BS"D
Shalom,
I am yeshiva bochur in the old city of yerushalayim and I am currenlty working on a chiddush which might be a reference i found in Chiddushei HaRan (bavli Sanhedrin 75a ד"ה ואם איתא) regarding kiddush HaShem Bnei Noach. In the maskana to support his opinion the Ran cites a yerushalmi in Shevi't perek 3, the only problem as far as I can see it does not exist. The text apparently would read according to the maskana of chiddushei HaRan:
והכי איתא בהדיא בירושלמי במס שביעית פ"ג ר אבינא בעי קומי רבי אמי כותים מהו שיהיו מצווין על קדוש השם ר ניסא בשם ר אלעזר שמע לה מן הדא לדבר הזה יסלח י"י לעדך בבאי בית רתמון וגו ישראל מצווין על קדוש השם כותים אינן מצווין על קדוש השם
So therefore either it is to be found somewhere in Yerushalmi or it is a different girsa i guess, which would be quite weird because in the same perek I found no scent of a discussion on kiddush HaShem whatsoever!
This leads me to ask you the following questions:
In case in a different place, How could we retrieve it (anyone you know of that is a baki in yerushalmi)?
In case the whole section is unretrievable can it be relied upon to pasken halachah? In the (potentially geshmacke) chiddush I am working on, this source might make the difference (based on a potential machloiket i see between Rambam and Rashi) whether a bnei Noach would be chaif kiddush HaShem or not
Thanks in advance for your time and care
Moshe Yochanan
Hi Moshe Yochanan,
Your aspirations are extremely impressive.
The Yerushalmi you are looking for is in Perek 4 (פרק ד׳), Halacha 2 (הלכה ב׳). In the Bavli there is a form of this Yerushalmi just an Amid back (74b) but I assume you know that.
