WHEN IS THE RIGHT ME'AKEV? (Yerushalmi Perek 12 Halachah 2 Daf 67b)

ר' יוחנן בעי מחלפא שיטתיה דר' ליעזר תמן הוא אמר הימנית מעכבת. והכא הוא אמר אין הימנית מעכבת

(a)

Question (R. Yochanan): R. Eliezer contradicts himself! There (Nega'im 14:9) he says that the right is Me'akev (if a Metzora has no right ear, thumb or big toe, we put blood on their place), and here he says that the right is not Me'akev (he is Machshir Chalitzah of the left shoe)!

א"ר יוסי תמן דכתיב [ויקרא יד יד] ימנית הימנית מעכבת. ברם הכא דלית כתיב ימנית אין הימנית מעכבת.

Answer (R. Yosi): There (Metzora), it is written "Yemanis", so the right is Me'akev. Here, it is not written "Yemanis", so the right is not Me'akev.

תני רבי יוסי ציידנייה קומי רבי ירמיה [שמות כא ו] אזנו [ויקרא יד יד] אזנו. מה אזנו שנאמר להלן הימנית אף כאן הימנית.

(R. Yosi Tzaidanyei, in front of R. Yirmeyah): [We learn from a Gezeirah Shavah] "Azno-Azno" - just like there (Metzora), it is his right ear, also here (a Nirtza) it is the right.

[דף סח עמוד א] ואמר [ויקרא יד יד] רגלו רגלו. מאן דאית ליה אזנו אזנו לית ליה רגלו רגלו.

Question: [R. Eliezer should learn that the right is Me'akev for Chalitzah -] he should learn from "Raglo-Raglo"! Will we say that the one who learns "Azno-Azno", does not learn "Raglo-Raglo"?!

Note: The Bavli (Kidushin 15a) cites a Beraisa in which R. Eliezer learns "Azno-Azno."

והא תניי בשם ר' ליעזר רגלו רגלו.

Strengthening of question: It was taught in the name of R. Eliezer [that he learns] "Raglo-Raglo"!

הוי תרתי מתניין אינון על דברי ר' ליעזר. מאן דאית ליה אזנו אזנו אית ליה רגלו רגלו מאן דלית ליה אזנו אזנו לית ליה רגלו רגלו.

Answer: Tana'im argue about R. Eliezer' opinion. The one who learns "Azno-Azno", he learns "Raglo-Raglo". The one who does not learn "Azno-Azno", he does not learn "Raglo-Raglo";

והדא מתני' לית ליה אזנו אזנו ולא רגלו רגלו:

[The Tana of] our Mishnah [holds that R. Eliezer] does not learn "Azno-Azno", and not "Raglo-Raglo." (We explained this based on REGEL YESHARAH. We do not explicitly find one who does not learn "Azno-Azno." However, R. Shimon (Nega'im 14:9) holds that the right is not Me'akev for Metzora, so it is reasonable that he does not learn Azno-Azno to obligate the right ear for Retzi'a. - PF)
