תלמוד בבלי מסכת גיטין דף לו. -לו:

תנן התם פרוסבול אינו משמט, זה אחד מן הדברים שהתקין הלל הזקן שראה את העם שנמנעו מלהלוות זה את זה ועברו על מה שכתוב בתורה הִשָּׁמֶר לְךָ פֶּן יִהְיֶה דָבָר עִם לְבָבְךָ בְלִיַּעַל וגו' (דברים טו:ט), עמד והתקין פרוסבול. וזה הוא גופו של פרוסבול, מוסרני לכם פלוני דיינין שבמקום פלוני שכל חוב שיש לי אצל פלוני שאגבנו כל זמן שארצה, והדיינים חותמים למטה או העדים. ומי איכא מידי דמדאורייתא משמטא שביעית והתקין הלל דלא משמטא? אמר אביי, בשביעית בזמן הזה ורבי היא דתניא רבי אומר וְזֶה דְּבַר הַשְּׁמִטָּה שָׁמוֹט (שם טו:ב), בשתי שמיטות הכתוב מדבר אחת שמיטת קרקע ואחת שמיטת כספים, בזמן שאתה משמט קרקע אתה משמט כספים בזמן שאי אתה משמט קרקע אי אתה משמט כספים; ותקינו רבנן דתשמט זכר לשביעית. ראה הלל שנמנעו העם מלהלוות זה את זה, עמד והתקין פרוסבול.

תא שמע דאמר שמואל לא כתבינן פרוסבול אלא אי בבי דינא דסורא אי בבי דינא דנהרדעא, ואי סלקא דעתך לדרי עלמא נמי תקין בשאר בי דינא נמי לכתבו? דלמא כי תקין הלל לדרי עלמא כגון בי דינא דידיה וכרב אמי ורב אסי דאלימי לאפקועי ממונא אבל לכולי עלמא לא.

תנן התם, השביעית משמטת את המלוה בין בשטר בין שלא בשטר. רב ושמואל דאמרי תרוייהו, בשטר - שטר שיש בו אחריות נכסים, שלא בשטר - שאין בו אחריות נכסים, כל שכן מלוה על פה! רבי יוחנן ורבי שמעון בן לקיש דאמרי תרוייהו, בשטר - שטר שאין בו אחריות נכסים, שלא בשטר - מלוה על פה, אבל שטר שיש בו אחריות נכסים אינו משמט.

... תנן התם המלוה את חבירו מעות על המשכון והמוסר שטרותיו לבית דין אין משמטין בשלמא מוסר שטרותיו לבית דין דתפסי להו בי דינא אלא מלוה על המשכון מאי טעמא אמר רבא משום דתפס ליה.

A loan for which a Pruzbul was written, is not cancelled by Shemitah. This is one of Hillel's enactments; he saw that people refrained from lending each other (due to fear that Shemitah cancel the loan), transgressing "beware, lest there be a base thought in your heart" (Devarim 15:9), so he enacted Pruzbul. The text of Pruzbul is, [the lender writes] 'I hand over to you, [names], the judges of the city [name], that all debts owed to me by so-and -so, I shall collect them whenever I want.' The judges or witnesses sign below. If mid'Oraisa the loan is cancelled, could Hillel enact that it is not cancelled?! Abayei: The Mishnah is like Rebbi, who says that cancellation of loans in Shemitah is only mid'Rabanan nowadays; a Beraisa states: "V'Zeh Devar ha'Shemitah, Ahamot" (ibid. 2); the verse discusses two Shemitos (abstentions), of money (not collecting loans), and of land (Rashi - not working the land in Shemitah; Tosfos - returning sold land to the seller in Yovel). (Tosfos - In an era) when Shemitah of land applies, Shemitah of loans applies, but when it does not apply, neither does Shemitah of loans. Chachamim [then] enacted cancellation of loans in Shemitah (even nowadays) to commemorate Shemitah. Hillel saw that people were not lending, so he enacted Pruzbul.

Shmuel said that Pruzbul may only be written in the Beis Din of Sura or Neharde'a. But if it was enacted for all generations, one should be able to write Pruzbul in any Beis Din! Perhaps the enactment for generations was to write it in a Beis Din like that of Hillel, or of Rav Ami and Rav Asi, which have power to make people's money Hefker; it may not be written in a simple Beis Din.

The Mishnah states, "Shemitah cancels a loan, whether or not it was written up in a document." Rav and Shmuel: 'A document was written' refers to a document with Acharayus (it gives rights to collect from property sold after the loan was given); 'a document was not written' means when there is a document without Acharayus -- and all the more so (Shemitah cancels) a loan without any document! R. Yochanan and Reish Lakish: 'A document was written' refers to a document without Acharayus; 'a document was not written' means there was no document; but if there is a document with Acharayus, the loan is not cancelled.

... "If one lent money and took a Mashkon (security), or handed over his documents to Beis Din, the loan is not cancelled in Shemitah. We understand that if he handed over his documents to Beis Din, they are the ones holding the debt. But why isn't the loan cancelled if he took a Mashkon? Rava: It is as if he is holding the payment.
