SHEMITAS KESAFIM

1) Reason -

What reasons are given for this Mitzvah?

1. Yosef Da'as to Gitin 36:p2, p3, ד"ה שמיטת כספים

2) How? -

Does Shemitah cancel a debt automatically, or must the lender verbally state "Meshamet Ani - I forgo payment due to Shemitah"?

1. Yosef Da'as to Gitin 37:p3, ד"ה המחזיר

3) "Af Al Pi Ken" -

Is the borrower encouraged to say "Af Al Pi Ken - ... but nevertheless!" - and voluntarily repay the loan?

1. Yosef Da'as to Gitin 37:p3, ד"ה מקפידתו, ד"ה אתה רואה

4) Repayment by force? -

When Shemitah has canceled a loan, if the borrower wishes to repay it, the lender must say "Meshamet Ani." If the borrower replies, "Af Al Pi Ken," the lender may accept the money. The Gemara (Gitin 37b) adds, "v'Talei Lei Ad d'Amar Hachi" (lit. he may hang until he says so). Does this mean that effectively, the lender can force the borrower to repay the loan? What then is accomplished by Shemitah?

PRUZBUL

5) How? -

How is a Pruzbul effective in over-riding the cancellation of all debts due to Shemitah?

6) Definition -

Is there a distinction between "Pruzbul" and "giving over one's loan documents to the Beis Din"?

1. Yosef Da'as to Gitin 36:p1, ד"ה פרוסבול

7) Requirements -

Does Pruzbul require an eminent Beis Din?
