Hello kollel!

The rambam notes the king may take a 10th of produce and animals.

How does this interact with regular maaser? Does the king take first? Does he take after maaser rishon but before maaser sheni/ani? How does it work in shmitta?

2. The Kollel replies:

The Radak (Shmuel A 8:15) states that Ma'aser haMelech is after Ma'aser HaLevi'im. I would assume that the same is true about Ma'aser Sheni\Ani but I have no source to proove that. In Shmitta, the King, just like everybody else, can take what he wants, so it is probably a moot point in Hilchos Melachim. Perhaps we could question if the king is prohibited from taking more Shvi's fruits than he needs (like everyone else) or if the Din of Ma'aseer supercedes the Din of Shvi'is; I don't have a proof, but to my mind, the question doesn't begin - between the king and Hash-m, the king is a commoner like everybody else.
