שאין הלואה בעין

Explanation: [A Bari cannot be Makneh a loan,] because the loan is not intact.

ונהי דיכול להקנות אגב קרקע אי גרסינן מסיק בדרב (גירסת מהר"מ) פפא (לעיל דף עז: ושם)

Implied question: He can be Makneh Agav land, if the text says Masik regarding Rav Papa (above, 77b! He was Makneh Agav land. "Masik" means that he was owed a debt. Our text connotes that he was Makneh a deposit.)

Answer: Even so, since a Bari cannot do so through a Kinyan, for he cannot be Makneh without something else with the loan, it is considered that it does not apply to a Bari.

However, we require that he can be Makneh it, like a Shechiv Mera is Makneh it through his words, a Bari can be Makneh it through Kinyan Chalipin or a sale. One cannot sell a loan, for it is not intact!

ומשני הואיל ויורש יורשה ומתנת שכיב מרע כירושה

Explanation (cont.): [The Gemara] answers that it is because an heir inherits [a loan], and Matanas Shechiv Mera is like inheritance.

ואע''ג דיורש יורש נמי דירת הבית [ופירות דקל]

Implied question: An heir inherits also [rights to] live in the house or fruits of a date tree [and Rav Nachman said that one cannot be Makneh these through Matanas Shechiv Mera]!

Answer: That is because he inherits also the house and date tree. (He cannot inherit just the rights to live in it or eat the Peros.)

Answer: This is not considered that a Bari can do so, since it is unlike a Shechiv Mera, which is in the expression of a gift and Kinyan.

Explanation: It says "since an heir inherits, he inherits [the loan]." This is not because it is considered that a Bari can do so;

אלא כיון שיורש יורשה יש כח לשכיב מרע ליתן דברשותו הויין דמתנת שכיב מרע כיורש

Rather, since an heir inherits it, a Shechiv Mera has the ability to give [a loan], since it is in his Reshus, for [the recipient of] a Matanas Shechiv Mera is like an heir.

ותדע דעל טעם זה דהואיל ויורש יורשה (הגהת בארות המים) לא נקט איתא בבריא הואיל ויורש יורשה ועל מעמד שלשתן נקט איתא בבריא במעמד שלשתן כמו שכתוב בכל הספרים ובפירוש רבינו חננאל

Proof: Regarding this reason "since an heir inherits it", we do not say that a Bari can do so, since an heir inherits it. Regarding Ma'amad Sheloshtan, it says that a Bari can do so through Ma'amad Sheloshtan, like is written in all Seforim and R. Chananel's Perush;

Reference: People commonly write Harsha'ah (power of attorney) for a loan (even though a Bari cannot be Makneh it). I explained this above (77b Sof DH Rav Papa. It was an enactment mid'Rabanan to enable one to make a Shali'ach even for a Harsha'ah of a loan.)

[I explained there] also that it is unreasonable to explain like Rashi in Kesuvos (55b), that [Hakna'ah of a loan does not apply to a Bari] because coins cannot be acquired through Chalipin.

We find different versions of Tosfos in this Masechta - see the last Tosfos on 144a.)

Explanation #1 (Rashbam): This refers to a Shiyur (something excluded from) a [Matanas] Shechiv Mera. Our Mishnah teaches that if he left over any amount of land, it is a valid gift.

Rebuttal #1 (Ri): If so, this should have been asked below on (149b, where we explain the Seifa of) the Mishnah (146b) "if he left over any amount of land"!

Support: A Beraisa above (63a) says that if a Ben Levi told a Yisrael "I sell this field [to you] on condition that the Ma'aser Rishon is mine", the Ma'aser Rishon is his. The Gemara asks that Ein Adam Makneh Davar she'Lo Ba l'Olam;
