Dibur. It does not help at all. Perhaps this is a Gezeiras ha'Kasuv.

Citation (Nedarim 87a): The Halachah is, Toch Kedei Dibur is like Dibur, except for one who serves idolatry, blasphemes, is Mekadesh or divorces. (Ran 87a DH v'Hilchesa - other matters are not so severe. One does them without total resolve. He intends that he can retract Toch Kedei Dibur. These are so severe that one does them only with total resolve, so he cannot retract even Toch Kedei Dibur.)

פירוש מגדף שאם גידף וחזר בו תוך כדי דבור לא מהני מידי

I.e. if he blasphemed and retracted Toch Kedei Dibur, it does not help at all.

וגמרא קיצר כאן משום דמגדף הוי בכלל עבודת כוכבים ומגרש בכלל מקדש כי טעם אחד להם:

Remark: The Gemara here was concise. Blasphemy is included in idolatry, and divorce is included in Kidushin, for the same reason applies to them.
