DAF DISCUSSIONS - KESUVOS 19

Yosef Levin asked:

The eidim state that their signatures appear on the document, but that there was an unwritten stipulation that modified the document. Would the eidim be believed if the document specifically stated that there are no stipulations?

Yosef Levin, Wesley Hills, New York

The Kollel replies:

The Eidim would not be believed because they would be contradicting the Shtar. The Gemara says that the Eidim are only believed to say that there was a condition in the Shtar because this is not considered a contradiction to the Shtar, since the condition is considered a separate act from the one described in the Shtar. But if the Shtar states specifically that there was no condition, then they would not be believed.
