DAF DISCUSSIONS - PESACHIM 82

DANIEL GRAY asks:

Hi. 3 lines up from bottom 82a how is Kal v'Chomer employed without violating b'Kodshim Ein Lemeidim Lamed Min ha'Lamed (Zevachim 49 Setting the parameters of this rule will help answer the question (such as: while we can't learn from one korban to another type, we can learn between different levels of kedusah in same korban type).

DANIEL GRAY, Toronto Canada

The Kollel replies:

There is a girsa cited in the margin here that it is not actually a "Kol She-kein" but is in fact a "Hu Hadin". This is in fact the text of Tosfos here DH Bishlama.

According to this a Kal v'Chomer is not employed.

Follow-up reply:

It seems that even according to our text in the Gemara; that this is a "Kol seh-kein"; it is anyway not a Lamed Min ha'Lamed. The latter means that we learn B from A, where A was itself learnt by one of the 13 ways that the Torah is darshened. This is not the case in our Gemara. Our Gemara cites an explicit verse in Vayikra 7:19 that if Shelamim touched something tamei it must be burnt. [We will call this A]. The latter din is not a Lamed; it is not necessary to learn this by a drasha because it is an explicit verse. So when we learn Kodashei Kodashim from A this is not a Lamed Min ha'Lamed; it is a "Lamed Min HaMefurash".
