DAF DISCUSSIONS - BAVA BASRA 97

1. A K asks:

The Shulchan Aruch brings down that you cant make kiddush on yoyin megulah because its not fitting for the mizbeach. Is this connected to the general issur of yayin megulim brought down in yoreh deah (siman 115) that there is a chashash a snake drank from it? And if so would the general dinim apply to yayim megulim by kidush as well? For example the tur brings down that there is no din of mashkeh megulah by yayin bevushal, would the same thing apply by kiddush? Does the din of yayin megulim by kiddush apply even if someone else is in the room?

Thanks

A K, Eretz Hakodesh

2. The Kollel replies:

Yes the flaw of Yayin Megule is synonymous with the wine that one does not drink due to the danger of a snake having tasted, and in general those Dinim would describe the wine we do not want to use for kiddush. Today people tend to be lax or lenient in these Dinim due to the assumption that our homes are places that "snakes are not usually present". Of course, one who lives in a more rural area might not be able to depend on this as much as city dwellers. If there are people in the room in close proximity to the wine it may be left uncovered .On the practical level (not a halachic instruction) this is even preferable for at least a few minutes before Kiddush as letting the wine "breathe" is meant to improve its taste. There may be a Kabbalic side to this question as well but if the wine was left open when there are people around the table this is just fine. I heard (if I'm not mistaken from HaGaon Rabi Noson Tzvi Finkel ztz"l) that Rosh Yeshivas Mir HaGaon Rabi Beinush Finkle ztz"l was accustomed that if there was a delay or something after the wine had been poured into the Kiddush cup he would tell one of the people at the table, "Keep an eye on the Kiddush cup".

3. A K asks:

Thank you for your response.

1. Would there be any nafkah minas between these 2 dinim in a place where snakes are common? In a place that has snakes the yayin is already assur to drink and so you can't drink the wine even the din of kiddush?

2. Also it should come out that you don't have to cover yayin mevushal lechatchila before kiddush (assuming mevushal by pasteurization is called mevushal)

Kol tuv and have a gut shabbas

4. The Kollel replies:

1) Perhaps. If one left the wine uncovered to air, but in a place that denies access to snakes, and it sat there long enough to affect the taste, it would be permitted to drink and disqualified for Kiddush. An example of this would be wine in the refrigerator, depending of course on the quality of the wine and the contents of the fridge. Please reference Orach Chaim 272, Sec 1 Mishna Berurah 3 Dirshu notes 4,5,6.

2) As far as Megulah is concerned, correct, but please remember that the use of Yayin Mevushal for Kiddush is a subject of major discussion. See Mishna Berurah 272, Sec 8, 9,22,23. About Pasteurization, please see ibid Dirshu notes 17; according to what is quoted there, pasteurized wine would still be able to become Pasul due to Meguleh.
