DAF DISCUSSIONS - YEVAMOS 75

Benyamin Prys asks:

How does the Gemara learn the Tevilah of Mechusar Kaparah from the Pasuk of Ad Asher Yithar that refers to one who does not require Kaparah according to Rebbi Eliezer whom we hold like? Is it from a Kal v'Chomer from one who is not Mechusar Kaparah?

Thank you,

Binyamin Prys

The Kollel replies:

Rashi (DH Katav Rachmana) writes that we learn from the words "Ad Melos" (Vayikra 12:4) that even a woman who has just given birth who is a Mechusar Kaparah is Tahor at sundown. Tevilah and sundowh are sufficient.

Benyamin Prys asks:

Thank you. However, my question is as follows: according to R. Yishmoel (the shita the gemoro is considering at this stage) ad asher yithar is talking about a zav/metzora tevul yom (ie zav baal shtei reiyos and a metzora musgar), so how can the gemoro bring that possuk as a source for the din that a zav/metzora mechusar kaporo (ie zav baal sholosh reiyos and a metzora muchlat) need not only haarev shemesh but also tevila to become permitted to eat teruma? If it is through a kal vachomer from a zav/metzora tevul yom then lichoro a possuk to learn this din is superfluous altogether.

The Kollel replies:

The Gemara is in doubt about what the verse "Ad Asher Yithar" means. Rebbi Yishmael learns that it means merely Ha'arev Shemesh. However, the Gemara (75a) cites a Tana who argues with Rebbi Yishmael. That Tana learns that "Ad Asher Yithar" means that he has to bring his Korbanos in order to receive atonement and Taharah.

So the Gemara is not going only according to Rebbi Yishmael. It is also explaining according to the other way of understanding the Pasuk.
