WE DO ONE CHALITZAH OR YIBUM FROM EVERY BAYIS (Yerushalmi Perek 4 Halachah 12 Daf 28b)

מתני' ארבעה אחין נשואין לארבעה נשים ומתו אם רצה הגדול שבהם מייבם את כולן הרשות בידו

(a)

(Mishnah): If four brothers were married to four women and the brothers died, if the oldest brother wants he may do Yibum to all of them (this will be explained);

היה נשוי לשתי נשים ומת ביאתה או חליצתה של אחת מהן פוטרת צרתה

(b)

If a man was married to two women and he died, Yibum or Chalitzah of one exempts the other.

היתה אחת כשירה ואחת פסולה אם היה חולץ חולץ לפסולה ואם היה מייבם מייבם לכשירה:

If one Yevamah was Kesherah (to Kehunah), and the other was Pesulah, if he does Chalitzah, he does it with the Pesulah. If he does Yibum, he does so with the Kesherah [if he wants].

(Gemara) Explanation: Four of the brothers [died. If there were only four, no one remains to do Yibum!]

דלמא תלת עשר אחין הויין ומתין תרין עשר דלא בנין אתיון בעיון מתייבמה קומי רבי אמר ליה רבי איזיל ייבם אמר ליה לית בחיילי. והם אומרות כל חדא וחדא אנא מזייננא ירחי.

A case occurred in which there were 13 brothers, and 12 of them died without children. [The widows] wanted to do Yibum, and came in front of Rebbi. He told the Yavam to do Yibum [to all of them]. He said, I lack wealth [to support all of them]! Each [widow] said 'I will support [the entire family] one month [of the year]."

אמר ומאן זיין ההוא ירחא דעיבורא. אמר רבי אנא זייננא ירחא דעיבורא וצלי עליהון ואזלון להון

The Yavam asked, [when there is a leap year], who will finance the added month? Rebbi said, I will finance the added month. He prayed for them [to have children], and they went away.

בתר תלת שנין אתון טעינין תלתין ושיתא מיינוקין אתון וקמנו להן קומי דרתה דרבי. סלקין ואמרין ליה לרע קרייא דמיינוקין בעיין מישאל בשלמא.

After three years, they came with 36 children (each woman gave birth each year), and stood in front of Rebbi's home. They told Rebbi that a village of children want to greet him.

אודיק ר' מן כוותא וחמתון. אמר לון מה עיסקיכון. אמרין ליה אנן בעיין תיתין לן ההוא ירחא דעיבורא. ויהיב להון ההוא ירחא דעיבורא.

Rebbi looked out of the window, and saw them. He asked why they came. They told him, we want you to give to us [food] for the leap month. He gave to them for the added month.

כתיב [דברי הימים א יג יד] וישב ארון יי עם [צ"ל בית] עובד אדום בביתו שלשה חדשים ויברך יי וגו' במה בירכו

Question: It says "va'Yeshev Aron Hash-m Im Beis Oved Edom b'Veiso Sheloshah Chadashim va'Yevarech Hash-m..." - how did Hash-m bless him?

בבנים. הדא הוא דכתיב [דברי הימים א כו ח] כל אלה מבני עובד אדום המה ובניהם ואחיהם איש חיל בכח לעבודה ששים וגו'. דהוות כל חדא מינהן ילדה תריי בכל ירחא.

Answer: He was blessed with children. It says "Kol Eleh mi'Bnei Oved Edom Hemah u'Vneihem va'Acheihem Ish Chayil ba'Ko'ach la'Avodah Shishim [u'Shenayim]" - each [of his eight daughters-in-law] bore two sons every month.

הא כיצד טמאה שבעה. וטהרה ז' וילדת. טמאה ז' וטהרה ז' וילדת שית עשר לכל ירח לתלתא ירחין הא ארבעין ותמניי'

How was this? Seven days she was Temei'ah (after giving birth to a boy), and seven days she was Tehorah, and [at the end if those seven days] she gave birth. [From all eight] he had 16 [grandsons] every month, for three months - this is 48;

והוא (אשתין) [צ"ל שיתה - קרבן העדה] הא חמשין וארבעה [דף כט עמוד א] ותמנותיהון הא אשתין ותריי. הדא היא דכתיב ששים ושנים לעובד אדום

[Oved Edom] himself had six [new] sons [in these three months]. This makes 54 in all, and his eight [married] sons [completes] 62. This is why it says "Shishim u'Shenayim l'Oved Edom."

א"ר בא בר זבדא כתיב [דברים כה י] ונקרא שמו בישראל בית חלוץ הנעל. בית שהוא ניתר בחליצה אחת.

(h)

(R. Ba bar Zavda): It says "va'Yikre'u Shemo b'Yisrael Beis Chalutz ha'Na'al" - a house that is permitted through one Chalitzah (it permits all the Tzaros).

אף בביאה כן. חליצה פוטר וביאה פוטר. כמה דאת אמר בחליצה. כן את אמר בביאה.

The same applies to Bi'ah. Chalitzah permits, and Bi'ah permits. Just like you say about Chalitzah (one Chalitzah permits all the Tzaros), so you say about Bi'ah.

ומהו להערים.

(j)

Question: May one scheme? (The Yerushalmi holds that a Shomeres Yavam to a Kohen may eat Terumah. Chalitzah forbids all the widows to Terumah, and Yibum with one forbids all the others. May one refrain from doing either, to permit all of them to Terumah?)

וכי רבי טרפון אביהן של כל ישראל לא הערים. קידש שלש מאות נשים בימי רעבון על מנת להאכילן בתרומה.

Answer: Did not R. Tarfon, [who was esteemed enough to be called] the father of all Yisrael, scheme?! He was Mekadesh 300 women in times of famine, in order to feed them Terumah [even though he had no intent for Nisu'in]!

Note: Even though Mishnah Acharonah forbids Terumah until Chupah, our question and R. Tarfon are according to Mishnah Rishonah (Kesuvos 5:2), which permits once the time set for Chupah came, even if he did not do Nisu'in. (Even though the custom was to schedule Nisu'in a year after Kidushin, surely he set a time shortly after Kidushin, to enable them to eat promptly - PF.)

תמן אין כל אחת ואחת ראויה לוכל בתרומה. ברם הכא כל אחד ואחד ראוי לייבם.

There (R. Tarfon's case), each woman was not proper to eat Terumah [before he was Mekadesh her]. Here, each one was proper to do Yibum [all the more so one may scheme! We explained this like MEICHAL HA'MAYIM. Surely, this is when all the women agree, but if one wants to do Yibum or remarry through Chalitzah, we do not force her to be an Agunah in order to help her Tzaros - PF.]

PESULIM THAT RESULT FROM MACHAZIR GERUSHASO (Yerushalmi Perek 4 Halachah 13 Daf 29a)\h

מתני' המחזיר את גרושתו והנושא את חלוצתו והנושא את קרובת חלוצתו יוציא והוולד ממזר דברי רבי עקיבה

(a)

(Mishnah - R. Akiva): If one was Machazir Gerushaso (remarried his ex-wife after she married someone else), or married his Chalutzah or Krovas Chalutzaso (one of her close relatives), he must divorce her. The child is a Mamzer;

וחכ"א אין הוולד ממזר ומודים בנושא את קרובת גרושתו שהוולד ממזר:

Chachamim say that the child is not a Mamzer. They agree that if he married the relative of his ex-wife, that the child is a Mamzer.

גמ' ר' חייה בשם ר' יוחנן המחזיר את גרושתו משנישאת פסלה מן הכהונה.

(c)

(Gemara - R. Chiyah citing R. Yochanan): One who was Machazir Gerushaso after she married someone else, he disqualified her from Kehunah.

בלא כך אינה פסולה מן הכהונה.

(d)

Question: Without [remarrying her], is she not disqualified from Kehunah [because she was divorced]?!

אלא פסולה מלוכל בתרומה.

(e)

Answer: [He means that] she is disqualified from eating Terumah [e.g. a Bas Kohen; had she not remarried him, she would have returned to eat Terumah of her father's house].

רבי זעירה ר' חייה בשם ר' יוחנן המחזיר גרושתו משנישאת בתה כשירה לכהונה.

(f)

(R. Ze'irah citing R. Chiyah citing R. Yochanan): One who was Machazir Gerushaso after she married someone else, his daughter is Kosher to Kehunah.

ומאי טעמא [שם כד ד] כי תועבה היא. היא תועבה ואין הוולד תועבה:

What is the reason? [It says about Machazir Gerushaso] "Ki To'evah Hi" - she is a To'evah (disqualified), but the child is not To'evah.
