DAF DISCUSSIONS - BAVA BASRA 115

1. Selim Dushey asks:

Regarding the ability of the deceased son's daughter's right to inherit over the deceased's daughter. Shouldn't that only be when that deceased son never had boys to begin with; so his daughter is inheriting directly from the father (just like Tzlaphad's daughters). If she had a brother that passed away; why should she have priority over the original deceased's own daughter that is still alive. Then the father and the son would be in the same position, why should the son's daughter prevail over the father's who is the deceased. Thank you.

Selim Dushey, Brooklyn, NY. USA

2. The Kollel replies:

Sholom Rav,

The son's daughter inherits her father in the grave, who in turn, takes precedence over his sister. Why should the fact that there was another brother who died make any difference?

Be'Virchas Kol Tuv,
