Of course, your question is presuming that Hash-m must keep the Torah. The Da'as Zekeinim in Beshalach (Shemos 14:2) says that Hash-m does not have to keep the Torah. (While we find that we are supposed to emulate His ways, this does not bind Him to following His laws which are made so that we can earn our portion in Olam Haba.) This is why He sits and judges us on Rosh Hashanah on Yom Kippur, even though we are not allowed to judge on these days. The Da'as Zekeinim also understands that this is the opinion of Rashi in Rosh Hashanah (30a, DH "Iy Nami").
