DAF DISCUSSIONS - MENACHOS 107

BERGMAN Mark asks:

The Mishna/Gemoro Menochos 107 discusses an neder of unspecified amount that one must bring an amount corresponding to the largest amount ever brought in one day?

Do you have an explanation why this should be so? (The menochos for 1st day sukkos on Shabbos were spread across many different korbonos etc, and why should a private neder depend on that)

The Kollel replies:

Sholom Rav,

The footnote in the 'Veshinantam' edition cites the S'fas Emes who asks your question. He answers by establishing the case where the Noder undertook to donate for the Tzibur. The same footnote also cites the Eizehu Mekoman who explains that, since the Noder does not remember what he declared, the one thing that is clear is that he did not undertake to bring more than the most wine that is brought on any one day; and he adds - like we find above in the Mishnah on 103b.

I would add that, if the Noder knew for sure that he did not have that in mind, he would not be Chayav to bring it - and seeing as he does not, it is possible that that is what he declared.
