CAN THERE BE A TENAI IN NEDARIM AND SHEVU'OS? (Yerushalmi Perek 3 Halachah 1 Daf 8b)

אית תניי תני הרוצה אית תניי תני אף הרוצה.

(a)

Some teach [in the Seifa that R. Eliezer ben Yakov says,] 'one who wants', and some teach 'even one who wants';

מאן דמר הרוצה מסייע לרבי (בא) [צ"ל אמי - קרבן העדה] מאן דמר אף הרוצה מסייע לר' (אמי) [צ"ל בא - קרבן העדה]

The one who teaches 'one who wants', he supports R. Ami (R. Eliezer ben Yakov does not agree with the first Tana). The one who teaches 'even one who wants', he supports R. Ba (R. Eliezer ben Yakov agrees with the first Tana).

רבי פדת בשם רבי יוחנן מאן תנא נידרי זירוזין רבי טרפון.

(b)

(R. Pedas citing R. Yochanan): Who taught vows of persuasion? It is R. Tarfon.

כיני מתניתא כל נדר שאני עתיד לידור הרי הוא בטל ובלבד שיהא זכור בשעת הנדר בשלא התנה אבל אם התנה אף על פי שאינו זכור.

Our Mishnah says 'any vow that I will take later, it is Batel', as long as he remembers [this stipulation] at the time of the vow - this is when he did not stipulate [that it be Batel even if he does not remember], but if he stipulated, even if he does not remember [it is Batel].

בנדרים אבל שבועות (שבועות תניי) [צ"ל לא שבועות דתנאי - קרבן העדה] בנדרים ואין תניי בשבועות

(d)

Limitation: Our Mishnah discusses Nedarim, but not Shevu'os, for there can be a Tenai in Nedarim, but there is no Tenai in Shevu'os.

כהדא דתני שבועות הדיינין כתניין שבלבינו לא כתנויי שבלבכם.

(e)

Question (Beraisa): Shevu'as ha'Dayanim (Modeh b'Miktzas) is according to the Tenai in our (the judges') hearts, and not according to the Tenai in your (the ones who swear) hearts. (This implies that there is Tenai in Shevu'os!)

אמר רבי יודה כתניי (שבליבו) [צ"ל שבלבינו - גליון אפרים] הוא משביעו. ולמה הוא מתנה עמו מפני ההדיוטות שלא יאמרו יש תניין בשבועות.

Answer (R. Yudan): [Even though there is no Tenai in Shevu'os,] according to the Tenai in our hearts he imposes the oath on him. Why does he stipulate with him? It is due to commoners, lest they say 'there is a Tenai in Shevu'os.'

תני ר' חנניה קומי רבי מנא והא כתיב [דברים כט יד] כי את אשר ישנו פה.

Support (R. Chananyah, in front of R. Mana - Beraisa): It is written "Ki Es Asher Yeshno Po Imanu ha'Yom"!

Question (R. Mana): How do you learn from this?

א"ל מה דורות הבאים אחרינו אין בליבן תניי אף אנו אין בלבינו תניי:

Answer (R. Chananyah): Just like the generations that come after us, there is no Tenai in their hearts, also us, there is no Tenai in our hearts. (We explained this like SHA'AREI TORAS ERETZ YISRAEL, Sotah 7:1.)
