Gemara: Alternatively, he accepted two Neziros simultaneously.

כלומר דכה"ג חיילי תרוייהו שהרי אין אחת מהן קודמת לחברתה דנימא שלא תחול שניה אחריה.

Explanation: In such a case, both of them take effect, for no one of them is before the other, that we will say that the second does not take effect after it.

ר"ן ד"ה מתיב רב המנונא כו' אילימא דאמר הריני נזיר היום הריני נזיר למחר הא קרא בעיא

Gemara - Question (Rav Hamnuna): ... If you will say that he said "I am a Nazir today. I will be a Nazir tomorrow", would we need a verse?!

דודאי כיון דמתוסף יומא יתירא בשביל נזירות שניה וכל מה שמנה עד אותו יום בשביל נזירות ראשונה היה פשיטא שצריך למנות ל' יום שאין נזירות פחותה מל' יום.

Explanation: Surely, since an extra day is added due to the second Nezirus, and everything he counted until that day was for the first Nezirus, obviously he must count 30 days, for there is no Nezirus less than 30 days.

RAN DH Hacha b'Mai Askinan... [TRANSLATION: What is the case? He accepted two Neziros at once.]

Explanation: The verse comes to teach this.

Question: Why do we need a verse to teach this? This is obvious! It is like one who says "I am a Nazir for 60 days!"

י"ל אי לאו קרא ה"א שימנה ס' יום כאחד ויביא קרבן

Answer: If not for the verse, one might have thought that he counts 60 days at once, and brings a Korban;

ואתא קרא ואשמועינן דשתי נזירות חלוקין הוו ועל כל ל' מגלח ומביא קרבן זהו פי' שמועה זו על נכון,

The verse teaches that they are two separate Neziros, and for each he shaves and brings a Korban. This is the proper Perush of this Sugya.

וראיתי לקצת מפרשים שנדחקו להעמידה לומר דכי תנן יש נדר בתוך נדר לחייבו ב' על אכילה אחת קאמר שאף בענין זה חמור נדר משבועה

Explanation #2: I saw some Meforshim who struggled to establish the Mishnah "there is a Neder b'Soch Neder" to obligate twice for one eating. Also regarding this, Neder is more stringent than Shevu'ah;

Note: Until now, the Ran explained the entire Sugya based on his Perush (17a, DH v'Chayav) that 'he is liable for each' means that he must conduct Nezirus for each acceptance.

שהאומר קונם עלי ככר זה קונם עלי ככר זה חייב ב' ומי שנשבע ב' פעמים שלא יאכל ככר אחד ואכלו אינו חייב אלא אחת

If one said "Konam Alai this loaf. Konam Alai this loaf" [and ate it], he is liable twice, whereas one who swore twice not to eat one loaf, and ate it, he is liable only once.

ורב הונא ה"ק דדוקא באומר הריני נזיר היום הריני נזיר למחר הוא דחייב שתים על אכילה אחת משום דס"ל שנדר חל על נדר לחייבו שתים בכולל

Rav Huna means as follows. Only when he says "I am a Nazir today. I am a Nazir tomorrow", he is liable twice for one eating, for he holds that a Neder takes effect on a Neder, to be liable twice through Kolel (the latter Neder forbids also something that the first did not forbid);

מה שאין כן בשבועה דאפילו בכולל לא חיילא

This is unlike Shevu'ah. Even through Kolel, [the second Shevu'ah] does not take effect;

אבל בלא כולל אפילו בנדרים אין נדר חל על נדר

However, without Kolel, even regarding Nedarim, a Neder does not take effect on a Neder.

והשמועה עולה לפירוש זה בקושי ודוחק דא"כ למה ליה לתנא דמתניתין למתנייה האי דינא בנזירות לתנייה בנדרים

Rebuttal #1: The Sugya is difficult according to this. If so, why did the Tana of our Mishnah teach this law regarding Nezirus? He should teach it about Nedarim!

ועוד דהיכי הוה ס"ד לאוקמי הא דמי שנזר שתי נזירות וכו' באומר הריני נזיר היום הריני נזיר היום (הגהות ישנות)

Rebuttal #2: What was the Hava Amina to establish the case of one who accepted two Neziros to be that he says "I am a Nazir today. I am a Nazir today"?

דא"כ מאי מנה את הראשונה והלא כשמנה את הראשונה מנה גם את השניה דשניהם מנין אחד להם אלא שהוא חייב כשעובר על נזירותו שתים

If so, what does it mean "he counted the first one"? When he counted the first, he counted also the second, for they are the same count, just he is liable twice when he transgresses his Nezirus!

ועוד מאי עלתה לו שניה בראשונה והרי אין השניה חלה אלא לענין שאם אכל ענבים בתוך ימי נזירותו חייב שתים ולמה הוא צריך שתעלה לו

Rebuttal #3: What does it mean "he fulfills the second through the first"? The second takes effect only so that if he ate grapes during the days of Nezirus, he is liable twice. Why must [the first] count for him [to fulfill the second]?

Rebuttal #4: We say in the other refutation [from the Beraisa "Nazir Lehazir"] 'if he said "I am a Nazir today. I am a Nazir tomorrow", would we need a verse?!'

What was difficult? Indeed, we need a verse to obligate him twice via Kolel, for in such a case of Shevu'os, he is liable only once!

Conclusion: Surely, Explanation #1 (17a, DH v'Chayav; 'he is liable for each' obligates conducting Nezirus for each acceptance) is primary.

Ruling: Just like a Shevu'ah does not take effect on a Shevu'ah to obligate him twice, a Neder does not take effect on a Neder;

ואם אמר קונם עלי ככר זה קונם עלי ככר זה אינו חייב אלא אחת דכי תנא יש נדר בתוך נדר דוקא למנות שתי נזירות הוא דאמרינן כדכתיבנא

If he said "Konam Alai this loaf. Konam Alai this loaf", he is liable only once. The Tana taught there is Neder b'Soch Neder only to count two Neziros, like I wrote (in the previous Dibur).

Ruling: However, regarding this Nedarim are preferable to Shevu'os. Nedarim take effect on Shevu'os, but Shevu'os do not take effect on Nedarim;

כיצד נשבע שיאכל ככר זה ואח"כ אסרו עליו בקונם אסור לאכלו

What is the case? If one swore that he will eat this loaf, and afterwards forbade it through Konam, he may not eat it;

This is like we said above, if one said "Konam Sukah that I will not make, or Lulav that I will not take", it is forbidden;

Surely, just like a Neder takes effect on a Devar Mitzvah, it takes effect also on a Shevu'ah, for Mitzvos and Shevu'os are both Isurei Gavra (on the person), and the Isur Cheftza (on an object) of Nedarim takes effect on them, to be Mevatel them passively.

ואפשר ג"כ שכשם שהנדר חל על השבועה לבטלה כך הוא חל לקיימה

It is also possible that just like a Neder takes effect on a Shevu'ah to be Mevatel it, so it takes effect on it to fulfill it;

שהנשבע שלא יאכל ככר זו וחזר ואסרו עליו בקונם ואכלו חייב שתים

If one swore that he will not eat this loaf, and afterwards forbade it through Konam, and ate it, he is liable twice.

וכן בדין אם לבטל הן חלין לקיים לא כל שכן

Support: This is reasonable. If they take effect to be Mevatel, all the more so they take effect to fulfill!

This is due to the very reason that I wrote, that Shevu'os are only Isur Gavra. When he said Konam, this adds an Isur Cheftza.

If one forbade a loaf to himself [via a Neder], and afterwards swore that he will eat it, obviously he may not eat it. Similarly, if he swore that he will not eat it, and he ate it, he transgresses only Bal Yachel.

וליכא למימר דכי היכי דאיסור חפצא דנדרים חייל אאיסור גברא דשבועות ה"נ איסור גברא דשבועות ליחול אאיסור חפצא דנדרים

Implied Suggestion: Just like the Isur Cheftza of Nedarim takes effect on the Isur Gavra of Shevu'os, the Isur Gavra of Shevu'os should take effect on the Isur Cheftza of Nedarim!

משום דבנדרים כי היכי דאית בהו איסור חפצא איסור גברא נמי אית בהו שהרי מכיון שנאסר עליו קאי עליה בלא יחל דברו

Rejection: Just like Nedarim have an Isur Cheftza, they also have an Isur Gavra, for since it is forbidden to himself, "Lo Yachel Devaro" applies to him;

והאי לאו איסור גברא הוא ככל לא תעשה שבתורה הלכך אין מקום לשבועה שתחול על הנדרים

This Lav ("Lo Yachel") is an Isur Gavra, like every Lav in the Torah. Therefore, there is no place for a Shevu'ah to take effect on a Neder.

Support - Citation (Yerushalmi in Nedarim): Regarding one loaf, once he mentioned a Shevu'ah about it (that he will not eat it), he made it like a Neveilah;

Citation (cont.): From now and onwards, [swearing about it] is like Shevu'os about Isurim, and Shevu'os do not take effect on Isurim.

Note: A Beraisa there discussed whether Isar (mentioned in the Torah - "Lesor Isar") is a kind of Shevu'ah. Perhaps R. Yudan teaches that if Isar is not Min Shevu'ah (rather, Min Neder), Shevu'os do not take effect on Isar only if the Isar (Neder) was first, but if the Shevu'ah was first, Isar (Neder) takes effect on it. Perhaps here is different, for at the time he accepted Nezirus, both of them took effect. Therefore, when he asks [and permits] the first, he fulfilled the second through the first [Nezirus that he observed];

Distinction: However, regarding Shevu'os, at the time he swore, the second Shevu'ah did not take effect...

Explanation: We hold like Rava, for granted, his support was rejected, but his teaching was not rejected.

ומתני' דהכא ודשבועות כותיה דייקי

Support: The Mishnayos here and in Shevu'os, one may infer that they are like him.

דהתם בפרק שבועות שתים בתרא (שבועות כז:) נמי מסייעי לרבא ממתני' דשבועה שלא אוכל ככר זה וכו' וכדאיתא התם.

Also there, in Shevu'os 27b, we support Rava from the Mishnah 'Shevu'ah, I will not eat this loaf', like it says there.

THE RAN EXPLAINS THE MISHNAH

ר"ן ד"ה מתני'. סתם נדרים להחמיר ופירושם להקל

Mishnah: We are stringent about Stam Nedarim. If they are explained, we are lenient.

כלומר מי שנדר ויש לפרש לשונו להחמיר ולהקל כל שלא פירש אחר כן (גירסת כתב יד) למה נתכוין הולכין בסתמא להחמיר.

Explanation: If one vowed, and we can explain his expression stringently or leniently, as long as he did not explain afterwards what he intended, Stam we are stringent.

ר"ן ד"ה ופירושן להקל

(b)

Mishnah: And we are lenient about their Perushim.

אם פירש אח"כ ואמר לכך נתכונתי סומכין על דבריו אף על פי שהוא מיקל

Explanation: If he explained afterwards and said 'this is what I intended', we rely on his words, even though he is lenient.

וכולה מתני' עד נדר בחרם מפרש כיצד סתמן להחמיר ומנדר בחרם ואילך מפרש כיצד פירושן להקל.

Our entire Mishnah, until 'Nadar b'Cherem', explains how Stam we are stringent. From 'Nadar b'Cherem' and onwards explains how we are lenient based on the Perush.

Mishnah: What is the case? 'It is Alai like salted meat' or '[like] Yayin Nesech...'

כלומר כיצד קרוי סתם נדרים האומר כבשר מליח ויין נסך דמשמע של שמים וקרי ליה בשר מליח משום דכתיב על כל קרבנך תקריב מלח ומשמע נמי של עבודת כוכבים

Explanation: I.e. what is called Stam Nedarim? If one said "like salted meat" or "[like] Yayin Nesech", which implies of Shamayim. It is called salted meat, for it says "Al Korbancha Takriv Melach", but it also implies of idolatry;

כה"ג הוי סתם נדרים דהא אם פירש של שמים אסור ואם פירש של עבודת כוכבים מותר

Such a case is Stam Nedarim, for if he specified of Shamayim it is forbidden, and if he specified of idolatry it is permitted;

ואם סתם דמשמע הכי ומשמע הכי אסור הרי שסתם נדרים להחמיר.

And if it was Stam, which can mean like this and can mean like this, he is forbidden. This is Stam Nedarim to be stringent.

ר"ן ד"ה אם כמעשר בהמה נדר אסור

Mishnah: If he vowed like Ma'aser Behemah, he is forbidden.

דדבר הנדור הוא כשהיה קורא לעשירי עשירי ואסור לכל עד שיקרבו מתיריו.

Explanation: [Ma'aser Behemah] is Devar ha'Nadur, for he called the 10th 'Asiri', and it is forbidden to everyone until he offers its Matirim (the blood and Chelev).

ר"ן ד"ה סתם חרמים ביהודה מותרין

Mishnah: Stam Charamim in Yehudah are permitted.

שמתוך שהכהנים מצויין ביניהם ורגילים בחרמי כהנים קרי להו נמי חרמי סתם כחרמי גבוה

Explanation: Since Kohanim are frequent among them, and they are used to Chermei Kohanim, they call them also Stam Charamim, just like Charamim of Hash-m (Bedek ha'Bayis);

ומש"ה מותרין דהך סיפא ר' אלעזר ברבי צדוק היא כדאיתא בגמרא וס"ל דסתם נדרים להקל ופליג ארישא

Therefore, it is permitted, for this Seifa is like R. Eliezer b'Ribi Tzadok, like it says in the Gemara. He holds that we are lenient about Stam Nedarim. He argues with the Reisha.

Mishnah: And in Galil they are forbidden.

והיינו דהדר קתני שאין אנשי גליל מכירין את חרמי הכהנים דמשמע טעמא דאין מכירין

Explanation: This is why the Mishnah returned to teach "because people in Galil do not recognize Chermei Kohanim." This implies that the reason [we forbid] is because they do not recognize;

הא מכירין אלו ואלו מותרין.

Inference: If they recognized, both of them (people in Galil and Yehudah) would be permitted.

ר"ן ד"ה שאין אנשי גליל מכירין את חרמי הכהנים

Mishnah: For people of Galil do not recognize Cherem of Kohanim.

שמתוך שלא היו כל כך כהנים ביניהם לחרמי כהנים לא קרו להו חרם סתם הלכך כי נדרי בחרם ליכא לספוקי במידי דודאי חרם גבוה קאמרי.

Explanation: A net used to trap fish

Mishnah: Atzmi Korban.

כלומר היה מדבר עם חבירו ואמר לו הרי עצמי קרבן

Explanation: He was speaking with his friend, and he said 'behold, Atzmi Korban';

אף על פי שנראה שאוסר עליו גופו כי אמר דלא נדר אלא בעצם שהניח להיות נודר בו כלומר שיש לו עצם אחד בתוך ביתו שהצניעו לכך להיות נודר בו מהימן.

Even though it seems that he forbids his body to his friend, if he says that he vowed only with an Etzem (bone) that he left to vow via it, i.e. he has one bone in his house that he stored away for this, to vow with it (i.e. he says 'Atzmi Korban' to makes others think that he forbids himself, but really, he discusses only the bone), he is believed.

Explanation: The Gemara explains that it means that a Chacham need not ask about them. If he vowed with Cherem, and says that he vowed with a fishing net, he is believed, and he need not ask.

Mishnah: And if they asked...

כלומר אי הוי אינש דלא מהימן וכגון שהוא עם הארץ ולפיכך צריך שאלה עונשין אותן אם נהגו היתר בדבר קודם שבאו לישאל

Explanation: I.e. if it is someone who is not believed, e.g. an Am ha'Aretz, and therefore he must ask, we punish them if they acted leniently before they came to ask.

Gemara: We punish them.

שאין מתירין להן עד שינהגו איסור כימים שנהגו בהן היתר כדאיתא בגמ'.

Explanation: We do not permit them until they observe the Isur [of the vow] for the number of days they acted leniently, like it says in the Gemara.

Mishnah: And we are stringent on them.

שאין פותחין להן בחרטה ואין מתירין אותו עד שימצאו פתח לנדרן.

Explanation: We are not Pose'ach for them with regret, and we do not permit them until they find a Pesach for their vow.

Mishnah: We make a Pesach for him from another place.

בתרתי פליגי חדא דאין עונשין אותן אם עברו על נדרן

Explanation: They argue about two matters. Firstly, we do not punish them if they transgressed their vow;

ועוד שפותחין להם בחרטה וקרי ליה מקום אחר משום דלא הויא פתח מגופו של נדר (הגהות ר' בצלאל אשכנזי)

And further, we are Pose'ach for them with regret. This is called from another place, for the Pesach is not from the vow itself.

ר"ן ד"ה ומלמדין אותן שינהגו איסור

Mishnah: And we teach them to conduct Isur.

אפי' בנדרים הללו

Explanation: Even in these vows.

ודוקא בהני דסיפא דמשמעותא דידהו הויא להחמיר טפי מלהקל אמרינן דצריך שאלה למר כדאית ליה ולמר כדאית ליה

Limitation: It is only for these of the Seifa. They imply more to be stringent than to be lenient, so we say that they need She'elah - this opinion like he holds, and this opinion like he holds;

אבל בהנך דרישא דנדר בבשר מליח אי פריש ואמר דבשל עבודת כוכבים נדר וכן כשנדר בחרם אי פריש ואמר דבשל כהנים נדר אפי' בעם הארץ אינו צריך שאלה.

However, those of the Reisha, that he vowed in salted meat - if he explained that he vowed in [salted meat] of idolatry, and similarly when he vowed in Cherem, if he explained and said that he vowed in Cherem of Kohanim, even an Am ha'Aretz need not ask.

Gemara: Safek Nezirus, we are lenient.

משנה היא במסכת טהרות (פ"ד משנה י"ב) ונזירות על ידי נדר הוא וקשיין אהדדי.

Explanation: This is a Mishnah in Taharos (4:12). Nezirus is via a Neder. The Mishnayos contradict each other!

Gemara: If one was Makdish his Chayah and Behemah.

Explanation: His Chayah or Behemah.

Gemara: He was not Makdish his Koy.

דהוי ספק חיה ספק בהמה ואי הקדיש את בהמתו אמרינן דלמא כוי חיה ואי הקדיש חייתו אמרינן דלמא בהמה הוא.

Explanation: It is a Safek Chayah, Safek Behemah. If he was Makdish his Behemah, we say, perhaps a Koy is a Chayah. And if he was Makdish his Chayah, we say, perhaps a Koy is a Behemah.

Gemara: Also himself.

סבירא ליה דמעייל לספיקא הלכך מתניתין דסתם נדרים להחמיר רבנן.

Explanation: [This opinion] holds that a person enters [his property] into a Safek. Therefore, our Mishnah of 'Stam Nedarim we are stringent' is Rabanan.
