STIPULATIONS THAT WERE NOT FULFILLED PRECISELY (Yerushalmi Perek 7 Halachah 5 Daf 43a)

[דף מג עמוד א] מתני' הרי זה גיטיך על מנת שתתני לי מאתים זוז הרי זו מגורשת ותתן

(a)

(Mishnah): [If one said] 'this is your Get on condition that you give me 200 Zuz', she is divorced, and she gives;

על מנת שתתני לי מיכן ועד שלשים יום נתנה לו בתוך שלשים יום מגורשת ואם לאו אינה מגורשת

[If he said] 'on condition that you give me within 30 days' - if she gave within 30 days, she is divorced. If not, she is not divorced.

אמר רבן שמעון בן גמליאל מעשה בציידן שאמר אחד לאשתו הרי זה גיטיך על מנת שתתני לי איצטליתי ואבדה איצטליתו אמרו חכמים תתן לו את דמיה:

R. Shimon ben Gamliel: A case occurred in Tzidon in which a man gave a Get on condition that she return his garment. She lost the garment. Chachamim ruled that she return its value.

גמ' תני לא הספיקה ליתן עד שמת. רבן שמעון ב"ג אומר תינתן לאביו ולאחיו והיא פטורה מן החליצה ומן הייבום.

(Gemara - Beraisa): If she did not give it before he died, R. Shimon ben Gamliel says, she gives to his father or brother, and she is exempt from Chalitzah or Yibum (the Get was valid).

אף בקידושין כן. הרי את מקודשת לי על מנת שאתן ליך מאתים זוז ולא הספיק ליתן לה עד שמת רבן שמעון בן גמליאל אומר אביו ואחיו נותנין לה והיא זקוקה לחליצה ולייבום.

The same applies to Kidushin. [If one said] 'you are Mekudeshes to me on condition that I give to you 200 Zuz', and he did not to give it before he died, R. Shimon ben Gamliel says, his father or brother gives to her, and she needs to do Chalitzah or Yibum (the Kidushin was valid).

אמר רבי יודן בשאבדה באונס אנן קיימין עשו אותה כמתנה שומר חנם להיות (פטור מן השבועה) [צ"ל כשואל - הג"ר מאיר שמחה]

(d)

(R. Yudan): [In the case in Tzidon,] she lost [the garment] through Ones. They made her like a Shomer Chinam who stipulates to be like a borrower (Tosefta Bava Metzi'a 8:9. This is why she must pay its value. However, she is not divorced, for the Tenai was to return the garment itself.)

Objection (R. Yosah): Do we come to teach that a Shomer Chinam can stipulate to be like a borrower?! Rather, we discuss when it was lost through negligence. [The Chidush is that] they made its value like the garment (paying is considered fulfilling the Tenai);

Note: R. Yudan holds that the Chidush is that even though he did not explicitly say that she will be like a borrower, this is understood; through accepting the Get with this Tenai, she accepted to be like a borrower (PF).

Chachamim say, this (the Reisha, a Tenai to give 200 Zuz) and the Seifa (a Tenai to return his garment) are due to Tanayim in Gitin. (In both cases, she may choose to give and be divorced, or not give and remain married. We explained this like R. MEIR SIMCHAH.)
