Leket must go to the poor. However, says the Mishnah, after Nemushos go through the field, the poor give up their rights (Ye'ush mi'Da'as) and therefore it is permitted to all. The question is that the Leket belongs to all poor people even from out-of-town. Even though they would give up their rights, they don't know when the Nemushos pass through the out-of-town field! Therefore, according to Abaye, Ye'ush does not work. If that is the case, how then can the Leket be taken by all? The answer is that the out-of-town poor, from the beginning, knowingly give up their rights. This is not a case of she'Lo mi'Da'as.
