Explanation: This is the Seifa of the Mishnah itself that we are lenient about Safek Nezirus.

והכי פריך בשלמא אי לא מוקמינן לה כר"א לא קשיא רישא אסיפא

So we ask. Granted, if we do not establish it like R. Eliezer, the Reisha does not contradict the Seifa;

דרישא דספק נזירות להקל משום דגופו לא מעייל איניש לספיקא

The Reisha says that we are lenient about Safek Nezirus, because one does not enter himself into a Safek;

וסיפא דספק בכורות כיון דממונא הוא אמרינן דמעייל אינש ממונא לספיקא

The Seifa, of Safek Bechoros, since it is Mamon, we say that one enters his property into a Safek.

אלא לדידך דלא שני לך בין גופו לממונא קשיא.

However, you (R. Zeira) do not distinguish between himself and his property. For you, it is difficult!

Gemara: Why do you compare Kedushah that comes automatically to Kedushah that comes via man?

משום דבקדושה הבאה בידי אדם הוא דאיכא למימר דהאי גברא לא גמר לעיולי נפשיה וממוניה לספיקא

Explanation: Because in Kedushah that comes via man, we can say that this man did not resolve to enter himself and his property into a Safek;

אבל בקדושה הבאה בידי שמים ליכא למימר הכי דאטו בידיה הוא.

Distinction: However, Kedushah that comes via Shamayim, one cannot say so. Is it in his hands?!

Gemara: A Safek about liquids.

כגון שהושיט טמא ידו לבין המשקין ואין ידוע אם נגע בהן.

Explanation: E.g. a Tamei person stuck his hands among liquids, and it is not known whether or not he touched them.

The Seifa teaches "Safek liquids to become Tamei, they are Tamei. To be Metamei others, they are Tahor."

Answer: Perhaps the text says so [like Version #1]. He preferred to ask from the Beraisa, for it explicitly says that R. Eliezer holds that Safek liquids to become Tamei, they are Tamei.

Gemara: Liquids have no Tum'ah at all.

Gemara: About Ayal Kamtza (a kind of locust).

חגב ששמו איל.

Translation: Ayal is the name of a [kind of] locust.

Gemara: It is Tahor.

טהור וכשר לאכילה.

Explanation: It is Tahor, and it is permitted to eat.

Gemara: And about liquids of Bei Mitbechai (where they rinse Korbanos), that they are Tehorim.

דכיון דטומאת משקין מדרבנן במשקה בי מטבחיא לא גזרו שלא להרבות טומאה בעזרה

Explanation: Since Tum'ah of liquids is only mid'Rabanan, they did not decree about liquids of Bei Mitbechai, lest this increase Tum'ah in the Azarah;

וכיון דטומאת משקין מדרבנן היכי מחמרינן בספקייהו.

Since Tum'ah of liquids is mid'Rabanan, how can we be stringent about a Safek about them?!

Question: If so, even if we do not establish "Safek Nezirus Lehakel" like R. Eliezer, why is it fine? There is still a contradiction in R. Eliezer!

He taught explicitly that Tum'ah of liquids is mid'Rabanan, like it says "there is no Tum'ah of liquids at all";

ואפילו הכי אזיל בספקייהו לחומרא כדקתני וכן היה רבי אליעזר אומר כדבריו עלה דההיא דספק משקין ליטמא טמא

Even so, he is stringent about a Safek, like it taught "and R. Eliezer said like his words", regarding "Safek liquids to become Tamei, they are Tamei"!

יש לומר דהכי פריך בשלמא אי הך דספק נזירות להקל לא מיתוקמא כרבי אליעזר לא קשיא דאיכא למימר דרבי אליעזר מחמיר בספק אפילו בדרבנן

Answer: We ask that granted, if we do not establish Safek Nezirus Lehakel like R. Eliezer, it is not difficult. We can say that R. Eliezer is stringent even about a Safek mid'Rabanan;

אבל כיון דאמרת דספק נזירות להקל רבי אליעזר היא נהי דהוי קדושה הבאה בידי אדם

However, since you said that Safek Nezirus Lehakel is like R. Eliezer, granted, it is Kedushah that comes through man...

How is Tum'ah mid'Rabanan better (more stringent), even though it comes automatically, than Nezirus mid'Oraisa, even though it comes from man?

וכי תימא הא חזינן בהדיא דבקדושה הבאה בידי אדם אף על פי שהיא מדאורייתא מיקל ר"א בספיקיה דקתני לא הקדיש את הכוי

Question: We find explicitly that Kedushah that comes through man, even though it is mid'Oraisa, R. Eliezer is lenient about a Safek. It says that he was not Makdish the Koy;

וכיון שכן אפילו כי לא מוקמינן הא דספק נזירות להקל כר"א קשיא דר"א אדרבי אליעזר

Therefore, even if we do not establish Safek Nezirus Lehakel like R. Eliezer, there is still a contradiction in R. Eliezer!

איכא למימר דהוה מצינן לדחויי דהיינו טעמא דרבי אליעזר דאמר לא הקדיש את הכוי משום דכוי שמו עליו ולא קרו ליה אינשי חיה ולא בהמה זה נ"ל.

Answer: We could have rejected that the reason that R. Eliezer says that he was not Makdish the Koy is because people call it a Koy, and not a Chayah or Behemah. So it seems to me.

ר"ן ד"ה והלך ומצאו שנגנב או שאבד רבי יהודה מתיר

Gemara: And he went and found that it was stolen or lost, R. Yehudah permits.

משום דלא מסיק אדעתי' דלהוי נזיר עד שיתברר לו שיהא באותו כרי מאה כור.

Explanation: Because it did not cross his mind that he will be a Nazir until it will be clear to him that there were 100 Kor in the stack.

Implied question: Why does he ask from an inference from the Seifa, and not from the Reisha itself, which taught that Stam Terumah in Yehudah forbids? This shows that we are stringent about a Safek!

משום דאיכא לדחויי דרישא היינו טעמא משום דאנשי יהודה מתוך שהיו יותר רגילין בתרומת הלשכה לתרומת הגורן לא קרו לה תרומה סתם

Answer: We could have rejected that the reason for the Reisha is because people in Yehudah, since they are used to Terumas ha'Lishkah, they do not say Stam "Terumah" to refer to Terumas Goren;

הלכך כי נדרי בתרומה ודאי בתרומת הלשכה נדרי

Therefore, when they vow [and say that something is like] Terumah, surely they vow with Terumas ha'Lishkah;

אבל דיוקא דסיפא קשיא דמדיהיב טעמא בהתירא דגליל לפי שאין מכירין משמע הא מכירין זו וזו אסורין דספיקא לחומרא.

However, the inference from the Seifa, since it gives the reason to permit in Galil because they do not recognize [Terumas ha'Lishkah], this implies that if they recognized it, in both places we would forbid, for we are stringent about a Safek.

RAN DH v'Ilu Al Sefeko... [TRANSLATION: Whereas for its Safek, he cannot shave.]

(SUMMARY: The Ran explains why a Safek Nazir cannot shave and bring Korbanos.)

לפי שצריך לגלח על הבאת קרבנותיו ולא מצי לאיתויינהו דלמא לא הוי נזיר ומייתי חולין בעזרה

Explanation: This is because one must shave with bringing Korbanos, and he cannot bring, for perhaps he was not a Nazir, and he brings Chulin b'Azarah.

וכי תימא נהי דחטאת לא מצי לאתויי בתנאי שאין חטאת באה נדבה

Question: Granted, he cannot bring a Chatas on condition [that if he was not a Nazir, it is a voluntary offering], for one cannot bring a Chatas for a Nedavah...

ליתי עולה ושלמים וליתני אם נזיר אני הרי אלו לחובתי ואם לאו יהא נדבה

[However,] he should bring Olah and Shelamim, and stipulate "if I am a Nazir, they are for my obligation. If not, it will be a Nedavah";

[This would enable him to shave,] for we hold that if he shaved after bringing one of the three Korbanos, he was Yotzei!

Answer: This is only b'Di'avad, but l'Chatchilah he shaves only if he offered a Chatas, Olah and Shelamim;

Gemara: If he said 'I am a Nazir Olam', what is the law?

דהא ברייתא דאם יש בכרי הזה מאה כור סתמא תניא ויש במשמע אפילו נזיר עולם

Explanation: The Beraisa taught Stam 'if there are 100 Kor in this stack.' It implies even a Nazir Olam;

ואפ"ה שרי רבי יהודה אף על פי שאין ספקו חמור דהא ודאי נמי לא מצי מגלח.

And even so, R. Yehudah permits, even though the Safek is not more stringent the Vadai, for also a Vadai cannot shave!

ר"ן ד"ה הריני נזיר שמשון מאי

Gemara: If he said 'I am a Nazir Shimshon', what is the law?

דאפי' ודאי לא מצי מגלח בתער.

Explanation: Even a Vadai [Nazir Shimshon] may not shave with a razor.

Citation (Nazir 32a - Mishnah): If two were walking on the road and saw someone approaching them, and one of them said "I am a Nazir if this is Ploni", and the other said "I am a Nazir if it is not [Ploni]", R. Tarfon says, neither is a Nazir.

ויהיב רבי יהודה משמיה טעמא למילתיה לפי שלא נתנה נזירות אלא להפלאה כלומר שאין נזירות חל עד שיפרש אותה בלא שום תנאי

וכי תימא ליתני דכי איתא בעיניה להודיעך כחו דרבי יהודה דכחה דהיתרא עדיף

Question: It should teach about when [the stack] is intact, to teach the Ko'ach (extremity) of R. Yehudah's opinion (he is not a Nazir), for it is better to teach the extremity of the lenient opinion!

ליתא דכיון דטעמא משום דלא נתנה נזירות אלא להפלאה ליכא כחה דהיתרא טפי כי איתא בעיניה משנגנב או שאבד

Answer: Since the reason for R. Yehudah is because Nezirus requires Hafla'ah, there is no more Ko'ach of the lenient opinion when it is intact that when it was stolen or lost.

אבל השתא דנקיט לה בנגנב אשמעינן רבותא דר"ש דלא חייש לנזירות דהפלאה ועוד דמעייל נפשיה לספיקא.
