RABBAN GAMLIEL'S LETTERS (Yerushalmi Halachah 2 Daf 5a)

תני אמר ר' יודן מעשה ברבן גמליאל וזקנים שהיו יושבין על גב מעלה בהר הבית ויוחנן סופר הלז יושב לפניהן.

(a)

Beraisa (R. Yudan): It once happened that Rabban Gamliel and the elders were sitting on a raised area on the Temple Mount and Yochanan the scribe sat in front of them.

אמר לו רבן גמליאל כתוב לאחנא בני דרומא עילאה ואחנא בני דרומא ארעייא שלמכון יסגא מודענא לכון דמטא זמן ביעורא לאפוקי מעשרייא מעומרי שיבלייא יסגא.

(Rabban Gamliel to the scribe): Write the following - "To my brothers of the upper south and the lower south, your peace should increase! I inform you that the time of Biyur Maaser has come. Remove all Maaser from your piles of stalks."

ולאחנא בני גלילא עילאה ובני גלילא ארעייא שלמכון מודענא לכון דמטא זמן ביעורא תפקון מעשרייא ממעטני זיתיא

And in another letter, "To my brothers of the upper Galil and the lower Galil, your peace should increase! I inform you that the time of Biyur Maaser has come. Remove all Maaser from your olive vessels."

לאחנא בני גלותא דבבל בני גולתא דמדי בני גולתא דיוון ושאר כל גלוותא דישראל שלמכון יסגא. מודענא לכון דאימריא רכיכין וגוזליא דקיקין וזימנא דאביבא לא מטא ושפר מילתא באפיי ואנפי חבריי מוספא על שתא דא תלתין יומין

And in another letter, "To my brothers in the Exile of Bavel, the Exile of Madai, the Exile of Yavan and the rest of the Exiles of Israel, your peace should increase! I inform you that the kids are young and the chicks are small and the time of spring has not yet arrived. It is correct in my mind and in my colleagues' minds that this year should be extended by 30 days."

PREREQUISITES FOR EXTENDING THE YEAR (Yerushalmi Halachah 2 Daf 5a)

אין מעברין לשנה אלא אם כן היתה חסירה רוב החודש וכמה רוב החודש ששה עשר יום.

(a)

They do not extend the year unless it was lacking most of the month. How much is that? 16 days. (Since the lunar year is shorter than the solar year, the calendar gradually moves backwards until, if not for extending the year by adding a month, Nisan would arrive when it is still winter.)

ר' יהודה אומר שתי ידות החודש אחד ועשרים יום.

R. Yehuda: 2/3rd of the month, which is 21 days.

א"ר שמואל בר נחמן והוא שיקרב העומר סוף ניסן של תקופות.

(b)

R. Shmuel bar Nachman: If the winter season will continue 16 days into Nisan, we extend the year to prevent the Omer being brought while it is still winter, instead of at the beginning of the spring.

א"ר יוסי עד הפסח.

(c)

R. Yosi: Until Pesach (which is 15 days into Nisan rather than 16 days).

אמר רב מתניה והוא שיטלו לולב בסוף תשרי של תקופות.

(d)

Rav Matanya: As long as he can finish taking his Lulav (on 21st of Tishrei) before the end of the summer season.

אין מעברין לשנה לא פחות מחדש ולא יותר על חדש ואם עיברוה אינה מעוברת.

(e)

They do not extend the year for less than a month or more than a month and if they did, it is not valid.

אין מעברין לא בשביעית ולא במוצאי שביעית ואם עיברוה הרי זו מעוברת.

(f)

They do not extend the year, neither if it is the Shemita year or the year after it, and if they did, it is valid.

(g)

When do they usually extend it? The year before Shemita (giving them an extra month to work the land before the Shemita year arrived).

ר' זעירא בשם ר' אבהו הדא דתימר עד שלא התיר ר' ליקח ירק מחוץ לארץ לארץ אבל משהתיר ר' ליקח ירק מחוצה לארץ לארץ היא שביעית שאר שני שבוע.

(h)

(R. Zeira citing R. Abahu): This was before Rebbi permitted bring vegetables from outside of Eretz Yisrael to Eretz Yisrael, but after that, Shemita is like any other year (since there is a supply of food from elsewhere).

היה ר"מ אומר הרי הוא אומר ואיש בא מבעל שלישה ויבא לאיש האלהים לחם בכורים עשרים לחם וגו'. והואיל והיתה השנה צריכה להתעבר מפני מה לא עיברה אלישע אלא מלמד שהיו שני רעבון והיו קופצים לגרנות.

(i)

(R. Meir): The pasuk states (Melachim 2:4:42), "A man came from Ba'al Shalishah and brought the man of Hash-m food from the first grains, twenty loaves (of barley bread)". If the year needed to be extended (Ba'al Shalishah was the most advanced place in the country in growth of new crops and nevertheless, only the barley had begun to ripen) why didn't Elisha do it? This teaches that it was a year of famine and people were rushing to the granaries (to eat from the new crops and if he would have extended the year, the people would have had to wait even longer to be able to eat the new crops, until after the Omer offering).

(j)

(Tana Kama): They may not extend the year because of tumah. (If most Jews are tameh in Adar and they have no more Parah Adumah (Red Heifer) waters with which to purify the nation, it is not permitted to extend the year in order to allow enough time to obtain the waters and purify them before the Pesach offering must be brought.)

ר' יוסי אומר מעברין שכן מצינו בחזקיה שעיבר מפני הטומאה שנאמר כי מרבית העם מאפרים ומנשה וישראל וזבלון לא הטהרו כי אכלו את הפסח בלא ככתוב כי התפלל יחזקיהו לאמר ה' הטוב יכפר בעד.

Yosi): They may extend it because of Tumah, as we find that Chizkiyah did so, as the pasuk states (Divrei Hayamim 2:30:18), "Because many of the people, from Efraim, Menashe, Yisrael and Zevulun did not become pure and they ate the Pesach offering not according to that which is written, as Chizkiyah prayed, saying, 'May Hash-m who is good give atonement for whoever...'.Chizkiyah extended the year, clearly because of the problem that many people would be impure at the time of bringing of the Pesach offering. (Note: According to the text of the Tosefta and the Bavli, this statement was said by R. Yehuda.)

(R. Shimon): (What was their mistake?) They added another month in Nisan but this can only be done in Adar.

(R. Shimon ben Yehuda): Chizkiyahu required them all to make Pesach Sheni.

אית תניי תני מעברין מפני הטומאה אית תניי תני אין מעברין מאן דאמר אין מעברין מינה כי אכלו את הפסח בלא ככתוב ומאן דמר מעברין מה מקיים בלא ככתוב מפני שעיברו ניסן ואין מעברין אלא אדר.

(k)

There is a Tanna that teaches that we extend because of Tumah. Another Tanna teaches that we do not. The one who teaches that we do not uses the above pasuk, "they ate the Pesach offering not according to that which is written". According to the one who teaches that we may extend, in what way did they act improperly? They added a second month of Adar when they were already during Nisan.

ותייא כיי דמר ר' סימון בר (זביד)[זבדי] גולגולת ארנן היבוסי מצאו תחת המזבח.

(l)

This understanding that Chizkiyah extended the year because of Tumah follows the statement of R. Simon bar Zavdi that the skull of Arnon the Yevusi was under the mizbeach, which shows that all of the congregation were Tameh and they would not have time to become Tahor before Pesach.

כתיב כל לבבו הכין לדרוש האלהים (ולעשות וללמד בישראל חק ומשפט)[ה' אלהי אבותיו ולא כטהרת הקודש]

(m)

The pasuk there states (Divrei HaYamim 2:30:19), "anyone who has set his whole heart to seek out God, (Hash-m, God of his fathers, but without the purity that is required for Holy things)..." (Note: The middle section of the pasuk is a mistakenly printed here and is actually part of a pasuk in Ezra 7:10. In fact, it is the second part of the pasuk that the Gemara is interpreting.)

ר' סימון בר (זביד)[זבדי] ור' שמואל בר נחמן חד אמר אפילו כמה עשה לטהרת הקודש לא יצא ידי טהרת הקודש

(n)

R. Simon bar Zavdi and R. Shmuel bar Nachman (disagreed over the meaning of the words "but without the purity that is required for Holy things") - one said that even with his good intentions to purify all idols from the Beis HaMikdash, he was not fully successful.

וחד אמר אפילו כל מעשים טובים (שעושין)[שעשה] לטהרת הקודש לא יצא ידי טהרת הקודש.

The other said - even though he had good intentions in all other matters, but he did not do all that he could to purify the Beis HaMikdash from idols.

כתיב ויחילו באחד לחדש הראשון לקדש וביום שמונה לחודש באו לאולם ה' ויקדשו את בית ה' לימים (שלשה)[שמונה] וביום ששה עשר לחדש הראשון כילו.

(o)

The pasuk states (Divrei Hayamim II 29:17), "They began to consecrate on the first day of the first month and on the eighth of the month, they came to the Hall of Hash-m and they consecrated the House of Hash-m for eight days and on the 16th of the month they finished."

והלא ליום אחד היו יכולין לבער כל עבודה כוכבים שהיה שם

(p)

Question: Weren't they able to destroy all idols there in one day? (Why did it take 16 days?)

א"ר אידי מפני צלמי כשדים שהיו חקוקים בששר.

(q)

Answer (R. Idi): It took time because of the images that the Kasdim had engraved in the marble.

3)

SIX THINGS THAT CHIZKIYAH DID (Yerushalmi Halachah 2 Daf 5b)

ששה דברים עשה חזקיהו על שלשה הודו לו ועל שלשה לא הודו לו.

(a)

There were 6 things that King Chizkiyahu did - the Chachamim agreed with 3 of them and disagreed with 3 of them.

שהיה גירר עצמות אביו על מיטת חבלים וכיתת נחש הנחושת וגנז טבלה של רפואות והודו לו.

He dragged his father's bones (through the streets) on a rope bed (to disgrace his father who was extremely wicked); he ground up the Copper Serpent (that was built by Moshe in the desert, on Hash-m's orders) and he hid away the board of medicines. Chachamim agreed with all of these.

סתם מי גיחון העליון וקיצץ דלתות ההיכל ועיבר ניסן בניסן ולא הודו לו.

2.

He blocked up the waters of the upper Gichon spring, he cut off the doors of the Heichal and he extended the year after the month of Nisan had begun.

4)

WHEN CAN THEY EXTEND THE YEAR? (Yerushalmi Halachah 2 Daf 5b)

אין מעברין קודם ר"ה ואם עיברוה אינה מעוברת אבל מפני הדוחק מעברין אחר ר"ה מיד אעפ"כ אינו מעובר אלא אדר

(a)

They may not extend the year before Rosh Hashanah and if they did, it is not valid. However, in a very pressed situation they can do it immediately after Rosh Hashana; but nevertheless, it should really be done in Adar.

רבי אומר ניסן לא נתעבר מימיו.

(b)

(Rebbi): It was never extended in Nisan.

והתנינן אם בא החדש בזמנו.

(c)

Question (Mishnah in Maseches Shekalim): If Nisan came at its time (as Adar was not extended), the sacrifices of the day are brought from the new donations (that begin to be used each year on the 1st of Nisan). (If not, since that day has been declared to be the 30th of Adar, the sacrifices are brought from the old donations.) This clearly shows that it is possible to extend Adar in Nisan?!

(d)

Answer: It was talking about a theoretical situation that never happens.

רב אמר תשרי לא נתעבר מימיו

(e)

(Rav): It was never extended in Tishrei.

והתנינן אם היה החדש מעובר.

(f)

Question (Beraisa): (The Torah teaches that debts are cancelled at the end of the Seventh year. One who slaughters a cow in the Seventh Year and divides it up amongst buyers on Rosh Hashanah - if the month of Elul was ruled to have 30 days, their division therefore retroactively had taken place on the last day of the year, so the debt of the buyers becomes cancelled so the following day). If Elul was not ruled to have 30 days, the division took place on the first day of the year, after all debts are already cancelled, and the debts incurred are not cancelled. We clearly see here that it is possible for Elul to be extended in Tishrei?!

(g)

Answer: It was talking about a theoretical situation that never happens.

וכשקידשו את השנה באושא ביום הראשון עבר ר' ישמעאל בן רבי יוחנן בן ברוקה ואמר כדברי רבי יוחנן בן נורי

(h)

When they extended the year in Usha, on the first day, R. Yishmael son of R. Yochanan ben Beroka passed and said like the words of R. Yochanan ben Nuri.

אמר רבן שמעון בן גמליאל לא היינו נוהגין כן ביבנה.

(Rabban Shimon ben Gamliel): We didn't used to do this in Yavneh.

ביום השני עבר רבי חנניה בן רבי יוסי הגלילי ואמר כר' עקיבה

On the second day, Chananyah ben R. Yosi Haglili said like Rabbi Akiva.

אמר רבן שמעון בן גמליאל כך היינו נוהגין ביבנה.

(Rabban Shimon ben Gamliel): We didn't used to do this in Yavneh.

והתני קידשוהו בראשון ובשני

(i)

Question (against Rav): Doesn't the Beraisa teach that they sanctified it on the first and second (days of Rosh Hashana)?

רבי זעירא בשם רב חסדאי אותה השנה נתקלקלה.

(j)

Answer (R. Zeira citing Rav Chisdai): That year, they mistakenly kept two days of Rosh Hashana.

מהו בראשון ומהו בשני (רבא)[רבי אבא] בשם רב שנה אחד ושנה שני'

Answer #2 (R. Aba citing Rav): What is the meaning of the phrase 'on the first and second'? 'And second' means the first day in the second year.

והתני קידשוהו ביום הראשון וביום השני

(k)

Rebuttal (Beraisa): They sanctified it on the first day and the second day! (This disproves R. Aba, as it seems clear that it happened in the same year.)

קידשוהו קודם זמנו או לאחר עיבורו יום אחד יכול יהא מקודש.

(l)

I might have thought that if Beis Din sanctified it early, on the 29th of the month, or late, on the 32nd of the month, that it would be valid...

תלמוד לומר אותם אותם אלה הם מועדי אין אלה הן מועדי קודם לזמנו תשעה ועשרים יום לאחר עיבורו שנים ושלשים יום.

The pasuk therefore teaches (Vayikra 23:2), "(that you shall call) them (OTAM)...these are My festivals." - the word OTAM is written without the letter 'vav', meaning that it can be read ATEM, you, that even if Beis Din made a mistake or even intentionally established it wrong, it is still valid. 'These are My festivals' - this is true only when they sanctified it at the expected time (on day 30 or 31 after the previous one), but on day 29 or 32, since it is not within the expected range, it is not valid.

EXTENDING THE YEAR FOR THE TRAVELLERS (Yerushalmi Halachah 2 Daf 5b)

ומניין שמעברין את השנה על הגליות שגלו ואדיין לא הגיעו

(a)

Question: From where do we know that they may extend the year for the sake of the travellers who left their homes in the Diaspora and will not arrive in time to bring the Pesach offering?

תלמוד לומר בני ישראל מועדי עשה מועדות שיעשו כל ישראל.

(b)

Answer: The pasuk teaches 'the children of Yisrael...the festivals (of Hash-m)' - (if the command is to Beis Din to fix the festivals, why are the children of Israel mentioned? To teach that) you should make the festivals that all of Yisrael should be able to keep them. (And if travellers will not arrive in Yerushalayim for the Pesach offering, then some of Yisrael will not be celebrating the festival. This gives Beis Din the permission to extend the year for the travellers.)

א"ר שמואל בר נחמן והן שהגיעו לנהר פרת.

(c)

(R. Shmuel bar Nachman): We do this for them as long as they have reached the Euphrates River (which is the border of Eretz Yisrael).

THE CORRECT VENUE TO EXTEND THE YEAR (Yerushalmi Halachah 2 Daf 5b)

אין מעברין את השנה אלא ביהודה ואם עיברוה בגליל מעוברת.

(a)

They should extend the year in Yehudah but if they did it in the Galil, it is valid.

העיד חנינה איש אונו שאם אינה יכולה להתעבר ביהודה שמעברין אותה בגליל.

(b)

Chaninah of Socho testified that if they are not able to extend it in Yehuda, they can do it in the Galil.

אין מעברין אותה בח"ל ואם עיברוה אינה מעוברת.

(c)

They may not extend it in Chutz La'Aretz (outside of the Land of Israel) and if they did, it is not valid.

אית חמי בגליל אין מעברין בחוצה לארץ מעברין.

(d)

Question: If they may not extend it in the Galil, would you think that they may do it in Chutz La'Aretz?

בגליל אין מעברין ואם עיברוה מעוברת בחוצה לארץ אין מעברין ואם עיברוה אינה מעוברת.

(e)

Answer: The meaning is - they may not extend it in the Galil, but if they did, it is valid. They may not extend it in Chutz La'Aretz and if they did, it is not valid.

ביכולין לעבר בארץ ישראל אבל בשאינן יכולין לעבר בארץ ישראל שמעברין אותה בחוצה לארץ.

(f)

If they are able to extend it in Eretz Yisrael, they may not in Chutz La'Aretz; but if they cannot extend it in Eretz Yisrael, they may extend it in Chutz La'Aretz...

ירמיה עיבר בחוצה לארץ. יחזקאל עיבר בחוצה לארץ. ברוך בן נריה עיבר בחוצה לארץ.

(As we find that several great Sages did so...) Yirmiyah, Yechezkel, Baruch ben Neriyah.

Chananyah nephew of R. Yehoshua extended the year in Chutz La'aretz. Rebbi sent him three letters with R. Yitzchak and R. Noson. In one, it was written, "To the Holiness of Chananyah" and in the second one was written, "The kids that you left behind have become goats" (meaning that there are now great Sages in Eretz Yisrael and you can no longer extend the year in Chutz La'Aretz).

ובחדא כתב אם אין את מקבל עליך צא לך למדבר האטד ותהי שוחט [דף ו עמוד א] ונחוניין זורק

And in the third letter was written, "If you do not accept upon yourself this ruling, go out into the Desert of HaAtad and you will slaughter and Nechunya (Head of the Exile) will throw the blood (because in your opinion, you could rebuild the Temple and offer sacrifices there).

קרא קדמייתא ואוקרון תנייתא ואוקרון תליתא בעי מבסרתהון

He read the first letter and he honored them. After the second, he still honored them. But after the third, he wanted to disgrace them.

אמרין ליה לית את יכיל דכבר אוקרתנין.

They said to him, "You cannot, because you have already honored us!"

קם ר' יצחק וקרא באורייתא אלה מועדי חנניה בן אחי ר' יהושע אמר אלה הם מועדי ה' אמר לון גבן.

R. Yitzchak got up and read in the Torah, "These are the festivals of Chananyah, brother of R. Yehoshua". He corrected them and responded, "These are the festivals of Hash-m". R. Noson replied to him, "But here, if Chananyah is extending the year in Chutz La'Aretz without permission, it is as if they are his festivals!"

קם רבי נתן ואשלים כי מבבל תצא תורה ודבר ה' מנהר פקוד. אמרין ליה כי מציון תצא תורה ודבר ה' מירושלם אמר לון גבן.

R. Noson got up and completed the curse (by adjusting the pasuk in Yeshayahu 2:3), "For from Bavel shall the Torah go out and the word of Hash-m...". They corrected him that the pasuk actually says, "For from Tzion shall the Torah go out, and the word of Hash-m from Yerushalayim". R. Noson replied, "That's true, but here, Chananyah has taken power for himself."

אזל קבל עליהן קמי רבי יהודה בן בתירה לנציבין. א"ל אחריהם אחריהם. א"ל לי נא ידע מה תמן. מה מודע לי דאינון חכמין מחשבה דכוותי. מכיון דלא ידעי מחשבה דכוותיה ישמעון ליה ומכיון דאינון חכמין מחשבה דכוותיה ישמע לון.

Chananyah went and complained about them to R. Yehuda ben Beseirah in Netzivin. R. Yehuda said to him - it is fitting that you follow their ruling (and refrain from extending the year in Chutz La'Aretz). Chananyah said - I know that the people I left behind in Eretz Yisrael were not as great as me. How do I know that they have become as fluent as me in making these calculations for the calendar? R. Yehuda said - According to what you say, they do not know the calculations like you, so they should listen to you. But since I say that they do know the calculations as well as you, you should listen to them.

קם רכב סוסיא הן דמטא מטא והן דלא מטא נהגין בקילקול.

Chananyah then travelled by horse (to inform as many people as possible that they should overturn his ruling and follow the calculations that were made in Eretz Yisrael). Wherever he reached, he informed them of this (and they adjusted accordingly). Wherever he did not reach, they remained with his original mistaken calculations.

כתיב ואל יתר זקני הגולה אמר הקב"ה ביותר הם [חביבה] עלי זקני הגולה חביבה עלי כת קטנה שבארץ ישראל יותר מסנהדרין גדולה שבחוצה לארץ.

(g)

The pasuk states (Yirmiyah 29:1), "and to Yeser elders of the Diaspora" - (The word yeser is understood here to mean important) Hash-m said, "The elders of the Diaspora are important to Me but a small group of people in Eretz Yisrael is even dearer to Me than the Great Sanhedrin in Chutz LaAretz".

(h)

Question: (Surely the elders of the Diaspora are more important) as the pasuk states (Melachim 2:24:16), "the Cheresh (literally: craftsmen) and the Masger (literally: gatekeepers) were one thousand". (The Gemara in Bavli Gitin 88a expounds that the word Cheresh and the word Masger refer to Torah Sages who came to Bavel. The word Cheresh means deaf/mute - as soon as these Sages begin expounding the Torah, all of the listeners go silent. The word Masger means closed - if these Sages are closed, that they cannot answer a question in Torah, it can never be reopened because no other person could possibly answer it. If so, how could you say that Hash-m prefers the people of Eretz Yisrael?

רבי ברכיה בשם רבי חלבו ורבנן. רבי ברכיה בשם רבי חלבו אמר החרש אלף והמסגר אלף ורבנן אמרי כולהן אלף.

(i)

R. Berechia citing R. Chelbo and Rabbanan had a dispute - R. Berechia citing R. Chelbo said that the word Cheresh represents 1000 Sages and Masger represents another 1000. Rabbanan said that they totalled 1000.

רבי ברכיה בשם רבי אילו החבירים ורבנן אמרין אילו הבולבוטין.

(j)

R. Berechia citing R. Chelbo said that these words refer to the Sages. Rabbanan said that it refers to the rich people.

רבי הושעיה כד הוה מקבל סהדיא בעיני טב הוה אמר לון הוו יודעין כמה עדות יוצא מפיכם כמה שכר בתים יוצא מפיכם.

When R. Hoshiyah would accept witnesses in Eynei Tav, he would say to them, "You should know how much bad can come from your testimony and how much wrongly paid rental money can come from your testimony!"

א"ר אבונה ואין כיני אפילו בדיני נפשות בת שלש שנים ויום אחד בא עליה הרי זה בסקילה נמלכו בית דין לעברו ובא עליה אינו בסקילה.

(l)

R. Avunah: You could even warn them that it can lead to the death penalty! If a man had relations with a girl who is forbidden to him and is aged 3 years and a day, he is punishable with stoning by Beis Din. But if the Beis Din decide to extend the year, so that when the crime was done, she was actually less than three, the man is not punishable with stoning.

א"ר אבין אקרא לאלהים עליון לאל גומר עלי בת שלש שנים ויום אחד נמלכו בית דין לעברו הבתולין חוזרין ואם לאו אין הבתולין חוזרין.

(m)

R. Avin: The pasuk states (Tehillim 57:3), "I will call out to Hash-m on high, to the God Who completes (His promise) for me" - if a girl was three years old and a day (and her Besulim (hymen) was broken) and Beis Din decided to extend the year, her Besulim will grow back; if not, they will not grow back.
