Shimon holds that if [her father] claims Boshes and Pegam [and the Bo'el falsely swore that he is exempt] he is obligated a Korban for the Shevu'ah? (No oath applies when there are witnesses. If he admitted, R. Shimon holds that he is exempt!)

Answer #1 (Ri): That is when her father initially claimed from him. It is not applicable to say "we do not believe [the Bo'el to say that she was enticed]", like we say here;

Implied question: (We explain according to the opinion that Chetzi Nezek is a fine. The victim should not get anything. Even if the Neveilah decreased in value, and he receives less than half the damage,) he receives what is not proper for him! (Why do we say that also the victim pays?!)

מ"מ כיון דזכי ליה רחמנא חצי נזק חשבינן ליה בתשלומין מה שפחתה הנבלה

Answer: Even so, since the Torah awarded to him half-damage, we consider that he pays the decreased value of the Neveilah.

Answer: There, the [gored] ox did not die. Surely he should not sell his animal, for he expects the value to increase;

Explanation: Nothing was omitted;

דאי משום דמועד משלם כופר שלם ותם אינו משלם אלא חצי כופר

Suggestion: It omitted that Mu'ad pays full Kofer, and Tam pays only half Kofer!

הא לאו שיורא הוא דהא תנן תם משלם חצי נזק ומועד נזק שלם וכופר בכלל

Rejection: This is not an omission. The Mishnah teaches that a Tam pays half Nezek, and a Mu'ad pays full Nezek. Kofer is included!

Question: Still, it should teach that a Mu'ad, even when it is stoned, pays Kofer, but when a Tam is stoned, it does not pay Kofer at all;

This is because [the damager says] "bring it to Beis Din, and it will pay you", for it (a Tam) pays [for its damage] only from its body, like we say in Bava Kama (42a. Since it will be stoned, it is not worth anything!)

Answer: Also this is not an omission. It is included in what was taught "a Tam pays mi'Gufo, and a Mu'ad pays from the Aliyah (even more than its value).

Question: We do not find explicitly in any place that R. Yosi ha'Glili says that a Tam pays half Kofer!

When the ox is not stoned, e.g. one witness of the owner said that it killed, it is exempt due to Rabah's teaching;

Explanation (R. Tam): This is only if he seized the damager itself, but not if he seized something else. [Only] regarding seizing the damager itself, Chachamim were lenient that he may seize it;

If you would not says so, he would seize everything the damager has, and there would be no consequence of this that we do not judge fines in Bavel;
